D)<"& ShethendrovethetwomalesaroundJeffersonCitywhiletheyliterallyproceededto +$(  paintthetownwithspraypaintandgraffiti.  #  5      ׀Specifically,thetwomenspray  paintedthewallofapizzarestaurant,atrailerbelongingtoaconstructionsite,andthefloorofachurchpicnicareawithobscenitiesandsatanicandgangrelatedepithets.Theappellantdidnotgetoutofthevehicleanddidnotpersonallyspraypaintanything. ` Soonaftertheirarrestonthevandalismcharges,thethreesomeofferedtorepairthepropertiesthatwerevandalized.Twoofthepropertieswerecleanedbytheappellantandhercodefendantsandthethreedefendantsmadeapublicapologyinthelocalnewspaper. ` Atthesubsequentsentencinghearing,theproofindicatedthattheappellantisatwentyyearoldhighschoolgraduatewithacosmetologylicenseandplanstoattendcollegetostudytobecomeanelementaryschoolteacher.Proofwasalsointroducedwhichrevealedthat,whileonbondonthepresentcharges,theappellantreceivedasdispositionninetydayspretrialdiversiononpriorbadcheckcharges.Theappellantalsoadmittedtofourpreviousspeedingticketsandonepriorviolationfordrivingwithoutadriverslicense.Thepresentencereport,attachedtotherecord,indicatesaratherpooremploymenthistoryandthefactthattheappellantadmitstosmokingmarijuanaatleastonceaweek. ` Inimposingsentence,thetrialcourtfound:8 ` Iwouldfindthatbecauseofthemultipleoffensesthatoccurredonthisevening,itwasntjustoneplace,itwasseveral;youhavethreechargesthatyouvebeenfoundguiltyof,threeseparatelocationswheredamagewasdone,Iveseenevidenceofothercriminalconductthathappenedthatnightforwhichyouwerentcharged,otherplaceswerepainted;andtoavoiddepreciatingtheseriousnessofthoseoffenses,andyouhavehadsomeinvolvementswiththelaw,IwouldfindthatitwouldbeappropriatetodenydeferringtheJudgmentin 6/5 eachofthesethreecases,andwouldmakethatfindingunderthelawthattheCourtwoulddenydeferral. ` !` ! 8 ` ButIamfindingthatunderthelawIcouldmaketheFelonycount,too,butoutofconsiderationforyourageandallthethingsyouvetoldme,Imgoingtoallowthatonetobedeferredforaperiodoftwoyearstogiveyouanopportunitytodowhatyoutoldmeyouwanttodoandwhatyourecertainlycapableofdoing;thatis,tofurtheryoureducation,getthiscourtthingbehindyou.Butitllbehangingoveryourheadforthatperiodoftwoyears. ` !` ! 8 ` Thereareaggravatingcircumstancesthatdoapplyinyourcase.Therewasevidenceofothercriminalconduct.Theresamultiplicityoftheseoffenseswhichwerenotchargedwhichwouldjustifyrasingthepenaltyabovetheminimum. ` !` !
