Ðsentencing€hearing,€and€her€parents€did€not€respond€to€the€victim€impact€questionnaire€that€wasÐ °"  Ðmailed€to€them€by€the€presentence€investigator.€€There€is€no€evidence€before€us€concerning€how€theÐ  #ð! Ðrelationship€between€the€defendant€and€the€victim€began€in€the€internet€chat€room.€€Likewise,€thereÐ $à" Ðis€no€evidence€of€the€nature€of€the€chat€room€conversations,€such€that€a€finding€could€be€made€thatÐ €%Ð # Ðthe€defendant€occupied€a€position€of€trust€with€the€victim.€€The€state€cites€us€to€the€recitation€by€theÐ p&À!$ Ðprosecutor€of€the€factual€basis€for€the€defendantððs€guilty€pleas.€€That€recitation€is€insufficient.€€Ð `'°"% ÐÌà8  àMR.€GREEN:à0¸ Ð Ð àYour€Honor,€had€this€matter€gone€to€trial,€the€witnesses€listed€on€theÐ @)$' Ðback€of€the€indictment€and€those€subsequently€supplied€would€haveÐ 0*€%( Ðbeen€called€to€testify,€and€they€would€have€testified€that€thisÐ  +p&) Ðdefendant€and€[AW],€who€was€a€15„year„old€minor,€beganÐ ,`'* Ðcorresponding€via€the€Internet.€€They€met€in€whatððs€commonlyÐ ° Ðreferred€to€as€a€chat€room€on€the€Internet€and€began€conversing€backÐ  ð Ðand€forth€for€a€period€of€time€until€ultimately€in€October€of€1997,€thisÐ à Ðdefendant€came€to€Knox€County,€Tennessee€to€meet€[AW].Ѐи Ð ¸ Ð  ÐÌà  àà ` àIn€appropriate€cases,€sexual€offenders€who€use€the€internet€to€develop€relationshipsÐ ` ° Ðwith€€third€parties€may€very€well€abuse€a€private€trust.€€Such€offenders€may,€for€instance,€masqueradeÐ P   Ðas€caring€individuals€or€individuals€who€are€needy.€€With€the€internet€and€chat€rooms,€a€person€canÐ @  Ðcreate€an€entirely€fictitious€identity€that€can€promote€confidence,€reliability,€or€faith€in€unsuspectingÐ 0 € Ðvictims.€€We€believe,€however,€that€such€a€showing€has€not€been€made€in€this€case.Ð  p  ÐÌà  àà ` àAlthough€we€conclude€that€the€trial€court€should€not€have€applied€enhancement€factor€Ð P  Ð(15),€we€also€exercise€our€òòde€novoóó€review€and€find€that€enhancement€factor€(7)€applies.€€Ô#†¼³´»XX¢#÷H#ÔÔ‡X¢#X»¼³´ÔThe€trialÐ ð@  Ðcourt€stated€that€it€had€ð ðno€problemðð€finding€that€the€offense€involved€a€victim€and€was€committedÐ à0  Ðto€gratify€the€defendantððs€desire€for€pleasure€or€excitement.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„114Ð Ð  Ð(1997).€€The€trial€court,€though,€did€not€believe€that€the€law€permitted€the€application.Ð À ÐÌà  àà ` àIn€òòState€v.€Adamsóó,€864€S.W.2d€31,€34-35€(Tenn.€1993),€our€supreme€court€rejectedÐ  ð Ðthe€proposition€that,€"as€a€matter€of€law,€every€rape€is€implicitly€committed€for€the€purpose€ofÐ à Ðpleasure€or€excitement."€€The€supreme€court€noted€that€not€all€such€crimes€are€committed€forÐ €Ð Ðpleasure,€but€rather€may€be€motivated,€for€instance,€by€acts€of€brutality,€revenge,€punishment,€orÐ pÀ Ðintimidation.€€òòId.óó€€Therefore,€even€though€this€enhancement€factor€may€be€applied€to€such€cases,€theÐ `° Ðstate€has€the€burden€of€demonstrating€that€the€rape€is€sexually€motivated.€€òòId.óó€€In€the€case€before€us,Ð P  Ðthe€record€demonstrates€that€the€multiple€incidents€of€statutory€rape€were€sexually€motivated.€€In€theÐ @ Ðdefendantððs€version,€which€is€included€in€the€presentence€report,€the€defendant€describes€his€conductÐ 0€ Ðwith€the€victim€as€a€ð ðconsentual€[sic]€sexual€relationship.ðð€€The€defendantððs€stepfather€testified€atÐ  p Ðthe€sentencing€hearing€that€the€defendant€asked€him,€ð ðWould€you€believe€that€a€younger€woman€isÐ ` Ðin€love€with€me?ðð€€The€stepfather€believed€that€the€defendant€ð ðwas€in€love€with€the€young€lady€thatÐ P Ðhe€got€involved€with,€and€he€thought€the€young€lady€was€in€love€with€him€and€age€would€make€noÐ ð@ Ðdifference.ðð€€Finally,€the€defendant€told€Officer€Legall€that€he€had€a€ð ðfetishðð€for€young€girls,Ð à0 Ðindicating€that€young€girls€excite€in€him€erotic€feelings.€€Under€these€circumstances,€we€hold€thatÐ Ð  Ðthe€record€supports€the€application€of€enhancement€factor€(7).Ð À! ÐÌÔ#†¼³´»XX¢#zV#ÔÔ‡X¢#X»¼³´Ôà  àà ` àThe€defendant€further€complains€that€the€trial€court€incorrectly€rejected€mitigatingÐ  #ð!
