àThe€child„victim€identified€a€photograph€of€a€house€in€which€her€family€lived€inÏMoscow€which€is€located€in€Fayette€County.€€Her€older€sister€told€jurors€the€family€hadÏlived€in€the€house€for€a€short€time€in€the€Summer€of€1994.€€The€child„victim€knew€herÏsister€Jamie,€born€in€November€1992,€€lived€there€as€well.€€The€child„victim€also€saidÏthe€act€occurred€around€the€time€of€her€June€9th€birthday.€€Ìà àWhile€at€this€house,€she€said€the€defendant€came€into€her€room.€€He€put€hisÏhands€in€her€pants.€ð ðHe€started€moving€around,€and€he€said€something,€but€I€donððtÏrecall€what€he€said.ðð€She€said€he€touched€her€ð ðprivateðð€with€his€hand.€€She€said€heÍtouched€both€the€inside€and€outside€part€of€her€ð ðprivates.ððÌà àDuring€the€July€10,€1994€recorded€conversation€the€defendant€told€his€ex„wifeÏthat€the€contact€with€her€daughter€was€usually€just€touching.€From€comments€madeÏabout€his€finger,€a€jury€could€find€that€he€attempted€to€penetrate€using€his€finger.€€€ÌÓÓà8 àThe€defendant€testified€he€reunited€with€Brenda€Gibson€in€March€1994,€afterÏtheir€divorce.€They€lived€together€until€June€7,€1994.€€He€said€the€two€girls€lived€at€hisÏhouse€for€three€days€in€March€until€they€moved€to€Mississippi€with€their€natural€father.€ÏHe€testified€he€saw€the€girls€in€June€1994.€ð ðI€went€down€there€[to€Mississippi]€with€herÏ[Brenda€Gibson]€to€get€them€on€June,€the€1st.ðð€€ð ðThey€came€back€to€our€house,€but€theyÏwent€over€to€their€auntððs€and€stayed€over€there.ðð€€ð ðI€donððt€think€they€stayed€one€night.€IÏdonððt€remember€them€staying€one€night.ðð€€He€said€D.W.€went€to€her€auntððs€house€inÏMemphis€for€a€birthday€party€on€June€11.€€During€that€whole€time€he€said,€ð ðI€never€sawÍthem€again€when€they€went€over€at€their€auntððs,€except€when€they€came€back€on€theÏnight€of€the€7th.ðð€Ìà àThe€child€victim€testified€the€act€of€digital€penetration€occurred€near€her€birthdayÏon€June€9.€€The€child€victim€clearly€identified€this€act€as€one€occurring€at€theÏdefendantððs€house.€€The€evidence€offered€by€the€defendant€shows€he€was€in€contactÏwith€the€child„victim€around€the€time€of€her€birthday€in€June€1994.€The€act€could€haveÏoccurred€without€the€child„victim€spending€the€night.€Ìà àThe€defendant€also€argues€the€testimony€from€nurse€evaluator€Jones€indicatedÏthere€was€no€penetration€because€Jonesððs€evaluation€showed€an€intact€hymen€and€noÏsign€of€penetration;€the€exam€of€D.W.€was€ð ðnormal.ðð€€The€defendant€fails€to€note€thatÏJones€also€said€€the€finding€of€ð ðnormalðð€did€not€mean€the€touching€did€not€occurÏbecause€the€defendant€could€have€used€a€finger€and€just€penetrated€between€theÏchildððs€labia.€€Jones€testified€the€last€instance€of€sexual€assault€was€reported€as€JuneÏ10,€1994.€€She€said€she€would€not€expect€to€find€evidence€of€bruising€after€twenty€daysÏhad€passed.€€The€defendant€argues€that€the€trial€court€held€this€testimony€wasÏinsufficient.€€The€record€does€not€support€the€defendantððs€assertions.€Ìà ×€as€thisÏchild„victim€did.€€In€òòSheltonóó,€the€only€incriminating€evidence€indicating€abuse€of€theÏchild„victim€came€from€two€other€child„victims€who€gave€non„specific€testimony.€€This€isÍclearly€distinguishable€from€the€present€case€which€includes€specific€testimony€fromÏthe€child„victim€and€admissions€by€the€defendant.€Ìà ðSexual€penetrationðð€means€sexual€intercourse,€cunnilingus,€fellatio,€analÏintercourse,€or€òòany€other€intrusion,€however€slightóó,€of€any€part€of€a€personððs€body€or€ofÏany€object€into€the€genital€or€anal€openings€of€the€victimððs,€the€defendantððs,€or€anyÏother€personððs€body,€but€emission€of€semen€is€not€required;ðð€Tenn.€Code€Ann.€ðð€39„13„501(7).€A€€rational€trier€of€fact€could€have€found€that€digital€penetration€occurred.€Ìà àThe€child€victim€testified€this€incident€occurred€at€the€trailer.€€Jamie€had€beenÏborn€at€that€time€indicating€this€act€occurred€after€November€1992.€€She€said€everyoneÏwas€present€at€the€trailer€when€this€occurred.€€She€and€her€sister€were€in€the€room€theyÏshared.€She€told€jurors€she€was€sleeping€on€the€floor;€her€sister€was€in€her€bed€asleep.ÏThe€defendant€entered€the€room€and€ð ðput€his€finger€in€my€private.ððÌà àThe€defendant€argues€the€child€was€under€the€influence€of€her€mother€whomÏthe€defendant€claims€was€attempting€to€extort€money€from€the€defendant.€€TheÏdefendant€also€argues€the€child€was€an€accomplice€and€a€conviction€cannot€be€upheldÏon€the€victimððs€unsupported€testimony.ò óThere€is€nothing€in€the€record€to€support€the€defendantððs€claims€the€child€was€anÍaccomplice€except€for€his€own€feeble€suggestion€that€she€enjoyed€performing€some€ofÏthe€acts.€€This€issue€was€not€raised€during€the€trial€and€was€not€raised€in€the€motion€forÏnew€trial,€therefore,€it€is€waived.Ìà àTennessee€Code€Annotated€ðð€39„13„502€prohibiting€aggravated€rape€andÏTenn.€Code€Ann.€ðð€39„13„522€prohibiting€child€rape€proscribe€the€same€behavior€„„Ïthe€rape€of€a€victim€under€the€age€of€13.€€Both€are€Class€A€felonies.€€The€onlyÏdifference€between€the€two€statutes€is€the€sentences€imposed€following€a€conviction.€ÏIn€prosecutions€pursuant€to€the€aggravated€rape€statute,€the€defendant€becomesÏeligible€for€release€on€the€release€eligibility€date.€€In€prosecutions€pursuant€to€the€childÏrape€statute,€the€defendant€must€serve€100€percent€of€his€sentence.Ìà à€The€letter€also€stated€that€in€March€1994€Brenda€Gibson€moved€in€with€theÏdefendant€in€a€house€in€Moscow.€€The€letter€stated€the€defendant€fondled€the€child„victimððs€vagina€with€his€hands€at€this€house.€€This€occurred,€according€to€the€state,€atÏthe€time€of€the€childððs€eleventh€birthday.€Ìà àIn€the€defendantððs€motion€to€strike,€he€argued€that€except€for€two€specificÏcharges€all€others€should€be€stricken.€€It€should€be€noted,€the€defendant€failed€to€makeÏthe€letter€a€part€of€record.€€He€merely€relies€on€his€own€recitation€of€certain€parts€of€theÏstateððs€letter€for€his€argument.Ìà àDuring€the€hearing€on€the€motion€for€a€€bill€of€particulars,€the€defendant€hadÏreceived€two€audio€tapes€containing€the€defendantððs€admissions€to€penile„vaginalÏpenetration,€fellatio,€and€digital€penetration€of€the€victim.€€The€defendant€also€had€aÏtwo„page€report€prepared€by€Dr.€Alan€Battle,€a€clinical€psychologist,€who€would€testifyÏabout€the€defendantððs€statements.€€The€report€indicated€that€the€defendant€hadÏadmitted€to€sexual€contact€with€the€child„victim.€€The€defendant€also€had€the€indictmentÏwhich€detailed€seven€allegations€of€sexual€penetration€between€June€1990€and€JuneÏ1994.€Ìà àThe€well„established€law€in€Tennessee€does€not€require€an€exact€date€or€yearÏof€an€offense€unless€the€date€ð àThe€original€indictment€limited€the€offenses€to€a€period€between€June€1990€andÏJune€1994;€the€amended€indictment€limited€the€offenses€to€a€period€between€JuneÏ1991€and€June€1994.€This€protected€the€defendantððs€double€jeopardy€rights.€Given€theÏinformation€furnished,€the€defendant€was€provided€with€notice€of€the€charges;€the€courtÏwas€provided€with€adequate€grounds€upon€which€to€enter€a€judgment;€and€theÏdefendant€was€protected€from€being€placed€in€double€jeopardy.€€The€state€wouldÏð ðobviously€be€estopped€from€initiating€subsequent€prosecutions€for€any€similarÏoffenses€against€the€same€victims€occurring€within€the€same€time€period.ðð€€òòByrdóó,€820ÏS.W.2d€at€741.€Ìà àFurthermore,€the€defendant€was€neither€prejudiced€nor€surprised€at€trial.€HisÏdefense€was€not€hampered€by€the€lack€of€specificity€in€the€indictment.€Ìà àThe€defendant€claimed€Brenda€Gibson€threatened€him€a€month€before€sheÏsecretly€recorded€her€conversation€with€him.€€He€testified€Gibson€told€him€that€if€heÏwould€admit€to€sexually€molesting€one€of€the€girls,€she€and€Jamie,€their€daughter,Ïwould€move€back€in€with€him.€€Otherwise,€he€would€not€see€his€daughter€again.€ÏAccording€to€the€defendant,€she€also€told€him€he€had€to€attend€counseling€with€her.€ÏHe€also€testified€she€told€him€that€if€he€provided€her€with€his€Bronco,€$5,000€cash,€aÏwasher/dryer,€some€furniture,€and€$400€a€month€child€support€she€would€not€claim€thatÏhe€sexually€abused€her€daughter.€€He€also€said€his€ex„wife€aroused€him€sexually€andÏthen€stopped.€€She€said€until€he€did€what€she€wanted€she€would€go€no€further.€€Ìà àRegarding€the€conversations€on€the€tapes€and€his€admissions,€the€defendantÏtestified€€he€was€too€drunk€and€he€did€not€remember€making€any€of€those€statements.€ÏAs€for€his€conversation€with€Dr.€Battle€and€those€admissions,€he€said€he€was€ð ðtooÏupsetðð€at€the€meeting€and€did€not€remember€making€those€statements.€€While€he€didÏnot€remember€making€the€statements,€he€testified€he€made€them€because€of€herÏthreats.€€Gibson€said€he€would€do€anything€his€ex„wife€had€asked€because€he€wantedÏher€back.Ìà à€The€defendant€was€able€to€tell€jurors€his€full€story€and€was€not€hampered€by€aÏlack€of€a€bill€of€particulars.€Ìà àThis€issue€is€without€merit.ÌÌò òÓ  ÓADMITTANCE€OF€AUDIO€TAPESÌ€ó óÌÓ  Óà àThe€defendant€contends€the€trial€court€committed€error€of€prejudicial€dimensionÍby€admitting€into€evidence€two€audio€tapes€containing€conversations€with€his€ex„wife.Ìà àOne€tape€was€recorded€on€July€10,€1994€at€Ponchoððs€Mexican€Restaurant€inÏWest€Memphis,€Arkansas.€€A€second€tape€was€recorded€July€18,€1994€at€MazzioððsÏPizza€in€Memphis.€The€conversations€lasted€several€hours.€€Brenda€Gibson€wore€aÏconcealed€microphone.€€Tennessee€Bureau€of€Investigation€agents€recorded€theÏconversations€on€audio€tape.€During€the€€conversation,€Brenda€Gibson€engaged€theÏdefendant€in€conversation€about€the€sexual€assaults€on€her€daughter.€€She€asked€theÏdefendant€for€more€specific€information€as€to€what€occurred€and€when.€Ìà àThe€defendant€admitted€to€sexually€abusing€the€young€girl.€€His€language€wasÏoften€raw€and€lewd.€€He€said€the€victim€masturbated€him€and€a€ð ðfew€timesðð€performedÏoral€sex€on€him.€€He€also€admitted€to€penile€penetration€of€the€victim€saying€ð ðvery€fewÏtimes€did€my€[penis]€touch€her.ðð€€He€estimated€it€was€not€more€than€ten€times.€€HeÏadmitted€telling€the€victim€if€she€told€anyone€about€what€had€been€occurring€ð ðweððd€allÏget€in€trouble.ðð€Ìà àDuring€the€July€18€conversation€Gibson€said,€€ð ðIt€wasnððt€very€many.€€The€wholeÏthing€wasnððt€that€many.€€I€donððt€think€it€was€20€times€the€whole€time,€the€whole€year€youÏare€talking€about.€€Hell,€like€you€say€one€timeððs€enough€Iððm€guilty.ððÌà àThe€defendant€attempted€to€suppress€the€tapes.€€He€argued€he€was€tricked€andÏentrapped€into€making€the€incriminating€statements,€and€his€statements€were€notÏvoluntary.€He€claimed€the€statements€were€taken€in€violation€of€his€constitutional€rightsÏagainst€self„incrimination,€right€to€counsel,€and€due€process.€The€defendant€objectedÏto€the€admissibility€of€the€tapes€based€upon€the€authentication€of€the€tapes€byÏTennessee€Bureau€Investigation€Agent€Terrell€McLean.€€He€argued€what€AgentÍMcLean€heard€was€hearsay.€€On€appeal€he€argues€playing€the€tape€containing€BrendaÏGibsonððs€accusations€in€the€presence€of€the€jury€violated€his€rights€to€confront€theÏwitnesses€against€him.€€Brenda€Gibson€was€not€called€by€the€state€to€testify€during€theÏtrial.€€Objection€is€also€made€to€Brenda€Gibsonððs€statements€regarding€what€herÏdaughter€told€her.€€The€defendant€also€argues€Brenda€Gibsonððs€statements€areÏhearsay€and€her€statements€as€to€what€her€daughter€said€constitute€double€hearsay.Ìà àWhen€the€recordings€were€made€the€defendant€had€not€been€arrested.€He€wasÏmerely€a€suspect€in€the€sexual€abuse€of€his€wifeððs€daughter.€Therefore,€his€rightsÏagainst€self„incrimination,€to€counsel,€and€due€process€were€not€violated.Ìà àThis€case€is€analogous€to€òòState€v.€Jonesóó,€598€S.W.2d€209,€222„23€(Tenn.Ï1980),€in€which€transcripts€of€taped€conversations€between€a€defendant€and€a€non„testifying€witness€were€presented€to€a€jury€by€the€agents€who€monitored€them.× ƒ2 ××  ×€€LikeÏGibson,€Jones€raised€the€confrontation€issue.€€The€Tennessee€Supreme€Court€inÏòòJonesóó€said€that€it€was€neither€a€confrontation€nor€hearsay€problem.€Ìà àBrenda€Gibsonððs€statements€on€the€tapes€were€not€hearsay€because€herÏstatements€were€not€offered€for€the€truth€of€the€matter€asserted.€Tenn.€R.€Evid.€801(c);Ïòòseeóó€òòJonesóó,€598€S.W.2d€at€223.€Her€statements€were€not€offered€or€intended€to€beÏsubstantive€evidence.€The€purpose€of€her€comments€was€to€elicit€statements€from€theÏdefendant.€€As€in€òòJonesóó,€the€state€did€not€ask€the€jury€to€believe€what€she€said€on€theÏtapes.€€The€stateððs€primary€objective€was€to€bring€before€the€jury€the€statements€madeÍby€the€defendant.€€See€òòJonesóó,€598€S.W.2d€at€223.Ìà àThe€issue€of€confrontation€does€not€apply€to€the€statements€made€by€BrendaÏGibson.€Likewise,€what€the€court€said€in€òòJonesóóis€applicable€here.€ð ðThe€issue€ofÏconfrontation€does€not€arise€as€to€her.€The€mere€fact€that€cross„examining€her€wouldÏhave€been€a€defense€lawyerððs€delight,€and€that€this€opportunity€did€not€present€itself,Ïdoes€not€operate€to€add€a€constitutional€dimension€to€the€situation.ðð€òòJonesóó,€598ÏS.W.2d€at€223.€€Even€though€she€did€not€testify,€the€defendant€attacked€her€credibilityÏwhen€he€testified.€€Moreover,€her€conversation€added€nothing€to€the€case€in€light€of€theÏdefendantððs€own€admissions€on€the€audio€tapes,€those€made€to€his€psychologist€andÏin€light€of€the€victimððs€testimony.€Ìà àThe€òòJonesóócourt€held€tape€recordings€may€be€presented€by€any€witness€whoÏwas€present€during€the€recording€or€any€witness€who€monitored€the€recording€as€longÏas€he€can€identify€the€declarant€with€certainty€and€his€testimony€comports€with€theÏother€rules€of€evidence.€598€S.W.2d€at€223.€€The€court€continued,€ð ðwhere€substantial€doubt€is€cast€upon€the€victimððs€sanity,Ïor€where€there€is€a€record€of€prior€mental€disorders€or€sexual€fantasies,€or€where€theÍstory€is€incredible,€and€even€in€these€situations,€only€if€there€is€little€or€no€corroborationÏto€support€the€charge.ðð€€Consequently,€a€trial€court€should€exercise€its€discretionÏsparingly€when€ruling€upon€a€motion€to€require€a€victim€to€undergo€a€psychologicalÏexamination€in€a€sexual€abuse€prosecution.€€òòForbesóó,€559€S.W.2d€at€321.€€In€this€case,Ïthe€trial€court€correctly€found€that€there€was€no€ð ðcompelling€reasonðð€to€require€the€childÏvictim€to€undergo€a€psychological€evaluation.Ìà àThe€defendant€also€filed€a€motion€requiring€the€child€to€be€examined€by€aÏqualified€medical€doctor.€The€examination€would€show,€the€defendant€argues,€theÏchild€had€not€sustained€any€penetration;€this€evidence€would€be€exculpatory€andÏexonerate€the€defendant.€€The€analysis€for€determining€whether€to€compel€a€physicalÏexamination€is€the€same€analysis€discussed€in€òòForbesóó€for€determining€whether€aÏpsychological€examination€should€be€compelled.€€òòState€v.€Baroneóó,€852€S.W.2d€216,Ï221€(Tenn.€1993).€€The€defendant€must€show€a€compelling€need€for€the€examination.€ÏòòBaroneóó,€852€S.W.2d€at€222.€Concerns€of€traumatizing€and€embarrassing€the€victimÏshould€be€balanced€against€the€likelihood€that€the€exam€will€provide€substantialÏmaterial€evidence€for€the€defendant.€In€this€case€an€examination€was€performed€at€theÏMemphis€Sexual€Abuse€Center€and€the€results€were€made€available€to€the€defendant.€ÏIn€fact,€the€defendant€called€Jo€Jones€the€nurse€evaluator€to€testify.€€She€said€her€examÏrevealed€no€evidence€of€sexual€abuse€although€she€qualified€her€answer€saying€thatÏthe€lack€of€evidence€did€not€mean€that€the€sexual€abuse€did€not€occur.€€The€defendantÏcould€have€placed€his€penis€or€finger€in€her€genital€area€without€disturbing€the€hymen.€ÏShe€also€said€she€would€not€expect€to€find€evidence€of€bruising€or€touching€in€that€Ïarea€twenty€days€after€the€last€reported€incident.€€The€defendant€failed€to€establish€aÍcompelling€reason€to€order€another€examination.Ìà à(b)€Notwithstanding€any€other€provision€of€law€to€theÏcontrary,€a€multiple€rapist€or€child€rapist,€as€defined€inÏsubsection€(a),€shall€be€required€to€serve€the€entireÏsentence€imposed€by€the€court€undiminished€by€anyÏsentence€reduction€credits€such€person€may€be€eligible€toÏearn.€.€.€.€ÌÓÓÌà
