Astheofficerarrivedatappellantsapartment,aladycametothedoor.OfficerTurneraskedherifshewasappellant.Theladyrespondedthatshewouldsummonher.Afteradelay,appellantappearedatthedoor,shoutingandcursingtheofficer.Theofficerleanedagainstthedoorframe,withhishanddirectlyontheframeitself.Appellantstoodinthedoorwayasshecontinuedtoloudlyandrepeatedlydemandthattheofficerleave.OfficerTurnerattemptedtoinformappellantthathesimplywishedtocautionheraboutmakingthreateningtelephonecalls.Becauseofappellantsdemeanor,hewasunsuccessfulinthisendeavor.Appellantsuddenlyslammedthedoor,strikingOfficerTurnersthumb.Thecontactofthedoorwiththeofficersthumbpreventedthedoorfromclosing.Theofficerthenenteredappellantsapartmentandimmediatelyeffectedanarrestofappellantforassaultanddisorderlyconduct. AppellantfiledapretrialmotiontosuppressatestimonyconcerningmatterswhichoccurredafterOfficerTurnerenteredappellantsapartmenttoeffectherarrest.ShestatesthatPaytonv.NewYork445U.S.573,100S.Ct.1371(1980)prohibitsawarrantlessentryintothedwellingofadefendantwithoutexigentcircumstances.ShealsosubmitsthattheentryviolatedT.C.A.407107(the knockandannouncerule). Sinceappellantwasonlyconvictedonassault,weshallconfineourdiscussiontoevidenceofthatcrime. Appellantmissestheentirepointofthecase.Thecrimehadalreadybeencommittedwhentheofficerenteredappellantsapartment.Anyevidenceofwhatoccurredthereindoesnotbearupontheelementsofthecrimeandwouldbe,atbest,ofgeneralrelevance.Anyerror,therefore,intheadmissionthereofwouldbeharmless.Chapmanv.California386U.S.18,87S.Ct.824,17L.Ed.2d705(1967). Weareawarethatappellantinsiststhatthefactsoccurredverydifferently,however,averdictofguilt,approvedbythetrialjudge,accreditsthetestimonyoftheState'switnessesandresolvesallconflictsintestimonyinfavoroftheState.Statev.Townsend525S.W.2d842(Tenn.1975).
