Insubstance,thepresentpetitioncontends(1)thathisrighttoconfrontationwasviolatedwhenhearsaystatementsofanontestifyingcodefendantwereadmittedattrial,(2)thatdueprocesswasviolatedbytheadmissionofhisstatementsbythecodefendantaftertheyunsuccessfullysoughtaseverancebecauseofincompatibledefenses,(3)thathistrial,appellateandpostconvictioncounselwereineffectivebyfailingtopreserveandpresentvariousissues,and(4)thathisremovalfromsafetyvalveearlyparoleeligibilityviolateddueprocessandconstitutedexpostfactoenhancementofpunishment.Hisassertedreasonfornotraisingthetrialissuesbeforeishisignoranceandrelianceuponattorneyswhowereineffective.Thetrialcourtruledthatthepetitionseekingrelieffromhis1986convictionswastimebarredandthatithadnojurisdictionoverthepetitionersparolecomplaints. Atthetimesinissue,therewasathreeyearstatuteoflimitationsforthefilingofpostconvictionactions.SeeT.C.A.4030102(repealed1995).Theexceptionswerequitelimited,essentiallydealingwiththerebeingnoreasonableopportunityexistingduringthelimitationsperiodtofileaclaimonthegroundraised.See,e.g.,Burfordv.State,845S.W.2d204(Tenn.1994);Watkinsv.State,903S.W.2d302(Tenn.1995)(petitionerinsaneduringlimitationsperiod);Woodenv.State,898S.W.2d752(Tenn.Crim.App.1994)(delayeddisclosureofexculpatoryevidencewithheldbystate).However,apetitionersmereclaimofignoranceofthefactsorissuesdoesnottollthestatuteoflimitationsevenifthatignorancestemsfromrelianceuponcounselsadvicerelativetopostconvictionclaims.SeeStatev.Phillips,904S.W.2d123(Tenn.Crim.App.1995).Inanyevent,aclaimofineffectiveassistanceofpriorpostconvictioncounselpresentsnoexcusefornotraisingexistingconstitutionalclaims.SeeHousev.State,911S.W.2d705,712(Tenn.1995).Thus,whenviewedinthecontextofhavingthreepreviousreviewsofhisconvictions,twobeingbymeansofpostconvictionactions,thepetitionersclaimsofignoranceandrelianceuponineffectivecounselarefornaughtrelativetotollingthestatuteoflimitations.Thestatuteoflimitationsappliessoastobarthepostconvictionpetitioninthiscaserelativetothemurderconvictions. Asforthepetitionersclaimthathewaswrongfullystrippedofhisearlyparoleeligibilityunderthesafetyvalvestatute,thetrialcourtwascorrectinconcludingthatitwaswithoutjurisdictiontodeterminetheclaim.IssuesinvolvingDepartmentofCorrectionprisonerreleasecomputationsarenotcognizableinapostconvictioncaseandmustbepursuedundertheAdministrativeProcedureAct.SeeSlaglev.Reynolds,845S.W.2d167(Tenn.1992).Moreover,wenotethattheearlyreleaseeligibilityissueraisedbythepetitionerhasbeenrejectedrelativetoanotherprisoner.SeeKaylorv.Bradley,912S.W.2d728(Tenn.Ct.App.1995).Inanyevent,itisnotajusticiableissueinthiscase.
