Inthisappealasofright,thepetitionerpresentstwoissuesforreview.First,hecontendsthatthetrialcourterredindismissingthepetition,andsecond,thathewasdeniedeffectiveassistanceofcounselondirectappeal.Afterconsiderationoftherecordinthiscause,wefindthepetitionerscomplaintstobewithoutmeritandaffirmthetrialcourtsaction.  Thepetitionerassertsinhispetitionthathisconvictionsandsentencesarevoidbecausetheyarenotbaseduponproofbeyondareasonabledoubtasaresultofanimproperjurychargedefiningreasonabledoubtasbeingdoubt toamoralcertainty.Heassertsthattheallegedlyincorrectinstructiondeprivedthetrialcourtofitsjurisdiction,makinghisconvictionsandsentencesvoid.Healsoassertsthathereceivedineffectiveassistanceofcounselonappealbecausehiscounselfailedtoraiseasanissuetheimproperjurychargeconcerningreasonabledoubt.  AmotiontodismissthepetitionwasfiledbytheState.Thismotionassertedthatthecourtlackedsubjectmatterjurisdictionbecausethepetitionerssentencehasnotexpirednorishisconvictionvoid.ThetrialcourtgrantedtheStatesmotiontodismissandthepetitionerappealsfromthatorder.̜  Inhisfirstissuethepetitionercontendsthatthetrialcourterredindismissinghispetitionforhabeascorpusrelief.Inorderforacourttoissueawritofhabeascorpus,thepetitionerssentencemusthaveexpiredand/ortheconvictionmustbevoidandthepetitionereligibleforimmediaterelease.InPassarellav.State,891S.W.2d619(Tenn.Crim.App.1994),thisCourtoutlinedthecircumstancesunderwhichhabeascorpusreliefisavailable:     Itisawellestablishedprincipleoflawthattheremedyofhabeascorpusislimitedinscopeaswellasrelief.Incriminalcases,theremedyislimitedtocaseswherethejudgmentisvoidorthetermofimprisonmenthasϜexpired....Ifthecourtrenderingajudgmenthasjurisdictionoftheperson,thesubjectmatter,andhastheauthoritytomakethechallengedjudgment,thejudgmentisvoidable,notvoid;andthejudgmentmaynotbecollaterallyattackedinasuitforhabeascorpusrelief. Thepetitionerssentencehasnotexpiredashispetitionshowsonitsface.Hedoes,however,arguethathisconvictionisvoidbecausethejuryinstructiongivenon reasonabledoubtwasunconstitutionalinthatitallowedthejurytoconvicthimbyastandardlowerthanthatrequiredbylaw.Thejuryinstructiongivenattrialon reasonabledoubtwasasfollows:     Reasonabledoubtisthatdoubtengenderedbyaninvestigationofalltheproofinthecaseandaninability,aftersuchinvestigation,toletthemindresteasilyastothecertaintyofguilt.Reasonabledoubtdoesnotmeanaϐcaptious,possible,orimaginarydoubt.Absolutecertaintyofguiltisnotdemandedbythelawtoconvictofanycriminalcharge,butmoralcertaintyisrequired,andthiscertaintyisrequiredastoeverypropositionofproofrequisitetoconstitutetheoffense. D     Thepetitionerarguesthatbecauseoftheimproperjuryinstructiongiven,hewasnotfoundguilty beyondareasonabledoubtandthathisconvictionsarevoidandthereforemaybeattackedbyapetitionforawritofhabeascorpus.Wedonotagree.  ThisCourthaspreviouslyheldthatsuchaninstructionisnotimproper.SeePettyjohnv.State,885S.W.2d364,366(Tenn.Crim.App.1994).Also,thisCourthasheldthatevenifthejuryinstructionwaserroneous,itwouldresultinavoidablejudgmentandnotavoidjudgment.SeeWillieEdwardThorntonv.Raney,No.02C019302CC00025,LauderdaleCounty(Tenn.Crim.App.FiledJanuary26,1994,atJackson).  Inhisotherissuethepetitionerassertsthathewasdeniedtheeffectiveassistanceofcounselonappeal.Thisissueisalsowithoutmeritasthis,eveniftrue,againwouldresultinavoidablejudgment,makingitanissuetoberaisedinapostconvictionpetition,notapetitionforwritofhabeascorpus.SeeGeneVossv.FredRaney,No.02C019501CC00022,LauderdaleCounty(Tenn.Crim.App.filedAugust2,1995,atJackson).
