FACTS    Theappellant'sindictmentonthechargeofrecklessendangermentreadasfollows:8 ...didunlawfullyandrecklessly,byuseofadeadlyweapon,towit:apistol,engageinconductwhichplacedotherpersons,whoseidentitiesaretotheGrandJurorsaforesaidunknown,inimminentdangerofdeathorseriousbodilyinjury....Theindictmentstemmedfromtheappellant'sactsofdischargingapistolintotheairorupintoatree. 0   ׀Therewasnotestimonythatanyonewaseitherinthetreebeingfireduponoroutsidetheapartmentbuildingintheimmediatevicinityoftheappellant.  ANALYSIS    RecklessendangermentisproscribedinTenn.CodeAnn.3913103(1991Repl.).Thestatuteprovidesthat:8 (a)Apersoncommitsanoffensewhorecklesslyengagesinconductwhichplacesormayplaceanotherpersoninimminentdangerofdeathorseriousbodilyinjury.8 (b)RecklessendangermentisaClassAmisdemeanor;however,recklessendangermentcommittedwithadeadlyweaponisaClassEfelony.Tenn.CodeAnn.3913103.Accordingly,recklessendangermentiscouchedintermsofrisktoanotherpersonproducedbyone'sconduct.ThisCourthaspreviouslyrecognizedthepotentially"absurd"and"unreasonable"resultsthatmayarisefrompermittingprosecutionofonedischarging"aweaponunderanycircumstanceswhereanyotherhumanbeingmightpossiblybepresentorwhereastraybulletmightpossiblystrikeanotherperson."Statev.Culbertson,No.03C019412CR00449,slipop.at2(Tenn.Crim.App.Aug.30,1995). Wefindtheappellant'smeredischargeofaweaponintotheairorupintoatreetopdidnot"placeanotherpersoninimminentdangerofdeathorseriousbodilyinjury."Merelydischargingagun,standingalone,isnotsufficienttoconstitutecommissionofrecklessendangerment.SeePeoplev.Richardson,97A.2d693(N.J.Super.Ct.App.Div.1953)(holdingdischargeofgunintoairdoesnotconstituterecklessendangerment).Thedischargemustcreateanimminentriskofdeathorseriousbodilyinjurytosomepersonorclassofpersons.Thestate'sproofhasfallenshortofthisrequirement.Thejudgmentofthetrialcourtis,therefore,reversed.
