ÐDefendantððs€application€for€permission€to€appeal.€€The€Defendant€subsequentlyÏfiled€a€petition€for€post„conviction€relief,€which€was€later€amended€afterÏappointment€of€counsel.€€The€trial€court€denied€relief€on€July€15,€1998.€€PursuantÏto€Tennessee€Code€Annotated€ðð€40„30„216€and€Rule€3(b)€of€the€TennesseeÏRules€of€Appellate€Procedure,€the€Defendant€now€appeals€as€of€right€the€trialÏcourtððs€denial€of€post„conviction€relief.€€We€reverse€the€order€of€the€trial€court€andÏremand€for€findings€of€fact€and€conclusions€of€law€as€mandated€by€statute.ÌÌà Ö5v,- Ðappeal€from€the€Defendantððs€conviction.€€òòSeeóó€òòState€v.€œClaude€Francis›€Garrettóó,€No.Ð `  Ð01C01„9403„CR„00081,€1996€WL€38105€(Tenn.€Crim.€App.,€Nashville,€Feb.€1,Ï1996).ÌÌà ` àThe€victim€in€this€case,€Lorie€Lance,€died€on€February€24,€1992€fromÏsmoke€inhalation€in€a€fire€that€consumed€the€residence€she€shared€with€theÏDefendant.€€When€firefighters€arrived€at€the€scene,€the€Defendant€reported€toÏthem€that€he€had€escaped€the€flames€but€that€the€victim€was€still€inside.€€He€toldÏthem€he€had€last€seen€the€victim€run€toward€the€back€of€the€house.€€FirefightersÏfound€her€lying€unconscious€on€the€floor€of€the€utility€room€in€the€rear€of€theÏhome.€€Although€the€room€contained€a€door€which€led€outside,€according€to€Ïtestimony€of€police€officers€at€trial,€the€door€was€locked€from€the€outside€of€theÏhome,€and€the€windows€in€the€room€were€boarded.€€The€victim€was€foundÏwedged€between€the€washer€and€dryer€and€the€wall.€€Despite€efforts€to€revive€theÏvictim,€she€never€regained€consciousness.€€The€Defendant€suffered€severe€burnsÏto€his€left€arm€and€face,€and€his€facial€hair€was€singed€in€the€fire.ÌÌà ` àAn€investigation€revealed€that€arson€was€likely€the€cause€of€the€fire.€ÏTraces€of€kerosene€were€found€on€the€living€room€œfloor›€where€the€blaze€arose,Ïa€kerosene„soaked€bedspread€was€found€in€front€of€the€refrigerator,€and€a€œfive„›Ïgallon€plastic€container€filled€with€kerosene€was€discovered€between€the€kitchenÏand€utility€room.€€In€addition,€a€smoke€detector€from€which€the€battery€had€beenÏremoved€was€found€on€the€dryer€in€the€utility€room.€€The€investigation€alsoÏrevealed€that€the€door€to€the€utility€room€inside€the€home€was€closed€during€theÏâ âfire.€€The€Defendantððs€clothing€tested€negative€for€accelerant.€€An€autopsyÐ à7€.0 Ðrevealed€that€the€victim€had€a€blood€alcohol€level€of€.06€percent€at€the€time€of€herÏdeath.Ìâ âÌà ` àA€neighbor€testified€at€trial€that€he€observed€the€Defendant€stooping€nextÏto€a€tree€during€the€blaze.€€He€stated€that€when€he€crossed€the€road€to€help,€theÏDefendant€picked€up€a€chair,€began€to€break€the€windows€of€the€residence,€andÏbegan€to€call€the€victimððs€name.€€The€neighbor€described€the€DefendantððsÏdemeanor€on€the€night€of€the€fire€as€ð ðsort€of€cold.ðð€€One€firefighter€testified€thatÏwhen€he€was€unable€to€locate€the€victim,€the€Defendant€told€him,€ð ðI€know€whereÏsheððs€at,€if€youððll€go€straight€through€the€back€of€the€house€sheððs€through€a€backÏdoor,€the€door€in€the€back€of€the€house€by€the€kitchen.ððÌÌà ` àA€police€detective€testified€that€the€Defendant€appeared€to€be€nervousÏimmediately€after€the€fire.€€He€stated€that€the€Defendant€asked€whether€he€wasÏunder€arrest,€although€he€had€not€yet€been€accused€of€starting€the€fire.€€He€alsoÏpointed€out€that€in€statements€to€police,€the€Defendant€presented€two€differentÏversions€of€what€happened€on€the€night€of€the€fire.€€However,€firefighters€whoÏtestified€for€the€defense€stated€that€they€had€to€restrain€the€Defendant,€whoÏappeared€to€be€intoxicated,€from€re„entering€his€home€on€the€night€of€the€fire.€ÏOne€testified€that€the€Defendant€was€beating€on€the€door€of€the€fire€truck€andÏfrantically€telling€the€firefighters€that€the€victim€was€in€the€bedroom.ÌÌà ` àWhen€police€decided€to€press€charges€against€the€Defendant,€they€wereÏunable€to€find€him.€€They€eventually€located€him€in€Hiawatha,€Kansas.€€TheÏDefendant€explained€that€he€had€gone€there€to€stay€with€his€mother€and€claimedÏthat€several€people€knew€how€to€reach€him.Ð Ð9p02 Їà ` àThe€Defendant€testified€that€he€and€the€victim€had€been€involved€in€aÏrelationship€for€one€and€a€half€years€and€planned€to€be€married.€€He€testified€thatÏon€the€night€of€the€fire,€he€and€the€victim€had€visited€a€local€bar€for€several€hours.€ÏHe€stated€that€they€returned€to€their€residence,€watched€television,€and€fell€asleepÏon€the€couch€before€getting€into€bed.€€The€Defendant€reported€that€he€awoke€toÏthe€fire,€arose,€walked€to€the€bedroom€door,€and€called€to€the€victim.€€He€statedÏthat€she€grabbed€his€arm€but€then€pulled€away€and€walked€toward€the€back€of€theÏhouse.€€ÌÌà ` àThe€Defendant€explained€that€the€door€to€the€utility€room€was€not€locked,Ïbut€merely€hard€to€open.€€He€also€stated€that€kerosene€was€stored€in€the€houseÏfor€use€in€a€kerosene€heater,€and€he€maintained€that€he€had€spilled€someÏkerosene€on€more€than€one€occasion€while€filling€the€heater.€€Furthermore,€heÏclaimed€that€the€smoke€detector€had€been€taken€down€while€the€kitchen€wasÏbeing€painted€and€that€it€was€inoperable€because€the€victim€forgot€to€buyÏbatteries€for€it.€€Finally,€he€suggested€a€couple€of€potential€suspects€who€heÏbelieved€may€have€started€the€fire.€€ÌÌà ` àOther€witnesses€at€trial€described€a€tumultuous€relationship€between€theÏDefendant€and€the€victim.€€The€victimððs€supervisor€at€Unoððs€Pizzeria,€where€sheÏworked€at€the€time€of€her€death,€testified€that€the€victim€once€came€to€work€withÏa€black€eye€and€marks€on€her€leg€and€lower€back.€€Another€witness€testified€thatÏthe€victim€once€claimed€to€have€received€bruises€at€the€hands€of€the€Defendant.€ÏœA›€waitress€from€the€bar€that€the€victim€and€the€Defendant€visited€on€the€night€ofÏthe€fire€testified€that€although€the€victim€and€the€Defendant€had€not€fought€thatÏevening,€the€victim€appeared€to€be€fearful€of€the€Defendant.€€The€DefendantÐ Ð9p02 Ðadmitted€that€he€had€ð ðbeatenðð€the€victim€on€three€prior€occasions.€€He€alsoÏadmitted€that€he€had€previously€been€convicted€of€grand€theft,€two€burglaries,€andÏa€jail€escape.ÌÌÓ  ÓPOST„CONVICTION€PROCEEDINGÌÓ  Óà ` àAt€the€post„conviction€hearing,€Detective€David€Miller,€the€lead€investigatorÏfor€the€case,€testified€about€a€report€which€he€wrote€during€the€investigation.€€InÏthe€report,€he€stated,€ÌÓÓà8 ` àHave€contacted€Captain€Jenkins€about€the€position€of€the€victimððsÏbody€when€located€in€utility€room.€€According€to€Captain€Jenkins,€theÏvictim€was€lying€parallel€to€the€outside€wall,€with€her€head€layingÏclosest€to€the€corner€near€the€washer€and€dryer.€€òòAs€best€as€CaptainÐ Èh ÐJenkins€remembers€to€us,€the€door€to€the€storage„utility€room,€theÏdoor€was€not€locked.ó󀀜иX` ü!` ü! ÐÌ(Emphasis›€œadded).€€›Ó¹+ÓAt€the€hearing,€Miller€claimed€to€remember€ð ðhaving€the€initialÏconversationðð€but€could€not€remember€any€specifics€of€the€conversation€asideÏfrom€what€he€had€included€in€his€report.€€He€stated€that€after€he€wrote€the€report,Ïhe€forwarded€it€to€the€œdistrict›€œattorneyððs›€office.€€It€appears€from€the€record€that€thisÏreport€was€not€disclosed€to€defense€counsel,€although€we€emphasize€that€thereÏare€no€findings€of€fact€in€the€record.ÌÌà ` àMiller€also€testified€about€a€toxicology€report€which€contained€the€resultsÏof€a€blood€alcohol€test€performed€on€the€Defendant€shortly€after€the€fire.€€The€test€Ïresults€revealed€that€the€Defendant€had€a€blood€alcohol€level€of€0.11€percent€onÏthe€night€of€the€fire.€€Miller€stated€that€a€copy€of€the€toxicology€report€ð ðshould€haveÏbeenðð€forwarded€to€the€œdistrict›€œattorneyððs›€office€along€with€all€other€reports€in€theÏcase.ÌÐ Ø8x/1 Ðà ` àCaptain€Otis€Jenkins€of€the€Metro€Fire€Department€next€took€the€stand€atÏthe€post„conviction€hearing.€€Jenkins€testified€that€he€responded€to€the€fire€onÏFebruary€24,€1992€and€was€likely€the€first€person€to€discover€the€victimððs€body€inÏthe€utility€room.€€Contrary€to€the€statement€attributed€to€him€in€Detective€MillerððsÏreport,€Captain€Jenkins€stated€that€the€outside€door€to€the€utility€room€was€lockedÏwhen€he€arrived.€€He€reported€that€he€testified€at€trial€that€the€door€was€lockedÏand€unequivocally€maintained€that€he€could€not€possibly€have€been€mistakenÏabout€this€fact.€€He€stated€that€€he€had€no€memory€of€ever€indicating€to€DetectiveÏMiller€that€the€door€was€unlocked.ÌÌà ` àGreg€Galloway,€the€Defendantððs€attorney€at€trial,€also€took€the€stand€at€theÏpost„conviction€hearing.€€He€stated€that€he€had€been€an€attorney€for€twenty„threeÏyears€and€œtestified€that›€he€believed€this€case€may€have€been€his€first€murder€trial.€ÏHe€stated€that€he€worked€on€the€case€for€approximately€a€year€before€the€trial,Ïdevoting€ð ðat€least€150€hoursðð€to€the€case.€€Galloway€estimated€that€he€spoke€withÏthe€Defendant€approximately€six€times€in€person€and€on€the€phone€on€otherÏoccasions.€€He€testified€that€he€and€the€Defendant€discussed€the€Stateððs€writtenÏresponse€to€their€discovery€request.€€Ô‡ŠÓŠŠŠÓÔHe€further€testified€that€the€Defendant€sentÐ P*ð " Ðhim€several€letters€which€included€witnesses€the€Defendant€believed€should€beÏcalled€to€testify€at€trial.€€He€recalled€that€he€and€the€Defendant€discussed€theÏwitnesses€and€settled€on€approximately€eight€witnesses€to€be€subpoenaed€forÏtrial.Ô#†ŠÓŠŠŠÓj6#ԀР2°(* àGalloway€stated€that€he€spoke€with€Detective€Miller€primarily€over€theÏphone€prior€to€trial€and€that€they€discussed€whether€the€door€to€the€utility€roomÏwas€locked€or€unlocked.€€He€stated€that€Miller€ð ðsaid€that€as€far€as€his€investigationÐ Ð9p02 Ðrevealed,€that€the€door€was€not€locked.ðð€€In€addition,€Galloway€testified€that€heÏattempted€to€speak€with€Captain€Jenkins€and€other€firefighters€present€at€theÏscene€of€the€fire.€€He€maintained€that€he€left€messages€for€them€by€phone€whichÏwere€never€returned.€ÌÌà ` àFurthermore,€Galloway€testified€that€he€sent€a€discovery€request€to€theÏœassistant›€œdistrict›€œattorney›€œgeneral›€handling€the€case€but€stated€that€he€did€not€fileÏa€copy€of€the€letter€with€the€court.€€Among€the€documents€provided€him€by€theÏState€was€a€diagram€of€the€house€which€did€not€include€any€indication€that€aÏbedspread€was€found€in€front€of€the€refrigerator.€€He€stated€that€it€was€aÏð ðcomplete€surprise€to€[him]€when€.€.€.€one€of€the€firemen€testified€that€there€wasÏa€blanket€or€something€in€front€œof›€the€refrigerator.ðð€€Galloway€testified€that€as€aÏresult€of€his€surprise,€he€did€not€cross„examine€the€witness€concerning€theÏdiagram€because€ð ð[i]t€didnððt€occur€to€[him]€that€[the€blanket]€wasnððt€on€the€diagramÏat€that€point€and€time.ðð€€However,€he€also€admitted€that€an€evidence€log€whichÏwas€turned€over€to€him€during€the€discovery€process€listed€as€one€of€the€itemsÏrecovered€from€the€scene€ð ð[b]ed€material,€bedspread€.€.€.€found€at€the€base€of€theÏrefrigerator.ðð€€Galloway€pointed€out€that€the€evidence€log€did€not€mention€that€theÏbedspread€had€been€soaked€in€kerosene.ÌÌà ` àGalloway€testified€that€before€trial,€he€spoke€with€Assistant€District€AttorneyÏGeneral€Zimmerman,€who€prosecuted€the€œcase,›€and€stated€that€Zimmerman€ð ðledÏ[him]€to€believe€that€he€had€no€information€indicating€the€door€was€locked.ðð€€Ô‡ŠÓŠŠŠÓÔHeÐ 4 *, Ðrecalled€that€he€did€not€prepare€a€defense€to€counteract€evidence€indicating€theÏâ âdoor€was€locked.€€Ô#†ŠÓŠŠŠÓu?#ÔHe€reported€that€had€he€known€the€State€would€introduceÐ à7€.0 Ðevidence€at€trial€that€the€door€was€locked,€he€would€have€ð ðtried€to€counteract€thatÏsome€way,€or€find€the€reason€if€it€was€locked.ðð€€Ìâ âÌà ` àNext,€Galloway€conceded€that€as€a€result€of€an€ð ðoversight,ðð€he€failed€toÏrequest€ð ðJencks€Act€materialðð€after€Detective€Millerððs€testimony€at€trial.€€He€statedÏthat€he€therefore€had€no€access,€either€before€or€during€the€trial,€to€Millerððs€reportÏin€which€Miller€claimed€Captain€Jenkins€remembered€that€the€outside€utility€roomÏdoor€was€not€locked.€€ÌÌà ` àIn€addition,€Galloway€described€an€incident€at€trial€involving€a€violation€ofÏthe€courtððs€sequestration€order.€€Apparently,€a€relative€of€the€victim€was€relatingÏtrial€testimony€to€potential€witnesses€in€the€hallway€outside€the€courtroom€duringÏthe€trial,€and€for€this€reason,€the€trial€judge€had€the€person€taken€into€custody.€ÏGalloway€stated€that€he€did€not€move€for€a€mistrial,€explaining,€ð ðI€just€knew€thatÏhe€was€talking€to€potential€witnesses,€I€didnððt€know€what€he€said,€so€I€really€didnððtÏknow€if€it€was€serious€enough€to€ask€for€a€mistrial,€so€I€didnððt.ðð€€He€also€admittedÏthat€he€failed€to€make€an€offer€of€proof€concerning€the€violation€because€heÏð ðdidnððt€think€about€it.ðð€€ÌÌà ` àFinally,€Galloway€stated€that€he€was€not€provided€a€copy€of€the€toxicologyÏreport€containing€the€results€of€the€Defendantððs€blood€alcohol€tests,€whichÏindicated€that€the€Defendant€had€a€blood€alcohol€level€of€œ.11›€percent€on€the€nightÏof€the€fire.€€He€testified€that€had€he€had€access€to€the€report€before€trial,€he€wouldÏhave€brought€this€fact€to€the€attention€of€the€jury€and€used€the€test€results€to€helpÏexplain€some€of€the€Defendantððs€behavior€on€the€night€of€the€fire.€€He€stated,Ïð ð[H]e€was€apparently€kneeling€or€hiding€under€a€tree€and€not€doing€anythingÐ Ð9p02 Ðabout€the€fire,€or€.€.€.€he€had€no€reaction€to€the€fire;€he€had€low€affect€or€he€wasnððtÏupset€enough€and€that€could€explain€it,€him€being€drunk.ðð€€However,€he€didÏconcede€on€cross„examination€that€the€Defendant€told€him€before€trial€that€heÏwas€drinking€on€the€night€of€the€fire,€and€Galloway€admitted€that€he€did€presentÏthis€information€to€the€jury.€ÌÌà àAssistant€District€Attorney€General€John€Zimmerman€next€took€the€stand.€ÏHe€testified€that€two€diagrams€of€the€residence€shared€by€the€Defendant€and€theÏvictim€were€provided€to€the€defense.€€He€stated€that€neither€depicted€a€bedspreadÏin€front€of€the€refrigerator,€but€he€also€pointed€out€another€document€provided€toÏdefense€during€discovery€which€contained€the€following€language:ÌÓÓà8 ` àIn€reviewing€the€enclosed€sketch€submitted€by€Fire€InvestigatorÏKenneth€Porter,€of€the€crime€scene€located€1114€Broadway€in€OldÏHickory,€Tennessee,€we€find€several€discrepancies€.€.€.€in€this€sketchÏthat€we€feel€needs€[sic]€to€be€corrected€or€discussed€before€placingÏthis€document€into€the€homicide€case€file.€.€.€.€€Item€Number€6.€€TheÏbedspread€lying€in€.€.€.€the€kitchen€in€front€of€the€refrigerator€whichÏwas€soaked€with€kerosene€is€not€depicted€in€the€sketch.Ð ` ü!` ü!
