X   <     BACKGROUND    X SergeantBalloftheWilliamsonCountySheriffsDepartmentfollowedthedefendantsvehicleforsomedistanceonLewisburgPike.HeobservedthedefendantexecutealefthandturnontoWilhoiteRoad,adeadendroad.Balltestifiedthathehadnoparticularreasonforfollowingthedefendantsvehicle,buthebelievedthedefendantmayhavebrakedheavilywhenmakingthisturn.BallstoppedhisvehicleandwaitedseveralminutesbeforeenteringWilhoite.BallmetthedefendantashewasreturningtoLewisburgPike,approximately100yardsfromtheintersection.Ballturnedaroundand,onreachingLewisburgPike,observedthatthedefendantsvehiclehadresumeditsoriginaldirectionoftravelonthatroadway.Ballobservedthevehicles taillightsinthe[unspecified]distance.Ballpursuedthevehicle,believingthatthedefendantmightbefleeing,andonhisreachingthevehicleheactivatedhisbluelights.Thedefendantpromptlypulledoverandstoppedhisvehicle.Balltestifiedthatduringthisentireincidentheobservednotrafficviolations. 2+0 ЇBasedoninvestigationsubsequenttothestop,includingBallsobservationofanodorconsistentwithconsumptionofalcoholonoraboutthedefendant,thedefendantsredeyes,thedefendantsstatementsandhisperformanceoffieldsobrietytests,Ballarrestedthedefendantfordrivingundertheinfluence.Thedefendantfiledamotiontosuppressallevidenceacquiredafterthetrafficstop.Atthesubsequentsuppressionhearing,thetrialcourtnoted#Xa0XX X6_ # X6XXXa0thatonesacceleratingfromanintersectiondoesnotnecessarilyconstitute   fleeing#Xa0XX X6r# X6XXXa0ԀandthatthedefendantpromptlypulledoverandstoppedwhenBall   activatedhisbluelights.Thetrialcourtfound noarticulablefactstosupportthestop,grantedthedefendantsmotion,anddismissedthecase.Thestateappeals,arguingthatBalllegitimatelystoppedthevehiclepursuanttoaninvestigation.  <   X @  @< STANDARDOFREVIEW  d\  XAtrialcourtsdeterminationoffactatasuppressionhearing ispresumptivelycorrectonappeal.Statev.Stephenson,878S.W.2d530,544 " (Tenn.1994).ThisCourtupholdsatrialcourtsdecision unlesstheevidenceintherecordpreponderatesagainstthefinding.Statev.Henning,975S.W.2d %" 290,299(Tenn.1998).
