àThe€appellant,€Milton€Franklin,€Jr.,€entered€a€plea€of€guilty€to€sellingÏdihydrocodeinone,€a€Class€D€felony.€€The€trial€court€found€that€the€appellant€was€aÏstandard€offender€and€imposed€a€Range€I€sentence€consisting€of€confinement€for€twoÏ(2)€years€in€the€Department€of€Correction.€€In€this€Court,€the€appellant€contends€that€theÏtrial€court€should€have€suspended€his€sentence€and€placed€him€on€probation,€or,€in€theÏalternative,€sentenced€him€pursuant€to€the€Tennessee€Community€Corrections€Act€ofÏ1985.€€After€a€thorough€review€of€the€record,€the€briefs€of€the€parties,€and€the€lawÏgoverning€the€issue€presented€for€review,€it€is€the€opinion€of€this€Court€that€theÏjudgment€of€the€trial€court€should€be€affirmed.Ìà àThe€appellant€was€thirty„seven€years€of€age€when€he€was€sentenced.€€He€isÏmarried.€€Five€children€were€born€to€this€union.€€He€finished€the€tenth€grade€of€formalÏschooling.€€According€to€the€appellant,€he€left€to€join€the€United€States€Army.€€HeÏobtained€his€diploma€while€in€the€military.€€€Later,€he€supposedly€attended€IndianaÏUniversity,€Big€Ben€Community€College€in€Germany,€and€Rose€State€College€inÏOklahoma.€€He€advised€the€presentence€officer€that€he€attended€Livingston€Area€StateÏVocational€Technical€School,€where€he€obtained€a€license€in€cosmetology.Ìà àThe€Presentence€Report€€indicates€that€the€appellant€worked€for€a€periodÏbetween€June,€1989€and€April,€1991.€€He€testified€at€the€sentencing€hearing€that€heÏhad€been€working€for€two€weeks€at€a€company€that€sold€and€installed€satellite€dishesÏand€cable€systems.€€The€appellantððs€wife€is€disabled€and€receives€monthly€benefits€ofÏ$446.€€She€is€also€entitled€to€aid€to€dependent€children,€which€totals€$305,€foodÍstamps,€and€medical€care.Ìà àThe€appellant€has€a€prior€record.€€He€has€been€convicted€of€involuntaryÏmanslaughter,€driving€while€license€suspended,€and€driving€while€license€revoked,Ïtwo€counts.€€He€was€convicted€of€speeding€and€required€to€attend€safety€school.€€HeÏwas€also€charged€with€larceny€from€a€retailer,€shoplifting,€in€Oklahoma.€€He€wasÏgranted€a€ð ðdeferred€disposition,ðð€a€form€of€diversion.Ìà àIn€1986,€the€Fentress€County€Sheriff€served€a€search€warrant€at€the€residenceÏwhere€the€appellant€and€his€family€resided.€€The€officers€found€a€large€patch€ofÏmarijuana€growing€behind€the€residence.€€The€appellantððs€wife€took€responsibility€forÏthe€marijuana.€€€The€appellant€was€not€charged€in€the€incident.Ìà àOn€July€16,€1993,€a€confidential€informant€was€sent€to€the€appellantððs€home€toÏpurchase€dihydrocodeinone.€€The€appellant€sold€the€drug€to€the€informant.€€BasedÏupon€this€sale,€the€sheriffððs€department€obtained€a€search€warrant€for€the€appellantððsÏresidence.€€The€officers€found€a€large€patch€of€marijuana€growing€behind€theÏappellantððs€residence.€€They€also€found€books€on€how€to€grow€marijuana€andÏmarijuana€seed€catalogs.€€The€appellant€had€$3,690€on€his€person.€€The€officers€foundÏa€list€of€drugs€and€prices€in€the€appellantððs€wallet.€€Seventeen€vehicles€came€to€theÏappellantððs€residence€while€the€officers€were€present.€€When€the€drivers€saw€the€policeÏcruisers,€they€turned€around€and€left.€€Ìà àThe€sheriff€testified€that€two€of€the€drugs€found€on€the€appellantððs€list,€Tylox€andÏPercoset,€had€ð ðjust€destroyed€some€of€the€younger€generation€in€Fentress€County€andÏsurrounding€counties.ðð€€He€also€testified€that€ninety€percent€or€more€of€the€peopleÏarrested€for€forgery€and€uttering€forged€paper€had€either€been€arrested€for€a€drugÍoffense€or€were€addicted€to€drugs.€€Ninety„eight€percent€of€the€people€who€committedÏthe€offenses€of€burglary€and€larceny€had€either€been€arrested€for€a€drug€offense€orÏwere€addicted€to€drugs.Ìà àThe€appellant€admitted€that€he€had€$3,690€in€his€possession€when€the€searchÏwarrant€was€executed.€€He€stated€that€his€sister€had€obtained€a€loan€for€$3,000€andÏgave€it€to€the€appellant€and€his€wife€to€purchase€a€van.€€They€had€borrowed€the€otherÏ$600€from€friends€to€go€towards€the€purchase€price€of€the€van.€€Later,€the€owner€of€theÏvan€was€murdered.€€He€died€inside€the€van.Ìà àWhile€the€appellant€admitted€that€he€was€addicted€to€Tylox€and€marijuana,€heÏdenied€having€any€interest€in€the€marijuana€growing€behind€his€residence.€€He€did€notÏadmit€or€deny€selling€any€other€drugs.Ìà àThe€trial€court€did€not€believe€the€appellantððs€testimony.€€The€court€noted€that€theÏappellant€had€been€engaged€in€the€drug€business€for€an€extended€period€of€time.€€HeÏhad€no€other€means€of€support.€€The€trial€court€also€noted€the€appellantððs€prior€record.€ÏThe€court€denied€an€alternative€sentence€based€upon€these€two€factors.Ìà àThis€Court€has€conducted€a€òòdeóó€òònovoóó€review€of€the€record€pursuant€to€Tenn.ÏCode€Ann.€ðð€40„35„401(d).€€The€findings€of€the€trial€court€have€been€given€theÏrequisite€presumption€of€correctness.€€This€Court€notes€that€an€accusedððs€lack€ofÏcandor€is€a€matter€which€can€be€considered€when€determining€whether€the€accusedÏcan€be€rehabilitated.€€Also,€the€appellantððs€convictions€may€be€considered€in€makingÏthis€determination.€€Here,€the€appellant€was€convicted€for€offenses€occurring€in€1979,Ï1985,€1989,€1990,€and€1993,€approximately€two€and€one„half€months€before€he€wasÏarrested€for€selling€the€drugs€to€the€informant.€€In€other€words,€these€offenses€did€notÍoccur€during€a€short€period€of€time.Ìà àIt€is€a€well„established€rule€that€the€appellant€has€the€burden€of€establishingÏhow€or€why€the€sentence€imposed€by€the€trial€court€is€erroneous.€€In€this€case,€theÏappellant€has€failed€to€overcome€the€presumption€of€correctness€afforded€the€trialÏcourtððs€findings.€€This€Court€agrees€that€the€appellant€was€not€entitled€to€leniency€„„€anÏalternative€sentence.€€Based€upon€his€background€and€testimony,€his€ability€to€beÏrehabilitated€is€questionable€at€best.€€Furthermore,€the€appellant€has€been€granted€anÏalternative€sentence€in€the€past.€€He€did€not€learn€from€this€experience.ÌÌÓÓÌà
