Weaffirmthejudgmentofthetrialcourt.  OnApril15,1980,theDyerCountyGrandJuryreturnedoneindictmentagainstthepetitionerforattemptingtoobtainacontrolledsubstancebyuseofanalteredprescriptionandtwoindictmentsforobtainingacontrolledsubstancebyuseofanalteredprescription.OnOctober6,1980,thepetitionerenteredpleasofguilttoeachofthecharges.Thetrialcourtimposedthreeconcurrentoneyearsentences,suspendedthesentences,andorderedaprobationarytermoftwoyears.  ThispostconvictionpetitionwasfiledApril26,1996.Thepetitionercomplainedthathehadnotbeenfullyadvisedofhisrightagainstselfincriminationandwouldnothavepledguiltyhadhebeeninformedofthecollateralconsequencesoftheconvictions.Inthemeantime,the1980convictionshadbeenused,heclaimed,toenhancehispunishmentforafederaloffense. 2   כ    Therewasnostatuteoflimitationsatthetimethepetitionerenteredhisguiltypleas.ThelegislatureestablishedathreeyearstatuteoflimitationsonJuly1,1986,ruledeffectiveJuly3,1989.SeeTenn.CodeAnn.4030102(repealed1995);seealsoAbstonv.State,749S.W.2d487(Tenn.Crim.App.1988).EffectiveMay10,1995,thenewPostConvictionProcedureActreplacedtheprioractinitsentirety.See1995Tenn.Pub.Act207,1and3.Themostrecentlegislationadoptedaoneyearlimitation:8 8 (a)...[A]personincustodyunderasentenceofacourtofthisstatemustpetitionforpostconvictionreliefunderthispartwithinone(1)yearofthedateofthefinalactionofthehigheststateappellatecourttowhichanappealistakenor,ifnoappealistaken,withinone(1)yearofthedateonwhichthejudgmentbecamefinal,orconsiderationofsuchpetitionshallbebarred.Thestatuteoflimitationsshallnotbetolledforanyreason....8 8 (b)Nocourtshallhavejurisdictiontoconsiderapetitionfiledaftersuchtimeunless:8 8  (1)Theclaiminthepetitionisbaseduponafinalrulingofanappellatecourtestablishingaconstitutionalrightthatwasnotrecognizedasexistingatthetimeoftrial,ifretrospectiveapplicationofthatrightisrequired.Suchpetitionmustbefiledwithinone(1)yearoftherulingofthehigheststateappellatecourtortheUnitedStates[S]upreme[C]ourtestablishingaconstitutionalrightthatwasnotrecognizedasexistingatthetimeoftrial;8 8  (2)Theclaiminthepetitionisbaseduponnewscientificevidenceestablishingthatsuchpetitionerisactuallyinnocentoftheoffenseoroffensesforwhichthepetitionerwasconvicted;or8 8  (3)Theclaimassertedinthepetitionseeksrelieffromasentencethatwasenhancedbecauseofapreviousconvictionandsuchconvictioninthecaseinwhichtheclaimisassertedwasnotaguiltypleawithanagreedsentence,andthepreviousconvictionhassubsequentlybeenheldtobeinvalid,inwhichcasethepetitionmustbefiledwithinone(1)yearofthefinalityoftherulingholdingthepreviousconvictiontobeinvalid.Tenn.CodeAnn.4030202(Supp.1996).̜Ǜ  Becausetheconvictioninthiscasebecamefinalin1980,thispetitionappearstohavebeenbarrednotonlybythecurrentoneyearstatuteoflimitationsbutalsotheformerthreeyearstatute.Moreover,thegroundsraiseddonotappeartofallwithinanyoftheexceptionssetoutinTenn.CodeAnn.4030202(b)(1),(2),or(3)(Supp.1996).  Thatpetitionermaynothavebeenadvisedofhisrightagainstselfincriminationandmaynothavereceivedtheeffectiveassistanceofcounseldoesnotcreateanexceptiontothestatuteoflimitations.Ourcourthasheld"ignoranceoftheexistenceofthestatuteoflimitations,evenwhenallegedtostemfromanattorney'snegligentfailuretorenderadvicetothepetitioner,doesnottolltherunningofthestatuteoflimitations."Statev.Phillips,904S.W.2d123,124(Tenn.Crim.App.1995).  Thepetitionerarguesthatthe1995ActcreatesanewoneyearfilingϜperiod.Aportionofthe1995Actprovidesasfollows:8 8 Thisactshalltakeeffectuponbecomingalaw,thepublicwelfarerequiringitandshallgovernallpetitionsforpostconvictionrelieffiledafterthisdate,andanymotionswhichmaybefiledafterthisdatetoreopenpetitionsforpostconvictionreliefwhichwereconcludedpriortotheeffectivedateofthisact.Notwithstandinganyotherprovisionofthisacttothecontrary,anypersonhavingagroundforreliefrecognizedunderthisactshallhaveatleastone(1)yearfromtheeffectivedateofthisacttofileapetitionoramotiontoreopenunderthisact.1995Tenn.Pub.Act207,3(emphasisadded).
