Also,IagreewithJudgeWhitethatthestateimproperlyfailedtodisclosetothedefenseinpretrialdiscoverycertainoralstatementspurportedlymadebythedefendanttocertainlawenforcementagentswhowereinvestigatingtheshooting.However,Iquestionwhethersubstantiveharmtothedefendanthasbeenshowntothedegreethatwouldaffirmativelyappeartohaveaffectedthetrialresult. First,thestateshouldhavedisclosedthefactthatSergeantFitchstatedthatuponhisinquiryatthesceneshortlyaftertheshooting,thedefendanttoldhimthatshewasinthekitchenatthetimeoftheshooting.Giventhenatureofherlaterstatementsabouthandingtheshotguntothedeceased,thecontradictionbetweenthetwowasextremelyimportant.Ontheotherhand,thedefendantdidnotspecificallyobjecttoSergeant'sFitch'stestimonyaboutherstatement.Asimportantly,therecordreflectsthatDetectiveBradfordtestifiedthatthedefendanttoldhimthatshewasinthekitchenwhentheshotgundischarged.Thisstatementwasinhisoffensereportandthereisnoindicationintherecordthatthedefendantwasunawareofthecontentsofthatreport. Second,thestateshouldhavedisclosedthefactofandthespecificsofthedefendant'sdemonstrationtoChiefDeputyMullinsshowinghowtheshootingoccurred.Thedefendant'sdemonstrationwasconductedattherequestoflawenforcementduringheroralaccountoftheeventsbeinginvestigated,anaccountbeinggivenbyherinresponsetopoliceinterrogation.InStatev.Underwood,669S.W.2d700,704(Tenn.Crim.App.1984),thiscourtviewedadefendant'sdemonstrativereenactmentoftheeventsinissueas"evidenceinthenatureofadeclarationagainstinterest"andadmissibleagainstthedefendant.Insimilarfashion,itdefiescommonsensetosaythatthedemonstrationinthepresentcasewasnotdiscoverable,aswell,aspartof"thesubstanceofanyoralstatementwhichthestateintendstoofferinevidenceatthetrialmadebythedefendant...inresponsetointerrogationsbyanypersonthenknowntothedefendanttobealawenforcementofficer"asprovidedbyRule16(a)(1)(A),Tenn.R.Crim.P.Iconcludethatademonstrationgiveninaidofastatement,oralorotherwise,ispartofthatstatementfordiscoverypurposes. Toholdotherwisewouldbetobowtofinedistinctionshavingnorelevancetothepurposesforourdiscoveryrules.Forexample,adefendant'snodoftheheadupanddowninanswertoaquestionwouldnotbediscoverableunderthestate'sposition.Nor,apparently,wouldeitherthefactthatadefendanttellsaninterrogator,"Letmeshowyouhowithappened,"orthedetailsofsuchashowingbediscoverable.Inthepresentcase,thedutyonthestatetodisclosedidnotriseorfalluponwhetherChiefDeputyMullinssaidtothedefendant,"showme,"insteadof"tellme,"howtheshootingoccurred.Eitherway,thedefendant'sresponseisadiscoverablestatement. However,thetrialcourtrecessedtheproceedingsuntilthenextmorninginordertoallowthedefendanttohavetheopportunitytoexaminethestickthatwasusedinthedemonstrationandtopreparefortheuseofsuchevidence,includingfilingamotiontosuppressifthedefensesodesired.Therecordreflectsthatnofurtherobjectionormotionwasmaderegardingthisdemonstration.Inthisrespect,thedefendant'spresentcomplaintaboutthenondisclosureofthedemonstrationisnotaccompaniedbyanyshowingofsubstantiveprejudiceflowingfromthetrialcourt'srefusaltosuppressthedemonstrationevidence.Thus,Idonotbelievethatthestate'sfailuretodisclosethesemattersbeforetrialshouldresultinareversaloftheconviction. Astotheremainingissuesraisedbythedefendant,Idonotbelieveanymeritworthyofreversaloftheconvictionhasbeenshown.Inthisrespect,IconcurinJudgeCornelius'opinion.Otherwise,Idissentfromtheconclusionthatthiscasemustbereversedandretried.     _____________________________     JosephM.Tipton,Judge
