Ðshortly€thereafter,€she€saw€Mr.€Fleming€point€a€gun€at€Mr.€Smith€and€order€him€onÏthe€floor.€€Mr.€Fleming€then€stabbed€Mr.€Smith€with€a€knife.Ìâ âÌà ` àOfficer€Melanie€Lewis€of€the€Memphis€Police€Department€testified€that€onÏNovember€20,€1996,€she€went€to€Appellantððs€residence€and€talked€to€Appellant€aboutÏthe€stabbing.€€During€the€discussion,€Appellant€stated€that€she€had€stabbed€Mr.ÏSmith€and€thrown€the€knife€under€a€red€Ford€Escort€that€was€parked€next€to€theÏapartment€complex.€€Officer€Larry€Colburn€of€the€Memphis€Police€DepartmentÏtestified€that€on€November€20,€1996,€he€discovered€a€knife€under€a€red€Ford€EscortÏthat€was€parked€next€to€the€apartment€complex.ÌÌà ` àAppellant€testified€that€on€November€20,€1996,€she€telephoned€herÏgrandchildren€who€were€staying€at€the€Smithsðð€apartment.€€During€the€conversation,Ïshe€heard€Mr.€Smith€cursing€the€grandchildren€and€then€Smith€took€the€phone€andÏbegan€cursing€Appellant.€€Appellant€then€became€concerned€about€the€safety€of€herÏgrandchildren.ÌÌà ` àAppellant€testified€that€after€the€telephone€conversation,€she€went€to€theÏSmithsðð€apartment€to€get€her€grandchildren.€€After€she€arrived€at€the€apartment€andÏknocked€on€the€door,€Mr.€Smith€opened€the€door€and€then€grabbed€Appellant€andÏbegan€hitting€and€kicking€her.€€Mr.€Smith€then€stated,€ð ðIððm€go[ing]€to€beat€your€assÏjust€like€I€do€your€daughter€and€your€kids€too.ðð€€After€Mr.€Smith€got€on€top€ofÏAppellant€and€started€beating€her,€she€stabbed€him€with€a€knife€that€she€had€put€inÏher€pocket€after€peeling€some€pears€earlier€that€day.€€At€this€point,€Mr.€Fleming€andñ< ñÏñ< ññ< ñÐ 8¸.. àAppellant€testified€that€the€only€reason€why€she€went€to€the€apartment€was€toÏretrieve€her€grandchildren.€€Appellant€testified€that€she€did€not€go€to€the€apartmentÏin€order€to€stab€Mr.€Smith€and€she€only€stabbed€him€because€she€was€afraid€heÏwould€kill€her€while€he€was€beating€her.€€Appellant€also€testified€that€she€never€sawÏMr.€Fleming€with€either€a€gun€or€a€knife.ÌÌà àTerrence€Clark€testified€that€he€went€with€Appellant€to€the€Smithsðð€apartmentÏon€November€20,€1996.€€When€Appellant€knocked€on€the€door,€Mr.€Smith€opened€theÏdoor,€pulled€Appellant€into€the€apartment,€and€began€beating€her.€€Mr.€Fleming€thenÏentered€the€apartment€and€pulled€Mr.€Smith€off€of€Appellant.€€Mr.€Clark€denied€thatÏhe,€Appellant,€Mr.€Fleming,€and€Mr.€Pate€had€kicked€Mr.€Smith.€€Mr.€Clark€alsoÏtestified€that€he€did€not€see€Appellant€stab€Mr.€Smith.ÌÌà àJames€Fleming€testified€that€on€November€20,€1996,€his€younger€brotherÏTracy€called€him€and€stated€that€Appellant€was€upset€and€was€going€to€the€SmithsððÏapartment.€€Mr.€Fleming€then€went€to€the€Smithsðð€apartment€and€he€saw€AppellantÏand€Mr.€Clark€standing€in€front€of€the€door.€€Shortly€thereafter,€Mr.€Fleming€sawÏAppellant€being€pulled€into€the€apartment.€€When€Mr.€Fleming€entered€theÏapartment,€he€saw€Mr.€Smith€on€top€of€Appellant.€€Mr.€Fleming€then€pulled€Mr.€SmithÐ Ðeventual€cross„examination€about€the€prior€incident€if€further€proof€indicated€thatÏevidence€of€the€prior€incident€was€relevant.Ìâ âÌà ` àWhen€the€State€called€Ms.€Smith€as€its€next€witness,€defense€counsel€askedÏfor€a€bench€conference.€€During€the€bench€conference,€defense€counsel€asked€theÏtrial€court€whether€they€could€have€a€jury„out€hearing€to€question€Ms.€Smith€aboutÏthe€prior€confrontation€between€Mr.€Smith€and€Mr.€Clark.€€The€trial€court€ruled€thatÏit€would€not€allow€the€defense€to€question€Ms.€Smith€about€the€incident,€but€it€wouldÏagree€to€keep€Ms.€Smith€under€subpoena€so€that€the€defense€could€question€herÏabout€the€prior€incident€if€further€proof€indicated€that€the€evidence€was€relevant€to€anÏissue€in€the€case.ÌÌà ` àAt€the€close€of€the€Stateððs€proof,€the€defense€asked€for€a€jury„out€hearing€inÏorder€to€voir€dire€Mr.€Clark€about€his€prior€confrontation€with€Mr.€Smith.€€The€trialÏcourt€granted€the€request€and€allowed€the€defense€to€question€Mr.€Clark€about€theÏincident.€€Mr.€Clark€testified€that€about€a€month€before€November€20,€1996,€he€andÏMr.€Smith€were€involved€in€a€confrontation€during€which€Mr.€Smith€grabbed€him€andÏheld€a€knife€to€his€neck.€€Mr.€Clark€testified€when€he€turned€over,€Mr.€Smith€ð ðnickedððÏhim€in€the€back€with€the€knife.€€Mr.€Clark€also€testified€that€he€told€Appellant€aboutÏthis€incident€when€he€went€to€live€with€her€about€a€month€before€the€incident€in€thisÏcase.€€The€trial€court€then€ruled€that€evidence€about€the€prior€incident€was€stillÏinadmissible€because€it€was€not€relevant€to€Appellantððs€claim€of€self„defense.ÌÌà ` àAfter€Appellant,€Mr.€Clark,€and€Mr.€Pate€testified€on€Appellantððs€behalf,Ïdefense€counsel€made€one€more€attempt€to€convince€the€trial€court€to€admitÐ  :À00 Ðevidence€about€the€prior€incident€between€Mr.€Smith€and€Mr.€Clark.€€DefenseÏcounsel€argued€that€the€evidence€was€relevant€to€Appellantððs€state€of€mind€at€theÏtime€of€the€offense€and€to€Appellantððs€claim€that€Mr.€Smith€was€the€first€aggressor.€ÏThe€trial€court€ruled€that€it€would€instruct€the€jury€about€self„defense,€but€it€would€notÏchange€its€ruling€that€evidence€about€the€prior€incident€between€Mr.€Smith€and€Mr.ÏClark€was€not€admissible.ÌÌà0 ` àà  àò òà0` ` €%` €%àà  àà@#D` €%` €%àB.€€Appellantððs€Testimonyó óˆÐ ˜8 ÐÌà ` àAppellant€contends€that€the€trial€court€erred€when€it€prohibited€her€fromÏtestifying€about€the€prior€incident€in€which€Mr.€Smith€cut€Mr.€Clark€with€a€knife.€ÏSpecifically,€Appellant€contends€that€the€trial€court€should€have€permitted€thisÏtestimony€because€it€was€substantive€evidence€of€her€state€of€mind€at€the€time€sheÏstabbed€Mr.€Smith.ÌÌà ` àWe€conclude€that€the€trial€court€erred€when€it€prohibited€Appellant€fromÏtestifying€about€the€prior€incident€in€which€the€victim€displayed€violent€conduct.€ÏThere€is€no€dispute€that€Appellant€had€knowledge€of€the€incident€in€which€Mr.€SmithÏcut€Mr.€Clark€with€a€knife.€€Indeed,€both€Appellant€and€Mr.€Clark€testified€during€jury„¼out€hearings€that€Mr.€Clark€told€Appellant€about€this€incident€one€month€beforeÏAppellant€stabbed€Mr.€Smith€with€the€knife.€€In€addition,€Appellant€testified€that€sheÏstabbed€Mr.€Smith€because€she€was€afraid€that€he€would€kill€her€while€he€wasÏbeating€her.€€Appellantððs€testimony€about€Mr.€Smithððs€violent€conduct€toward€Mr.ÏClark€was€clearly€relevant€to€establishing€the€reason€for€Appellantððs€belief€that€Mr.ÏSmith€would€kill€her.€€Because€Appellant€had€knowledge€of€the€prior€incident,Ð  :À00 ÐAppellantððs€testimony€about€the€incident€was€admissible€as€substantive€evidence€ofÏher€state€of€mind€at€the€time€of€the€offense.€€òòJohn€D.€Joslinóó,€1997€WL€583071,€at€*36;Ð h  ÐòòRuaneóó,€912€S.W.2d€at€779;€òòState€v.€Hillóó,€885€S.W.2d€357,€361€n.1€(Tenn.€Crim.€App.Ð p  Ð1994).€€Thus,€the€trial€court€erred€when€it€excluded€this€evidence.ÌÌà ` àThe€State€contends€that€even€if€the€trial€court€erred,€the€error€was€harmlessÏbecause€evidence€about€the€prior€incident€of€violence€on€the€part€of€Mr.€Smith€hadÏalready€been€introduced€or€alluded€to€at€one€point€or€another.€€This€argument€isÏinaccurate.€€A€review€of€the€record€indicates€that€the€jury€was€never€informed€thatÏMr.€Smith€held€a€knife€to€Mr.€Clarkððs€throat€and€cut€him€on€the€shoulderÏapproximately€one€month€before€the€incident€at€issue€in€this€case.€€In€short,€the€trialÏcourtððs€error€prevented€Appellant€from€establishing€a€reason€for€her€belief€that€Mr.ÏSmith€would€kill€her.€€Therefore,€we€conclude€that€the€trial€courtððs€error€requires€aÏremand€for€a€new€trial.ÌÌà@ŠŠDàò òC.€€Testimony€of€Other€Witnessesó óˆÐ Ø'x ÐÌà ` àAppellant€contends€that€the€trial€court€erred€when€it€prohibited€her€from€askingÏother€witnesses€about€the€prior€incident€in€which€Mr.€Smith€cut€Mr.€Clark€with€a€knife.€ÏSpecifically,€Appellant€contends€that€the€trial€court€should€have€permitted€the€otherÏwitnesses€to€testify€about€the€prior€incident€during€direct€or€cross„examinationÏbecause€the€testimony€was€offered€to€corroborate€her€claim€that€Mr.€Smith€was€theÏfirst€aggressor.Ìâ âÐ 8¸..
