àAppellant€is€currently€serving€a€forty„five€year€sentence€for€robbery€with€aÏdeadly€weapon.€€In€his€petition,€œAppellant›€contends€that€his€forty„five€yearÏsentence€expired€in€1986€and€that€he€is€currently€being€held€illegally.€€He€alsoÏœalleges›€that€the€State€was€improperly€granted€the€hearing€at€which€his€petition€forÏhabeas€corpus€was€denied.€€The€trial€judge€dismissed€his€petition€finding€thatÍœAppellant›€must€œserve›€the€portion€of€his€sentence€from€his€escape€in€1980€to€hisÏextradition€from€New€York€in€1992.ÌÌà àœIn›€January€œ1964,›€œAppellant›€was€sentenced€to€serve€forty„five€years€inÏprison€for€robbery€with€œa€deadly›€weapon.€€Under€the€terms€of€œthat›€sentence,€theÏœAppellant›€would€have€been€eligible€for€parole€as€early€as€1984,€and€his€sentenceÏwould€have€expired€in€1986.€€Upon€the€recommendation€of€the€Board€of€œPardons›Ïand€œParole,›€Governor€œWinfield›€Dunn€commuted€his€sentence€to€twenty€years€onÏDecember€œ15,›€1971.€€ÌÌà àœAppellant›€was€released€on€parole€on€December€20,€1972.€€The€conditionsÏof€his€parole€included€that€he€would,€ð ðlead€the€life€of€a€good€œcitizen;›€obey€all€theÏlaws€of€the€nations,€states€and€œmunicipalities;›€and€shall€not€be€guilty€of€otherÏconduct,€in€the€opinion€of€the€œGovernor›€improper€and€illegal.ðð€€Violation€of€œany€ofÏthe›€conditions€would€result€in€the€revocation€of€the€commuted€sentence.€€TheÏGovernor€would€be€the€sole€determiner€of€whether€œany€of€the›€conditions€had€beenÍviolated.€€Under€œthe€terms€of€his€parole,›€€œAppellant›€resided€at€the€OpportunityÏHouse€in€Davidson€County€and€worked€at€the€Nashville€Painting€Corporation.ÌÌà àOn€August€5,€1973,€œAppellant›€was€arrested€and€charged€with€armedÏrobbery,€carrying€a€weapon,€and€possession€of€marijuana.€€A€parole€violationÏwarrant€was€issued€two€days€later.€€On€August€29,€a€preliminary€hearing€was€heldÏto€determine€if€there€was€probable€cause€to€believe€that€œAppellant›€had€beenÏinvolved€in€the€incident.€€Ultimately,€œAppellant›€was€not€charged€with€œa€parole›Ïviolation€because€œit›€was€unclear€if€he€had€been€involved€with€one€or€six€armedÏrobberies€and€because€the€parole€warrant€had€been€issued€to€prevent€œAppellant›Ïfrom€making€bond.ÌÌà àœAppellant›€attempted€to€contact€his€parole€counselor€on€August€31,€1973,Ïbut€was€told€to€telephone€again€because€his€œcounselor›€was€not€available.€ÏœAppellant›€did€not€contact€his€œparole€officer›€again.€€The€Board€of€Probation€andÏParoles€declared€him€delinquent€on€January€25,€1974.€€He€was€arrested€for€hisÏabsconding€status€on€February€œ3,€1974.›ÌÌà àIn€his€preliminary€hearing€on€March€6,€œAppellant›€first€claimed€that€heÏthought€his€commuted€sentence€expired€in€August€1973.€€He€later€admitted€thatÏhe€was€aware€his€sentence€did€not€expire€until€January€20,€1975.€€The€hearingÍofficer€concluded€that€probable€cause€œexisted€to›€œbelieve›€that€œAppellant›€violatedÏhis€parole€by€absconding€to€avoid€parole€supervision.ÌÌà àœAppellantððs›€parole€revocation€hearing€was€held€May€22,€1974.€€At€theÏconclusion€of€the€hearing€the€Board€told€the€œAppellant›€it€would€recommend€toÏGovernor€Dunn€that€his€parole€be€revoked.€€Revocation€would€result€in€a€paroleÏdate€in€1985€and€a€sentence€expiration€date€in€1986.€€Governor€œWinfield€Dunn›Ïœrevoked›€œthe›€œAppellantððs€commutation›€on€October€28,€1974.ÌÌà àAlmost€one€year€later,€on€September€9,€1975,€œAppellant›€was€convicted€ofÏrobbery€with€a€deadly€weapon,€the€crime€being€committed€while€on€parole.€€OnÏOctober€28,€œ1975€he›€received€a€five€to€seven€year€sentence€for€that€crime.€€TheÏcourt€stated€that€the€sentence€ð ðshall€run€at€the€expiration€of€present€sentence€nowÏbeing€œservedðð›€by€the€œAppellant.›ÌÌà àOn€July€4,€1980,€œAppellant›€escaped€from€the€Tennessee€StateÏPenitentiary,€and€a€warrant€for€his€arrest€was€issued.€€He€remained€on€escapeÏstatus€until€he€was€extradited€from€New€York€and€returned€to€custody€on€April€8,Ï1992.€€The€Department€of€Correction€calculated€that€he€lost€4,296€days€during€hisÏescape.€€He€will€be€eligible€for€probationary€parole€on€January€23,€1999€andÏregular€parole€on€January€23,€2000.€€His€sentence€will€expire€on€July€24,€2000.ÌÌà@ àœAppellant›€raises€three€issues€concerning€the€dismissal€of€his€petition€ofÏhabeas€corpus€„„€whether€the€petition€was€proper€and€sufficient€under€theÏcircumstances;€whether€the€trial€court€erred€by€dismissing€the€writ€without€aÏbenefit€of€a€full€evidentiary€hearing;€and€whether€the€œAppellant›€is€beingÏincarcerated€for€an€ð ðarises€out€of€theðð€offense€forÏwhich€the€credit€is€claimed.€€òòE.g.óó,€òòSmith€v.€McWherteróó,€1987€WL€6069€(Tenn.€œCrim›.ÏApp.€1987).€€When€œAppellant›€escaped€from€custody€on€July€4,€1980,€he€stoppedÏreceiving€credit€toward€his€sentence.€€That€œAppellant›€was€never€charged€œwith€or›Ïconvicted€for€his€escape€has€no€bearing€on€whether€his€sentence€has€expired.€ÏòòœCf›.óó€òòState€v.€œAbbott›,óó€617€S.W.2d€172,€œ173„74›€(Tenn.€œCrim›.€App.€1981)(finding€thatÏan€escaped€felon€who€was€not€charged€with€the€escape€was€required€to€serve€theÏremainder€of€his€incomplete€sentence.)ÌÌà àà àœAppellant›€also€argues€that€he€was€denied€a€full€evidentiary€hearing.€ÏThe€trial€court€is€not€required€as€a€matter€of€law€to€grant€the€writ€and€conduct€anÏinquiry€into€the€allegations.€œ€Rather€a€petition€that€fails€to€state€a€cognizable€claimÏmay€be€summarily€dismissed€by€the€trial€court.€€òòPassarella›óó,€891€S.W.2d€at€627.€€AÏhearing€is€not€warranted€when€the€facts€alleged€in€the€petition,€even€if€true,€wouldÏnot€serve€as€the€basis€for€œrelief.€€òòde€la€Beckwith€v.€Evattóó,€819€S.W.2d€453,€458Ï(Tenn.€Crim.€App.€1991)€citing€òòRussell›€v.€Willisóó,€œ222€Tenn.€486,€437›€S.W.2d€529,Ï531€œ(1969)€and€òòState€ex€rel.€Kuntz€v.€Bomaróó,€supra.€€The›€only€facts€in€dispute€areÏthe€dates€of€œAppellantððs›€release.€€However,€the€evidence€œAppellant›€presents€in€hisÏappeal€clearly€shows€that€he€failed€to€serve€the€last€six€years€of€his€1964Íconviction€and€that€he€is€not€entitled€to€be€released.€€Assuming€that€all€theÏdocumentation€œAppellant›€placed€in€his€brief€had€merit,€œAppellant›€would€not€beÏentitled€to€relief€and,€consequently,€an€evidentiary€hearing€is€not€warranted.€ÏHowever,€attachments€to€briefs€are€not€evidence€and€will€not€be€considered€byÏthe€appellate€courts.€€Appellant€is€to€remain€incarcerated€until€he€serves€theÏremainder€of€his€sentence€for€his€1964€conviction.ÌÌà
