ÒBinding€Effect€and€Duration.€€A€restraining€order€becomesÏeffective€and€binding€on€the€party€to€be€restrained€at€theÏtime€of€service€or€when€the€party€is€informed€of€the€order,Ïwhichever€is€earlier.€€Every€temporary€restraining€orderÏgranted€without€notice€shall€expire€by€its€terms€within€suchÏtime€after€entry,€not€to€exceed€fifteen€days,€as€the€CourtÏfixes,€unless€within€the€time€so€fixed€the€order,€for€goodÏcause€shown,€is€extended€for€a€like€period,€or€unless€theÏparty€against€whom€the€order€is€directed€consents€that€itÏmay€be€extended€for€a€longer€period.€€The€reasons€for€theÏextension€shall€be€entered€of€record.ÌÌÌÒ àThe€TRO€in€question€was€issued€in€a€domestic€relations€case.€€It€was€theÏcontinuation€of€the€initial€divorce€and€custody€litigation.€€The€specific€purpose€of€theÏpleadings€filed€by€Lanny€Dean€George,€the€former€husband€of€Barri€George€Green,Ïwas€the€custody€of€the€coupleððs€minor€child.€€Thus,€the€TRO€was€in€effect€when€theÏdefendants€committed€the€offense€in€question.€€The€TRO€issued€by€the€chancellor€onÏSeptember€15,€1995,€states€it€is€to€remain€in€effect€ð ðpending€a€final€hearing€in€thisÏcause.ðð€€The€parties€agree€no€hearing€had€been€held€in€the€chancery€court€prior€to€theÏcommission€of€the€offense€in€question.€€Since€the€offense€occurred€in€December€ofÏ1995,€the€TRO€was€still€in€effect€pursuant€to€the€domestic€relations€exception€containedÏin€Tenn.€R.€Civ.€P.€65.07€if€the€TRO€was€valid.€€In€short,€the€stateððs€contention€that€theÏTRO€had€expired€ignores€the€exception€in€Rule€65.07€regarding€the€domestic€relationsÏexception€to€the€time€constraints€set€forth€in€Rule€65.05.Ìà àThe€question€this€Court€must€now€determine€is€whether€the€chancellor€hadÏjurisdiction€to€issue€a€TRO€in€this€case€after€the€filing€and€adjudication€in€juvenile€courtÏof€a€petition€for€€dependency€and€neglect€concerning€the€coupleððs€child.ÌÌò àThe€record€reflects€Lanny€Dean€George€and€the€defendant,€Barri€Jo€GeorgeÏœGreen,€litigated›€the€dissolution€of€their€marriage,€the€custody€of€their€child,€and€theÏdistribution€of€the€marital€assets€in€the€Chancery€Court€of€Gibson€County.€ÏSubsequently,€a€decree€was€entered€dissolving€the€marriage,€awarding€the€defendantÏcustody€of€the€minor€child,€and€distributing€the€marital€assets.Ìà àIn€1993,€Lanny€Dean€George€obtained€a€TRO€which€placed€the€child€inÏprotective€custody.€€Shortly€thereafter,€a€petition€to€declare€the€child€dependent€andÏneglected€was€filed€in€the€Gibson€County€juvenile€court.€€The€juvenile€court€grantedÏthe€Department€of€Human€Services€legal€custody€of€the€child.€€However,€the€judgeÏawarded€Lanny€Dean€George€physical€custody€of€his€daughter€pending€finalÏresolution€of€the€petition.Ìà àOn€May€8,€1995,€the€juvenile€court€judge€heard€evidence€and€decided€the€childÏwas€dependent€and€neglected€within€the€meaning€of€the€statute.€€On€September€11,Ï1995,€the€juvenile€court€entered€an€order€granting€custody€of€the€child€to€theÏdefendant,€Barri€Jo€George€Green.€€The€judge€further€ordered€that€Lanny€DeanÏGeorge€would€have€the€same€visitation€rights€granted€by€the€chancellor.Ìà àGeorge,€aggrieved€that€he€did€not€receive€custody€of€his€daughter,€filed€aÏmotion€€to€(a)€stay€the€judgment€of€the€juvenile€court€and€(b)€modify€the€judgment€of€theÏjuvenile€court€on€September€15,€1995.€€He€also€filed€a€petition€for€change€of€custodyÏand€sought€the€granting€of€the€TRO€which€the€defendants€were€accused€of€laterÏviolating.€€The€TRO€was€issued€September€15,€1995€shortly€after€the€petition€was€filed.Ìà àA€juvenile€court€has€exclusive€original€jurisdiction€of€proceedings€ð ðin€which€aÍchild€is€alleged€to€be.€.€.dependent€and€neglected.ðð€€Tenn.€Code€Ann.€€ðð€37„1„103(a)(1).€€Once€the€juvenile€court€has€assumed€jurisdiction€in€such€matters,€theÏjuvenile€courtððs€ð
