State,357S.W.2d57,61(Tenn.1962). -#$  ` Initsreviewoftheevidence,anappellatecourtmustaffordtheState thestrongestlegitimateviewoftheevidenceaswellasallreasonableandlegitimateinferencesthatmaybedrawntherefrom.Tuggle,639S.W.2dat914(citing 4~+, Statev.Cabbage,571S.W.2d832,835(Tenn.1978)).Thecourtmaynot re 6n-. weighorreevaluatetheevidenceintherecordbelow.Evans,838S.W.2dat 8^/0 191(citingCabbage,571S.W.2dat836).Likewise,shouldthereviewingcourt `  findparticularconflictsinthetrialtestimony,thecourtmustresolvetheminfavorofthejuryverdictortrialcourtjudgment.Tuggle,639S.W.2dat914. @  =̛ ` Attrial,TennesseeHighwayPatrolOfficerJamesT.SearstestifiedthatonMarch21,1997,heandtwootherofficersconductedatrafficenforcementroadblockonHighway127inFranklinCounty.Atapproximately11:47p.m.,Defendantdroveintotheroadblockveryslowly,withhisheadlightsonbrightbeam.WhenDefendantstoppedhisvehicle,Searsapproachedandsmelledanodorofalcohol.AfterrequestingDefendantslicense,Searsaskedhimifhehadbeendrinking,towhichDefendantrespondedthathehadconsumedthreetofourbeers.AlthoughSearsfoundDefendantsdemeanorcooperative,hestatedthatDefendantsspeechwas somewhatdraggedoutandslurred. ` Basedupontheseobservations,OfficerSearsaskedDefendanttoparkhisvehicleonthesideoftheroadandstepout.SearsnoticedthatafterDefendantslowlyexitedthecarandclosedthedoor,heleanedbackontothedoor.Searsthenconductedtwofieldsobrietytests:thefingertonosetestandthewalkandturntest.Searstestifiedthathewasnotcertifiedtoconductthehorizontalgazenystagmustest. ` First,hedirectedDefendanttoperformthefingertonosetest.DefendantbeganthetestwithoutwaitingforSearstofinishtheinstructions,contrarytoSearssdirection;andtheofficertestifiedthatheultimatelyhadtoinstructDefendantthreetimes.AccordingtoSears,Defendantwasunsteadyonhisfeetandmissedhisnose,touchinghischeekinstead. 9p02 Ї ` Next,SearsaskedDefendanttoperformthewalkandturntest.DefendantagainbeganthetaskbeforeSearsfinishedtheinstructions,requiringtheofficertostophimandgivetheinstructionsagain.DefendanttookthreetofourstepsandbecamesounsteadythatSears hadtograbhimbecausehewas afraidthathewouldfalloutintrafficorfalldownandhurthimself.Bothtestswereconductedonapavedroadway,withDefendantsbacktothepatrolcarsbluelights.OfficerSearsexplainedtheimpliedconsentlawtoDefendant, F b    1      כand   Defendantrefusedabloodalcoholtest.>>>> F      2      כSearsthenarrestedDefendantandtook   himtothecountyjail. ` Atthejail,countycorrectionalofficerKimRhodesmetSearstoadmitDefendantforbooking.BothSearsandRhodestestifiedthatDefendanthaddifficultywalkingandrequiredassistanceenteringthejail.AccordingtoRhodes,whenshegraspedDefendantsarmtosteadyhim,shesmelleda strongodorofalcoholicbeverage.Rhodestestifiedthatsheindependentlyconcludedonthestandard intakedocumentthatDefendantwas undertheinfluenceofalcohol.Finally,RhodesstatedthatDefendant stumbledoutoftheholdingfacilitywhenhewaspermittedtoleavewitharesponsibleparty. ` Defendanttestifiedonhisownbehalfattrial.Hestatedthathewasonehundredpercentdisabledduetoapastinjurytobothhisfeet.Hetestifiedthatwhilepainting,hefellandbrokebothfeet,requiringhimtobebedriddenand 3 ** confinedtoawheelchairforoneyear.Defendantrecountedhowthedisabilitycauseshimgreatpainanddifficultyinwalking@,@andAreportedAthatheoftenmustingestprescriptionpainkillers.Hestatedthatalthoughhisfeethurtthenightheperformedthefieldsobrietytests,hehadnotingestedanypainkillers.Inaddition,hetestifiedthathetoldOfficerSearsbeforetheteststhathecouldnotperformthembecauseofhisdisability,afactwhichSearsrecollected.Finally,Defendantstatedthathehadconsumedthreeorfourbeersbetweenthehoursof11:00a.m.and2:00p.m.;thathehadnothadanyalcoholafter2:00p.m.;andthatinhisopinion,hewasnotimpaired. ` Theforegoingtestimonypresentedclassicquestionsoffactandcredibilityforthejurytoresolve.ThejurydeterminedfromtheevidencethatDefendantwasdrivingundertheinfluenceofintoxicants,despiteitsacceptanceorrejectionoftestimonyregardingDefendantsdisability.Weconcludethatsucharesolutionwasproperlywithinthejuryspurviewandthattheevidenceissufficienttosupportthefindingbythejuryofguiltbeyondareasonabledoubt.̜ ` Thejudgmentofthetrialcourtisaffirmed.>>>>̛ `     h   ____________________________________ `     h   DAVIDH.WELLES,JUDGE̜  7-- CONCUR:___________________________________̜7JOHNH.PEAY,JUDGE7___________________________________̜8J898.89:AMES:8CURWOODWITT8AA;,JR.;B,JUDGEB
