àTestimony€at€trial€revealed€that€on€June€9,€1995,€the€twelve„year„old€victim,ÏT.S.€€(we€will€use€the€initials€rather€than€the€full€name€of€the€victim),€insisted€on€goingÏto€work€with€her€mother.€€While€the€mother€and€daughter€were€in€the€car,€the€victimÏstarted€crying€and€said€that€Defendant,€the€victimððs€stepfather,€had€raped€her.€€TheÏmother€immediately€notified€authorities€and€took€T.S.€to€the€hospital€emergencyÏroom€to€be€examined.ÌÓÓÌÓ» Óà ` àDr.€Donald€Verlin€Tucker,€Jr.€examined€T.S.€at€the€emergency€room€and€hisÏexamination€revealed€a€history€of€sexual€abuse€consistent€with€that€which€she€hadÏtold€him.€€He€testified€that€he€examined€the€victim€five€days€after€the€penileÏpenetration€had€allegedly€occurred.€€He€testified€that€the€genitalia€examination€wasÏnormal€except€for€the€absence€of€a€hymen.€€€Ìâ âÐ ,8Ì.0 Ðà ` àDr.€Peter€Reardon,€an€obstetrician/gynecologist,€took€a€medical€history€of€theÏâ âvictim€on€June€14,€1995,€which€included€her€statement€that€she€had€bled€for€twoÏdays€after€penile€penetration€on€Sunday,€June€4,€1995,€and€had€experienced€twoÏother€vaginal€penetrations,€one€digitally€and€one€orally.€€Dr.€Reardon€discovered€twoÏsmall€broken€areas€on€the€victimððs€hymen€when€doing€a€pelvic€examination,€butÏfound€no€recent€trauma€to€the€vagina€or€any€lacerations.€€Dr.€Reardon€said€that€a€Ïð ðrecent€traumaðð€to€the€hymen€takes€about€six€to€eight€days€to€heal€after€being€tornÏand€that€after€ten€days€it€would€look€like€a€healed€wound.€ÌÌà ` àThe€victim€testified€at€trial€about€various€types€of€sexual€abuse€inflicted€byÏDefendant,€described€the€circumstances€surrounding€each€incident€of€abuse,€andÏgave€approximate€dates€for€most€incidents€based€on€where€the€family€was€living,Ïwhat€car€the€family€was€driving,€and€birthdays€of€family€members.€€The€time€span€forÏDefendantððs€sexual€abuse€occurred€over€a€seven„year€period€beginning€when€T.S.Ïwas€five€and€ending€when€she€was€12.ÌÌà ` àT.S.€testified€that€her€family€moved€to€the€ð ðblockhouseðð€when€she€was€aboutÏfive€years€old€and€that€a€barn€was€located€on€the€property.€€While€the€family€lived€inÏthe€ð ðblockhouse,ðð€Defendant€took€the€victim€to€the€barn€to€feed€the€cats.€€In€the€barn,ÏDefendant€placed€her€on€stacked€bales€of€hay,€removed€her€panties,€and€fondledÏher.€€T.S.€€did€not€tell€her€mother€about€this€incident€before€June€9,€1995,€althoughÏshe€testified€that€she€believed€that€this€incident€occurred€in€1987.à Ð àà (# àÐ 2°(* Ðà ` àà ¸ àà  àÌÌà ` àIn€1990,€when€the€victim€had€finished€the€second€grade,€the€family€moved€toÏa€house€on€Snake€Hollow€Road.€€At€that€time,€the€family€owned€a€red€Thunderbird.€Ð Ð9p02 ÐThe€victim€said€that€she€and€Defendant€were€in€the€red€Thunderbird€travelingÏtowards€the€familyððs€prior€residence,€the€ð ðblockhouse,ðð€when€Defendant€beganÏð ðplaying€with€himself,ðð€pulled€to€the€side€of€the€road,€and€stopped€the€car.€€DefendantÏthen€walked€to€the€passenger€side€of€the€car,€removed€the€victimððs€ð ðbottom€clothes,ððÏand€started€rubbing€her€vagina€and€masturbating.€€Defendant€ejaculated€on€T.S.€andÏwiped€the€ejaculate€off€with€his€bandana€handkerchief.€€The€victim€did€not€tell€herÏmother€about€this€incident€before€June€9,€1995,€because€she€was€afraid€thatÏDefendant€might€hurt€her€by€ð ðwhippingðð€her.€€Upon€objection€by€Defendant,€the€trialÏcourt€instructed€the€jury€to€disregard€the€victimððs€statement€about€DefendantÏð ðwhippingðð€her.€€Defendant€moved€for€a€mistrial€based€on€that€statement,€but€the€trialÏcourt€overruled€it.ÌÌà ` àT.S.€testified€that€while€she€and€Defendant€€were€riding€in€a€red€Buick€car€heÏhad€purchased€that€day,€Defendant€said€he€needed€to€go€to€his€employerððs€garageÏto€roll€up€the€windows€of€his€garbage€truck.€€Other€proof€showed€that€the€vehicle€wasÏpurchased€on€June€29,€1992.€€While€the€victim€was€sitting€in€the€Buick,€she€lockedÏthe€car€doors€because€she€was€afraid€that€Defendant€ð ðmight€try€something.ðð€€AfterÏDefendant€told€the€victim€to€unlock€the€doors,€he€took€her€out€of€the€car,€laid€her€onÏa€pallet,€removed€her€panties,€got€on€top€of€her,€and€began€rubbing€his€penis€againstÏher.€€When€the€victim€said€ð ðyou€promised€you€wouldnððt€do€this€again,ðð€Defendant€toldÏher€that€this€was€the€last€time.ÌÌà ` àSometime€before€her€brotherððs€August€22nd€birthday€in€an€unspecified€year,ÏDefendant,€the€victim,€and€her€brother€were€taking€items€to€the€garage€at€the€SnakeÏHollow€Road€residence.€€Defendant€sent€the€victimððs€brother€to€feed€the€chickens.€ÏWhen€Defendant€and€T.S.€were€alone€in€the€garage,€Defendant€rubbed€her€vagina,Ð Ð9p02 Ðmasturbated,€ejaculated,€and€wiped€the€ejaculate€off€her€with€his€bandanaÏhandkerchief.€€T.S.€stated€that€ð ðthis€happened€several€times,€about€four€or€fiveÏtimes.ððÌÌà ` àOn€another€occasion,€Defendant€was€standing€beside€the€Buick€with€his€pantsÏunzipped€and€his€penis€exposed€while€the€victimððs€mother€was€mowing€the€yard.€ÏDefendant€forced€T.S.€to€put€her€mouth€on€his€penis€and€to€perform€fellatio.€€ÌÌà ` àDuring€the€wintertime€after€the€year€1990,€Defendant€used€Vaseline€that€wasÏkept€on€the€victimððs€motherððs€dresser€to€penetrate€the€victim€digitally€in€the€adultsððÏbedroom.€ÌÌà ` àOn€the€Saturday€after€school€ended€in€1995,€Defendant€came€into€the€victimððsÏbedroom€while€victim€was€reading€a€book,€pulled€down€her€shorts€and€panties,€andÏsaid€he€was€checking€to€see€if€she€had€ð ðbeen€with€any€boys.ðð€€Then€he€performedÏcunnilingus€on€her.€€After€telling€her€he€was€going€to€do€what€he€ð ðusuallyðð€did,€heÏrubbed€her€vagina,€masturbated,€ejaculated,€and€wiped€the€ejaculate€off€with€hisÏbandana€handkerchief.€€Neither€the€victimððs€mother€nor€brother€were€at€home€duringÏthis€incident.ÌÌà ` àOn€June€4,€1995,€again€while€her€mother€and€brother€were€away€from€theÏhouse,€Defendant€penetrated€the€victim€with€his€penis€in€the€victimððs€bedroom.€ÏDefendant€told€T.S.€that€he€would€kill€her€if€she€told€anyone.€€The€victim€was€cryingÏand€bleeding€from€the€penetration€and€she€continued€to€bleed€for€two€days.Ìâ âÐ à7€.0 Ðà ` àOn€June€7,€1995,€Defendant,€the€victim,€and€her€brother€went€to€Kinser€Park.Ïâ âThey€had€been€on€their€way€to€visit€the€childrenððs€mother€at€work,€but€learned€thatÏthe€mother€could€not€get€off€to€see€them.€€As€the€victim€and€Defendant€walkedÏthrough€the€woods€at€Kinser€Park€looking€for€a€place€to€fish,€Defendant€beganÏplaying€with€the€victimððs€breasts€through€her€clothes.€€T.S.€said€that€she€tried€to€getÏaway,€but€Defendant€told€her,€ð ðIf€you€try€to€get€away€it€makes€me€want€you€more.ððÌÌà ` àAt€the€conclusion€of€the€victimððs€testimony€on€direct€examination,€counsel€forÏDefendant€objected€to€her€statement€that€Defendant€had€sexually€battered€her€fourÏor€five€times€in€the€Snake€Hollow€garage.€€The€basis€for€defense€counselððs€objectionÏwas€that€these€were€ð ðother€bad€actsðð€not€covered€by€the€Bill€of€Particulars.€ÏOverruling€the€motion€for€a€mistrial,€the€court€stated€that€the€charges€could€beÏdefined€specifically€enough€to€avoid€any€jury€confusion.ÌÌà ` àSamera€Zavaro,€a€forensic€scientist€with€the€TBI,€testified€that€the€fitted€bottomÏsheet€from€the€victimððs€bed€tested€positive€for€blood€and€semen.€She€further€testifiedÏthat€after€DNA€testing€on€the€bed€sheet,€Defendant€could€not€be€excluded€as€theÏcontributor€of€the€sperm€on€the€victimððs€bed€sheet.€ÌÌà ` àDefendant€testified€and€denied€that€he€had€molested€or€had€sex€with€hisÏstepdaughter.ÌÌà ` àThe€jury€found€Defendant€guilty€of€four€counts€of€aggravated€sexual€batteryÏand€four€counts€of€rape€of€a€child.€€As€reflected€in€the€judgment€form,€the€trial€courtÏchanged€one€of€the€child€rape€convictions€(Count€Three)€to€aggravated€rape€Ïbecause€the€State€was€not€able€to€establish€that€it€occurred€after€July€1,€1992,€theÐ ðState€was€allowed,€over€objection,€toÏintroduce€irrelevant€prejudicial€uncharged€conduct.ðð€€Specifically,€DefendantÏcontends€that€the€victim€was€allowed€to€testify€about€an€incident€that€was€time„barredÏby€the€statute€of€limitations.€€Defendant€asserts€that€the€count€of€the€presentmentÏcharging€this€offense€had€already€been€dismissed.€€He€also€contests€the€victimððsÏtestimony€that€Defendant€ð ðwhipped€her€hardðð€and€that€he€sexually€assaulted€her€ð ðfourÏor€five€timesðð€in€the€garage€at€the€Snake€Hollow€residence.€€Finally,€he€argues€thatÏit€was€improper€for€the€victimððs€mother€to€testify€that€Defendant€had€threatened€to€killÏher€and€to€hurt€the€victim.€ÌÌà àFirst,€Defendant€contends€that€the€victim€was€allowed€to€testify€to€an€allegationÏof€aggravated€sexual€battery€that€was€dismissed€as€being€time„barred€by€the€statuteÏof€limitations.€€This€incident€allegedly€occurred€in€1987€when€the€victim€was€œaboutñôññôññ÷ñÌñ÷ññøññôñÐ Ðñôññøññõñ›€ñõñfive›€years€old.€€The€victim€testified€that€Defendant€took€her€to€the€barn€to€feed€theÏcats,€and€there€he€removed€her€panties€and€fondled€her.€€First€of€all,€Defendant€hasÏwaived€this€claimed€error€on€appeal€because€he€did€not€enter€a€contemporaneousÏobjection€to€the€testimony.€€Tenn.€R.€App.€P.€36(a);€òòState€v.€Killebrewóó,€760€S.W.2dÐ ` àSecond,€Defendant€has€also€waived€any€objection€to€the€victimððs€testimonyÏthat€Defendant€took€her€to€the€Snake€Hollow€garage€and€sexually€battered€her€ð ðfourÏor€five€timesðð€because€Defendant€again€made€no€contemporaneous€objection€to€thisÏtestimony.€Tenn.€R.€App.€P.€36(a);€òòKillebrewóó,€760€S.W.2d€at€235.€€At€the€œconclusionñýññöñÐ  `(  ÐñöññýññþñÐ `(  Ðñþññÿñ›Ð `(  Ðñÿñof›€the€victimððs€testimony€on€direct€examination,€defense€counsel€did€object€to€thisÏstatement€and€asked€for€a€mistrial.€€The€court€said€that€the€charges€could€be€definedÏspecifically€enough€to€avoid€any€jury€confusion.€€€The€trial€court€did€give€a€juryÏinstruction€explaining€the€limited€purpose€of€the€evidence€and€explained€that€anyÏevidence€that€Defendant€had€committed€a€crime€or€crimes€other€than€those€chargedÏcould€not€be€considered€to€prove€his€disposition€to€commit€the€charged€crimes.€€TheÏjury€is€deemed€to€have€followed€the€courtððs€instruction,€and€we€find€the€instructionÏsufficient€to€cure€any€prejudice€to€Defendant.€€òòSeeóó€òòState€v.€Harrisóó,€839€S.W.2d€54,Ð à7€.0 Ð72€(Tenn.€1992).€€€Ð Ð9p02 Ðà ` àÌà ` àNext,€Defendant€did€make€a€contemporaneous€objection€to€the€victimððsÏtestimony€that€she€was€afraid€of€Defendant€because€he€ð ðwhipped€her€hard.ðð€€In€theÏpresence€of€the€jury,€defense€counsel€asked€for€an€instruction€concerning€theÏtestimony€about€the€whipping,€and€the€court€instructed€that€ð ðthe€jury€should€disregardÏthat€and€not€consider€it€for€any€purpose.ðð€€The€jury€is€presumed€to€have€followed€theÏtrial€courtððs€instruction.€€òòIdóó.€€Moreover,€this€testimony€by€the€witness€does€notÐ p& Ðð ðaffirmatively€appear€to€have€affected€the€result€of€the€trial€on€the€merits.ðð€€Tenn.€R.ÏCrim.€P.€52(a).€€Accordingly,€any€error€that€occurred€as€a€result€of€this€victimððsÏunsolicited€statement€was€harmless.€€Tenn.€R.€App.€P.€36(b).ÌÌà àAfter€reviewing€the€verdict€forms,€we€find€that€the€trial€court€did€not€offerÏunnecessary€commentary€on€the€facts€as€alleged€by€Defendant.€€Rather,€the€formsÏcontain€enough€specific€information€to€comply€with€the€requirement€that€the€StateÏelect€the€particular€offenses€for€which€convictions€were€sought.€€òòSeeóó€òòStateóó€òòv.Ð Ðand€[Defendant]€had€took€[sic]€the€jar€ofÏVaseline€and€put€it€on€his€finger€and€pulledÏmy€pants€down€and€he€stuck€his€finger€in€myÏvagina€and€I€told€him€that€it€hurt€me.€€HeÏpulled€his€finger€back€out€and€told€me€to€getÏup.Ð hÐ hÐ  ÐÌà8 ` àà8¸ ` (#` (#àState:à h àDid€you€tell€your€mother€about€that?Ð8-Ø#%¸ Ð ¸ Ð  ÐÌà8 ` àà8¸ ` (#` (#àVictim:à h àNo,€I€did€not.Ð(/È%'¸ Ð ¸ Ð  ÐÓ²lÓÌà ` àThe€foregoing€testimony€demonstrates€that€the€State€did€not€establish€theÏexact€date€that€this€particular€incident€occurred.€€The€only€time€frame€the€victim€couldÏtestify€to€was€that€it€occurred€after€they€moved€to€the€Snake€Hollow€residence€whichÏwas€earlier€established€as€being€sometime€in€the€year€1990.€€The€count€in€theÏpresentment€dealing€with€the€digital€rape€states€that€Defendant€stuck€his€fingerÐ Ð9p02 Ðinside€the€victimððs€vagina€ð ðbetween€___,€1992,€and€___,€1993.ðð€€The€Bill€ofÏParticulars€states€that€the€single€incident€of€digital€penetration€occurred€beforeÏThanksgiving€Day€of€1993.€€However,€contrary€to€the€Stateððs€argument,€this€is€notÏenough€to€satisfy€the€Stateððs€burden€of€proving€that€the€incident€occurred€after€JulyÏ1,€1992,€in€order€to€establish€rape€of€a€child.€€These€documents€were€not€admittedÏinto€evidence€and€it€was€the€Stateððs€burden€to€clearly€establish€through€evidence€atÏtrial€when€the€alleged€incident€occurred.ÌÌà ` àHowever,€to€dismiss€this€count€altogether€would€be€an€extreme€misplacementÏof€form€over€substance.€€The€act€of€ð ðunlawful€sexual€penetration€of€a€victimðð€who€ð ðisÏless€than€thirteen€(13)€years€of€age,ðð€did€not€cease€being€a€crime€at€midnight€onÏJune€30,€1992;€it€merely€ceased€being€codified€at€Tenn.€Code€Ann.€ðð€39„13„502.€ÏòòSeeóó€Tenn.€Code€Ann.€ðð€39„13„522(a).€€Again,€the€elements€of€aggravated€rape€andÐ   @ Ðrape€of€a€child€are€the€same€and€the€State€did€prove€beyond€a€reasonable€doubtÏDefendantððs€guilt€of€the€unlawful€sexual€penetration€of€a€child€less€than€thirteen€yearsÏof€age.€€However,€since€the€State€did€not€clearly€establish€when€the€incidentÏoccurred,€we€hold€that€Defendant€is€guilty€of€aggravated€rape€instead€of€rape€of€aÏchild€in€Count€Four€(Count€Five€of€the€presentment).€€The€judgment€must€beÏmodified€accordingly.ÌÓ ðKnowledge€of€sexual€mattersðð€is€often€sought€to€be€introduced€in€childÏsexual€abuse€cases.€€Where€the€Stateððs€proof€suggests€that€the€child€victimððsÏknowledge€of€sexual€matters€resulted€solely€from€the€incident€with€the€defendant,€theÏdefendant€is€permitted€to€show€that€the€victim€acquired€the€familiarity€from€sexualÏactivity€with€third€persons.€Advisory€Commission€Comments,€Tenn.€R.€Evid.€412.ÌÌà ` àHowever,€before€evidence€regarding€a€victimððs€ð àHowever,€even€addressed€on€the€merits,€Defendantððs€argument€must€fail.€€OnÏdirect€examination,€Dr.€Reardon€testified€that€he€took€a€medical€history€from€theÏvictim,€that€the€history€was€important€for€purposes€of€diagnosis€and€treatment,€andÏthat€the€victim€had€told€him€of€three€specific€incidents€of€penetration.€€Dr.€ReardonÏsaid€that€his€physical€examination€led€him€to€conclude€that€partial€penetration€by€aÏmale€penis€of€the€victim€was€possible€and€was€consistent€with€the€history€that€theÏvictim€gave€him.€€This€issue€is€without€merit.ÌÌÓ  ÓòòVI.€€SentencingóóÐ °P ÐÓ~žÓÌà ` àIn€this€issue,€Defendant€argues€that€the€court€erred€in€finding€threeÏenhancement€factors,€finding€no€mitigating€factors,€and€in€ordering€the€sentences€onÏthe€four€rape€convictions€to€be€served€consecutively.ÌÌà àIf€our€review€reflects€that€the€trial€court€followed€the€statutory€sentencingÏprocedure,€imposed€a€lawful€sentence€after€having€given€due€consideration€andÏproper€weight€to€the€factors€and€principals€set€out€under€the€sentencing€law,€and€thatÏthe€trial€court's€findings€of€fact€are€adequately€supported€by€the€record,€then€we€mayÏnot€modify€the€sentence€even€if€we€would€have€preferred€a€different€result.€€òòState€v.Ð (#àNow,€weððve€had€no€evidence€in€the€case€fromÏpsychologists€or€psychiatrists€about€the€consequences€ofÏthe€defendantððs€criminal€acts€upon€her,€although€she€wasÏvery€young,€and€the€evidence€was€that€the€defendantððsÏabuse€of€her€sexually€began€at€age€five.€€But€I€did€observeÏher€demeanor€while€she€was€testifying€and€she€was€veryÏdistraught€throughout€her€testimony,€she€cried€and€sobbedÏalmost€throughout€her€testimony.€€Certainly€theÏobservation€this€Court€would€make,€in€looking€at€her€asÏcompared€with€other€victims€of€similar€age€who€haveÏtestified€in€this€court€in€other€cases€over€a€period€of€time,Ïis€that€she€obviously€suffers€greatly€from€the€things€thatÏhave€been€done€to€her€and€I€think€that€#6€is,€in€fact,€anÏenhancement€factor€in€the€case.Ð    Ðconvictions,€the€trial€court€stated€the€following:ÌÓÓà8 ` àà8¸ ` (#` (#àThe€character€of€rape€has€many€faces.€€It€can€be€one€ofÏoppression,€of€male€dominance,€of€punishment,€or€it€canÏbe€for€pleasure€and€excitement.€€I€think€the€evidence€inÏthis€case€clearly€show€that€it€was€to€gratify€the€defendantððsÏdesire€for€pleasure€or€excitement,€and€I€think€thatÏdistinguishes€this€case€in€an€enhancement€way,€and€so€IÏbelieve€that€is€a€valid€enhancement€consideration.Ð ¸ Ð ¸ Ð  ÐÓ³¿Óà ` àÌà ` àInitially,€we€note€that€a€necessary€element€of€aggravated€sexual€battery€asÏcharged€is€sexual€contact€which€is€defined€as€the€intentional€touching€of€an€intimateÏpart€or€the€clothing€over€such€intimate€part€"for€the€purpose€of€sexual€arousal€orÏgratification."€Tenn.€Code€Ann.€€ðð€39-13-501(6);€òòseeóó€òòKissingeróó,€922€S.W.2d€atÐ Ð489-90€(Tenn.€1996).€Because€a€factor€cannot€be€applied€if€it€is€also€an€essentialÏelement€of€the€offense€as€charged€in€the€indictment,€enhancement€factor€(7)€isÏinapplicable€to€the€four€aggravated€sexual€battery€convictions.€€ÌÓÓÌÓýÃÓà ` àHowever,€factor€(7)€is€not€an€essential€element€of€aggravated€rape€or€rape€ofÏa€child€and€may€be€considered€as€an€appropriate€enhancement€factor.€€òòSeeóó€òòStateÐ 2°(* Ðv.€Adamsóó,€864€S.W.2d€31,€34-35€(Tenn.€1993).€€In€òòKissingeróó,€our€supreme€court€Ð 4 *, Ðrecognized€the€difficulties€in€establishing€factor€(7):€€ÌÓÓà8 ` àà8¸ ` (#` (#àEnhancement€factor€(7),€unlike€most€of€the€otherÏsentencing€factors,€calls€into€question€a€defendant'sÏreasons€for€committing€a€crime.€Human€motivation€is€aÐ Ð9p02 Ðtangled€web,€always€complex€and€multifaceted.€To€proveÏdefendant's€motives€will€always€be€a€difficult€task.€But€theÏlegislature,€in€its€wisdom,€has€placed€that€obligation€on€theÏstate€when€the€state€seeks€an€enhanced€sentence.€Ð ¸ Ð ¸ Ð  ÐÌ922€S.W.2d€at€491.€ÌÌÌÓ’ÅÓà ` àWe€are€of€the€opinion€that€the€State€met€its€burden€of€proof€in€this€case€thatÏthe€rape€was€sexually€motivated€to€gratify€Defendantððs€desire€for€pleasure€orÏexcitement.€€There€were€several€instances€of€sexual€conduct€by€Defendant€with€theÏvictim€occurring€on€different€occasions.€Defendant€penetrated€the€victim€by€insertingÏhis€penis€in€the€victim's€vagina,€the€victim€performed€fellatio€on€Defendant,€andÏDefendant€performed€cunnilingus€on€the€victim.€€The€victim€testified€as€follows€aboutÏone€incident:ÌÓÓà8 ` àà8¸ ` (#` (#à[Defendant]€pulled€down€my€shorts€and€panties€and€heÏtold€me€that€he€had€to€check€and€see€if€I€had€been€withÏany€boys.€€Then€he€stuck€his€tongue€in€my€vagina.€€Ð ¸ Ð ¸ Ð  ÐÌà ` àà ¸ à.€.€.ÌÌà8 ` àà8¸ ` (#` (#à[A]fter€he€got€done€he€told€me,€he€said,€ððNo,€you€havenððtÏbeen€with€any€boys,ðð€and€then€he€said,€ðð[victim€],€Iððm€goingÏto€do€what€I€usually€do,ðð€and€then€he€started€rubbing€myÏvagina€and€masturbating€and€then€he€ejaculated€on€meÏand€then€he€wiped€it€off€with€a€handkerchief.Ð ¸ Ð ¸ Ð  ÐÌÓ¦ÉÓIn€regards€to€the€incident€of€penile€penetration,€the€victim€testified€that€she€asked€theÏvictim€to€stop€and€he€asked€her,€ð ðDo€you€want€me€to€hurry€up€and€get€done,ðð€and€sheÏtold€him€that€she€did.€€€ÌÌà ` àAlthough€orgasm€is€insufficient,€in€and€of€itself,€to€establish€that€DefendantÏcommitted€rape€to€gratify€his€desire€for€pleasure€or€excitement,€when€that€fact€isÏviewed€along€with€other€circumstances€in€the€case,€we€find€this€factor€to€beÏappropriate.€€òòSeeóó€òòKissingeróó,€922€S.W.2d€at€490„91.€Despite€Defendant's€denial€thatÐ à7€.0 Ðhe€committed€the€offenses,€the€evidence€supports€the€application€of€factor€(7)€by€aÐ Ð9p02 Ðpreponderance€of€the€evidence.€òòSeeóó€òòState€v.€Carteróó,€908€S.W.2d€410,€413€(Tenn.Ð `  ÐCrim.€App.),€òòperm.€to€appeal€deniedóó€(Tenn.€1995)€(preponderance€of€the€evidenceÐ P ð Ðstandard€applies€to€factual€determinations€necessary€for€enhancement€factor).ÏFurthermore,€the€jury€concluded€beyond€a€reasonable€doubt€that€the€defendant'sÏintentional€touching€was€for€the€purpose€of€sexual€arousal€or€gratification€to€convictÏthe€defendant€of€four€counts€of€aggravated€sexual€battery.€Under€theseÏcircumstances,€we€hold€that€the€record€supports€the€application€of€factor€(7)€inÏsentencing€Defendant€for€the€aggravated€rape€and€rape€of€a€child€convictions.€€ÌÌà ` àThe€court€also€found€as€an€enhancement€factor€the€Defendant€abused€aÏposition€of€private€trust.€€Tenn.€Code€Ann.€ðð€40„35„114(15).€€We€note€that€DefendantÏdoes€not€specifically€contest€the€application€of€this€factor€on€appeal.€€We€believe€thisÏenhancement€factor€clearly€applies,€and€obviously€the€trial€court€gave€it€great€weight.€ÏDefendantððs€status€as€stepfather€while€living€with€the€victimððs€mother€is€a€sufficientÏbasis€for€sentence€enhancement€under€factor€(15).€€òòAdamsóó,€864€S.W.2d€at€34.€€AÐ €$  Ðmore€serious€violation€of€private€trust€is€hard€to€imagine.€€Accordingly,€we€find€thatÏthis€enhancement€factor€appropriate€for€all€convictions.ÌÌà ` àIn€conclusion,€we€find€that€enhancement€factor€(6)€is€inapplicable€to€all€eightÏconvictions,€enhancement€factor€(7)€is€only€applicable€to€the€four€rape€convictions,Ïand€enhancement€factor€(15)€is€applicable€to€all€eight€convictions.ÌÌà ` àWith€respect€to€mitigation,€Defendant€merely€mentions€that€a€few€mitigatingÏfactors€should€have€been€applied€which€include€no€prior€criminal€record,€hisÏemployment€record,€his€limited€education,€and€his€financial€assistance€to€his€family.€ÏThe€pre„sentence€report€reveals€that€a€search€was€conducted€for€prior€criminalÐ Ð9p02 Ðoffenses€in€Greene€County€and€none€were€found.€€We€find€the€absence€of€a€criminalÏrecord€to€be€applicable€in€mitigation,€although€little€weight€should€be€afforded€it.€€ThisÏCourt€has€also€held€that€where€Defendant€was€convicted€of€sex€offenses€involvingÏminors,€favorable€consideration€based€upon€his€family€contributions€and€work€ethicÏwas€not€appropriate.€€òòSeeóó€òòState€v.€McKnightóó,€900€S.W.2d€36€(Tenn.€Crim.€App.Ð  À Ð1994),€òòperm.€to€appeal€deniedóó€(Tenn.€1995).€€Further,€we€find€no€evidence€in€theÐ °  Ðrecord€as€to€how€his€limited€education€affected€his€actions€against€his€stepdaughterÏin€this€case,€so€this€factor€will€not€be€applied.€€ÌÌà ` àIn€summary,€we€believe€one€mitigating€factor,€Defendant's€lack€of€a€priorÏcriminal€record,€should€be€considered€relative€to€the€length€of€the€sentencesÏimposed.€€òòSeeóó€Tenn.€Code€Ann.€ðð€€40-35-113(13).€€However,€although€this€factorÐ °P Ðshould€be€considered,€we€do€not€believe€it€is€entitled€to€significant€weight€in€theÏcontext€of€this€case.€ÌÌà `
