(  @( OPINIONFILED:򀀀 |.)4 AFFIRMEDJOEG.RILEY,JUDGE  62=  7\XdXXd7 P@qq* OPINION    ` AFranklinCountyjuryconvicteddefendantofaggravatedburglary,aClassCfelony,andtheftofpropertyover$1000,aClassDfelony.Thesoleissueinthisappealasofrightistheproprietyofthetrialcourtsrulingthatdefendantspriorfelonymarijuanaconvictionwasadmissibleforpurposesofimpeachment.Baseduponourreviewoftherecord,we AFFIRM thejudgmentofthetrialcourt.   @+ FACTS  D  ` Defendantwasindictedandconvictionedforaggravatedburglaryandtheftofa4wheelallterrainvehicle(ATV)valuedatover$1000.ThestatesproofattrialincludedidentificationtestimonyfromtwoeyewitnesseswhoidentifieddefendantasthepersonridingthestolenATVthedayoftheburglary,andtestimonyfromdefendantsexmotherinlawthatdefendantpromisedtoreturntheATVifsheandherhusbandwoulddropthechargesagainsthim. ` Thestateservednoticeondefendantofintenttousehispriorfelonymarijuanaconvictionforpurposesofimpeachmentattrial.Atthecloseofthestatesproofandoutsidethepresenceofthejury,defensecounselobjectedtoadmissionofthepriorconviction.ThetrialcourtoverruledthemotionfindingthattheconvictionmettheprerequisitesofTenn.R.Evid.609(a)foradmissibility.Duringdefendantsdirectexamination,defensecounseleliciteddefendantsacknowledgmentofthepriorconviction.Thestatedidnotaddresstheconvictionduringcrossexamination.
