OnNovember19,1993,thedefendantpledguiltytotheftover$1,000.00andreceivedafouryearsentence.Thesentencewassuspendedandprobationimposedafterheservedninetydays.HewasthenconvictedinKentuckyofchargesthatwerependingatthetimeofthetheftconviction.VickieFarrar,thedefendant'sprobationofficer,testifiedthatthedefendantescapedwhilehewasservinghissentenceontheKentuckyconvictions.ShesaidthathewasapprehendedinFloridaapproximatelysixweeksaftertheescapeandthathedidnotcontactherwhilehewasonescapestatus.Thedefendantdid,however,writeheraletterafterhewasextraditedbacktoCoffeeCounty.Intheletter,thedefendantapologizedforleavingKentuckyandaskedhernottorevokehisprobation. Itwaswithinthetrialcourt'sdiscretiontorevokethedefendant'sprobationifitfoundbyapreponderanceoftheevidencethatthedefendantviolatedaconditionofhisprobation.T.C.A.4035310,311(d);Statev.Mitchell,810S.W.2d733,735(Tenn.Crim.App.1991).Iftherecordcontainssubstantialevidencetosupportthetrialcourt'sconclusionthatthedefendantviolatedaconditionofhisprobation,noabuseofdiscretionwillbefound.Id. Therewassubstantialanduncontrovertedevidencetosupportthetrialcourt'sconclusionthatthedefendantviolatedtheconditionsofhisprobation.ByescapingandleavingKentuckywithoutnotifyinghisprobationofficer,thedefendantviolatedthefirstandfifthconditionsofhisprobation:  8 (1)IwillobeythelawsoftheUnitedStates,oranyStateinwhichImaybe,aswellasanymunicipalordinances.0 ...8 (5)Iwillinformmyprobationofficerbeforechangingmyresidenceoremployment.IwillgetthepermissionofmyprobationOfficerbeforeleavingtheState.
