àA€jury€convicted€the€petitioner€of€aggravated€assault€on€December€9,Ï1992.€€After€a€hearing,€she€was€sentenced€as€a€Range€II€multiple€offender€to€tenÏyears.€€On€December€4,€1995,€the€petitioner€filed€for€post„conviction€relief.€€AnÏevidentiary€hearing€was€held,€and€the€post„conviction€court€dismissed€her€petition.€€ItÏis€from€this€dismissal€that€she€now€appeals.ÌÌà àà àIn€this€post„conviction€proceeding,€the€petitioner€alleges€that€her€trialÏcounsel€were€ineffective€in€their€representation.€€Specifically,€she€claims€that€counselÏfailed€to€adequately€cross„examine€the€victim€and€the€victimððs€doctor€and€thatÏappellate€counsel€failed€to€file€an€application€for€permission€to€appeal€to€theÏSupreme€Court.€€After€a€review€of€the€record,€we€find€no€merit€to€these€allegations.€ÍThus,€we€affirm€the€judgment€of€the€court€below.ÌÌà àà àThe€petitionerððs€conviction€stems€from€an€incident€in€which€she€attackedÏan€eighty„four„year„old€man€in€his€home.€€At€trial,€an€issue€for€the€jury€to€decide€wasÏwhether€the€victim€had€suffered€ð ðserious€bodily€injury,ðð€a€material€element€of€theÏoffense€with€which€she€was€charged.€€The€victim€and€the€victimððs€doctor€testifiedÏabout€the€extent€of€the€victimððs€injuries.€€The€doctor€testified€that€the€victim€hadÏreceived€a€ð ðbroken€noseðð€in€the€altercation€and€that€such€an€injury€is€ð ðvery€painful.ðð€ÏThe€doctor€never€used€the€term€ð ðextreme€physical€pain,ðð€one€of€the€statutoryÏdefinitions€for€serious€bodily€injury.€€òòSeeóó€T.C.A.€ðð€39„11„106(a)(33).€€The€petitionerÏnow€claims€that€her€defense€counsel,€Rob€Robinson€and€Robert€P.€Ballinger,€wereÏineffective€for€not€pressing€the€doctor€to€explain€exactly€what€he€meant€by€ð ðveryÏpainful.ððÌÌà àà àAt€the€post„conviction€hearing,€the€petitioner€testified€that€she€thoughtÏher€attorneys€should€have€asked€the€doctor€more€questions€about€the€victimððsÏinjuries.€€Specifically,€she€testified€that€they€should€have€asked€the€doctor€what€heÏmeant€by€ð ðvery€painful.ðð€€She€further€testified€that€she€simply€felt€her€attorneys€couldÏhave€done€a€better€job€representing€her.ÌÌà àà àMr.€Robinson€and€Mr.€Ballinger€also€testified€at€the€hearing.€€Mr.ÏRobinson,€an€assistant€public€defender,€testified€that€he€had€thought€the€doctorððsÏtestimony€had€been€beneficial€to€the€petitionerððs€case€because€the€doctor€did€not€useÏthe€statutory€term€ð ðextreme€physical€pain.ðð€€Thus,€he€thought€it€unwise€to€continue€toÏask€questions€which€might€produce€a€less€favorable€answer.ÌÌà àà àMr.€Ballinger,€also€an€assistant€public€defender,€testified€that€he€tooÏthought€the€doctorððs€testimony€had€been€favorable€to€the€petitioner.€€He€testified€thatÏhe€had€felt€that€the€State€failed€to€carry€its€burden€of€proving€to€the€jury€that€the€victimÏhad€suffered€ð ðserious€bodily€injury.ðð€€He€further€testified€that€the€victim€had€not€beenÏconcise€in€describing€his€pain€and€that€the€victimððs€testimony€had€been€sufficientlyÏattacked€through€cross„examination.€€Mr.€Ballinger€testified€that€he€had€asked€theÏcourt€for€a€judgment€of€acquittal€because€the€State€had€failed€to€carry€its€burden€ofÏproof.€€When€the€court€denied€this€request,€Mr.€Ballinger€then€made€the€sameÏargument€to€the€jury.€€After€the€petitionerððs€conviction,€this€issue€was€raised€onÏappeal.ÌÌà àà àð ðIn€post„conviction€relief€proceedings€the€peti‚tioner€has€the€burden€ofÏproving€the€allegations€in€his€[or€her]€petition€by€a€preponderance€of€the€evidence.ðð€ÏòòMcBee€v.€Stateóó,€655€S.W.2d€191,€195€(Tenn.€Crim.€App.€1983).€€Fur‚thermore,€theÍfactual€findings€of€the€trial€court€in€hearings€ð ðare€conclusive€on€appeal€unless€theÏevidence€preponderates€against€the€judgment.ðð€€òòState€v.€Bufordóó,€666€S.W.2d€473,Ï475€(Tenn.€Crim.€App.€1983).Ìœ›à àà àIn€reviewing€the€petitionerððs€Sixth€Amendment€claim€of€ineffectiveÏassistance€of€counsel,€this€Court€must€deter‚mine€whether€the€advice€given€orÏservices€rendered€by€the€attorney€are€within€the€range€of€competence€demanded€ofÏattorneys€in€criminal€cases.€€òòBaxter€v.€Roseóó,€523€S.W.2d€930,€936€(Tenn.€1975).€€ToÏprevail€on€a€claim€of€inef‚fective€counsel,€a€petitioner€ð ðmust€show€that€counselððsÏrepresenta‚tion€fell€below€an€objective€standard€of€reason‚ablenessðð€and€that€thisÏperformance€prejudiced€the€defense.€€There€must€be€a€reasonable€probability€thatÏbut€for€coun‚selððs€error€the€result€of€the€proceeding€would€have€been€different.€ÏòòStrickland€v.€Washingtonóó,€466€U.S.€668,€687„88,€692,€694€(1984);€òòBest€v.€Stateóó,€708ÏS.W.2d€421,€422€(Tenn.€Crim.€App.€1985).ÌÓÓÓÓÌà àà àThis€Court€should€not€second„guess€trial€counselððs€tactical€andÏstrategic€choices€unless€those€choices€were€uninformed€because€of€inadequateÏpreparation,€òò€Hellard€v.€Stateóó,€629€S.W.2d€4,€9€(Tenn.€1982),€and€counsel€should€notÏbe€deemed€to€have€been€ineffective€merely€because€a€different€procedure€orÏstrategy€might€have€produced€a€different€result.€€òòWilliams€v.€Stateóó,€599€S.W.2d€276,Ï280€(Tenn.€Crim.€App.€1980).ÌÌà àà àIn€this€case,€the€post„conviction€court€€found€that€Mr.€Robinson€and€Mr.ÏBallinger€were€highly€competent€and€experienced€attorneys€and€that€the€petitionerÏfailed€to€carry€her€burden€of€proving€her€allegations€by€a€preponderance€of€theÏevidence.€€We€agree.ÌÌà àà àFirst,€the€petitioner€has€failed€to€show€that€her€counselððs€decisions€notÏto€further€question€the€doctor€or€the€victim€œwere›€in€any€way€ineffective.€€As€notedÏabove,€this€Court€will€not€second€guess€the€tactical€decisions€of€attorneys.€€Second,Ïthe€petitioner€has€failed€to€prove€that€she€was€in€any€way€prejudiced€by€herÏattorneysðð€representations.€€She€has€failed€to€provide€any€information€that€had€herÏattorneys€further€questioned€the€doctor€or€the€victim,€the€answers€would€have€beenÏmore€favorable€to€her.€€Thus,€we€affirm€the€conclusion€of€the€trial€court.€€TheÏpetitionerððs€claim€is€devoid€of€merit.ÌÌà àà àThe€petitionerððs€second€complaint€is€that€her€appellate€counsel,€JefferyÏDeVasher,€failed€to€file€an€application€for€permission€to€appeal€to€the€SupremeÏCourt.€€The€appellant€has€waived€this€issue€because€she€has€failed€to€cite€authorityÏto€support€œher›€argument.€€Rules€of€the€Court€€of€Criminal€Appeals€of€TennesseeÏ10(b);€òòState€v.€Killebrewóó,€760€S.W.2d€228,€231€(Tenn.€Crim.€App.€1988).€€In€fact,€herÍwhole€argument€on€this€point€consists€of€two€sentences.€€However,€we€briefly€noteÏthat€Mr.€DeVasher€testified€at€the€post„conviction€hearing€that€after€the€completion€ofÏthe€petitionerððs€appeal€to€this€Court,€he€had€filed€a€motion€to€withdraw€from€furtherÏrepresentation.€€The€motion€was€granted,€and€Mr.€DeVasher€informed€the€petitionerÏof€such.€€He€also€informed€her€of€her€right€to€file€an€application€for€permission€toÏappeal€and€the€time€deadlines€for€doing€so.€€Thus,€this€issue€is€also€devoid€of€merit.ÌÌà
