Atthebeginningofthepostconvictionevidentiaryhearing,thepetitioneragainclaimedthattherecklessdrivingconvictionwasvoid.Attheendofthehearing,thepetitionerarguedthathewasnotadvisedofhisrightswhentherecklessdrivingconvictionwasenteredandthathedidnotagreetosuchaconviction.Thetrialcourtfoundthatthewarrantwaseffectivelyamendedtorecklessdrivingwiththeagreementofthepetitioner,throughhiscounselandwithcounselsadvice.Itnotedthatthepetitionermadenoclaimofineffectiveassistanceofcounselandconcludedthattheconvictionupontheamendedwarrantforrecklessdrivingwasvalid. Ibelievethattherecordbeforeusshows,withoutquestion,thatthedeterminationofguiltforrecklessdrivingintheoriginalprosecutionresultedfromadealreachedwiththeconsentofthepetitionerandhiscounsel.ItalsoshowsthattheresultwasobtainedthrougharoughhewnamendmenttotheDUIwarrant,effectivelychangingittoarecklessdrivingwarrant.Anydisagreement,objection,orconcernthenexistinginthepetitionersmindshouldhavebeenaddressedinanappealoftheconvictiontothecircuitcourt. Forthefirsttime,thepetitionersbriefonappealstatesthatthèpostconvictionpetitionwas ontheprimarygroundsofineffectiveassistanceofcounsel...,astatementthatispatentlyincorrect.Also,hisbriefassertsthatthechargingwarrantcouldnotbeamendedwithouthisconsentorafterjeopardyattached.However,itignoresthetrialcourtsfindingthatthepetitioneragreedtotheamendment.Theresimplyexistsnobasisforgrantinganyformofpostconvictionrelief. Inthisrespect,Icannotagreewiththeresultreachedinthemajorityopinion.Asthatopinionindicates,thiscasepresentsadisturbingpictureofconvenientjusticethatshouldnotbecondonedinasocietygovernedbytheruleoflaw.Theresultreachedinthemajorityopinionconstitutesfittingirony,indeed,intermsofgrantingthepetitioner reliefthatactuallyplaceshimbackinthepositionoffacingachargeofDUI,thirdorsubsequentoffensefromthefryingpanintothefire.ButIfear,though,thatitwouldtakeourignoringthepostconvictionlawtodoso.Weshouldnotgiveintothetemptation.Thefactthata greatroadthroughthelaw 0   ׀wascutbythepetitioner,hisoriginalcounselandthegeneralsessionsjudgeforsomemutuallyconvenientpurposeshouldnotmeanthatweoughttotravelthesameroadnomatterhowpoeticoraptthejusticeweseeatroadsend.Therefore,Idissent.      ____________________________      JosephM.Tipton,Judge
