'   ׀HeiscurrentlyconfinedattheTurneyCenterfacilityoftheDepartmentofCorrectionwhereheisservingafiftyyearsentencefortenarmedrobberyconvictions.Theappellant'sconvictions,resultingfromajuryverdictinRutherfordCounty,wereaffirmedbythiscourtonappeal.Statev.FrankGlennHall,No.88186III,(Tenn.Crim.App.atNashville,Feb.9,1989).InFebruary,1992,theappellantpetitionedforpostconvictionreliefclaimingineffectivenessoftrialcounsel.TheRutherfordCountyCriminalCourtdeniedtheappellant'sclaimforpostconvictionrelief.Thisdismissalwasaffirmedbythiscourt.FrankGlennHallv.State,No.01C019205CC00157(Tenn.Crim.App.,Sept.8,1992).Amotiontoreconsiderwasfiled,butwasdeniedbythiscourtasbeing"toolatetoentertain."OnAugust25,1993,theappellantsoughtanapplicationforextraordinaryappealpursuanttoRule10,Tenn.R.App.P.Thiscourtdeniedtheappellant'srequestonSeptember22,1993.Almosttwoyearslater,onJuly14,1995,theappellantfiledtheinstantpetitionforwritofhabeascorpus.TheHickmanCountyCircuitCourtdismissedtheappellant'spetition,findingthatitfailedtostateacognizableclaimforhabeascorpusrelief.Theappellantnowconteststhisdismissal. Theappellantcontendsthathisconvictionsarevoidfortworeasons(1)thetrialcourt'sinstructiononthedefinitionof"reasonabledoubt"waserroneous,and(2)hereceivedineffectiveassistanceofappellatecounsel.Thetrialcourtdismissedtheappellant'spetitionforhabeascorpusrelieffindingthesegroundsinsufficienttovoidtheappellant'sconvictions. InTennessee,habeascorpusreliefisonlyavailablewhenaconvictionisvoidbecausetheconvictingcourtwaswithoutjurisdictionorauthoritytosentenceadefendant,orthatadefendant'ssentencehasexpiredandheisbeingillegallyrestrained.Archerv.State,851S.W.2d157,164(Tenn.1993).Indistinguishinghabeascorpusrelieffrompostconvictionrelief,thiscourtinPassarellav.State,891S.W.2d619,627(Tenn.Crim.App.1994),heldthat:8 Ifthecourtrenderingajudgmenthasjurisdictionoftheperson,thesubjectmatter,andhastheauthoritytomakethechallengedjudgment,thejudgmentisvoidable,notvoid;andthejudgmentmaynotbecollaterallyattackedinasuitforhabeascorpusrelief. Conversely,ifthefaceoftherecordrevealsthatthecourtdidnothave personalandsubjectmatterjurisdiction,ortheauthoritytomakethe challengedjudgment,thejudgmentisvoid. Initially,wenotethatanallegationofanerroneousjuryinstructionwillnotsustainanactionforhabeascorpusrelief.SeeVossv.Raney,No.02C019501CC00022(Tenn.Crim.App.atJackson,Aug.2,1995),perm.toappealdenied,(Tenn.Nov.20,1995);Thorntonv.Raney,No.02C019302CC0025(Tenn.Crim.App.atJackson,January26,1994),perm.toappealdenied,(Tenn.May23,1994).Furthermore,ourcourtshaveconsistentlyupheldthechallengedreasonabledoubtinstructionasconstitutionallyvalid.See,e.g.,Statev.Nichols,877S.W.2d722,734(Tenn.1994),certdenied,__U.S.__,115S.Ct.909(1995);Pettyjohnv.State,885S.W.2d364(Tenn.Crim.App.),perm.toapp.denied,(Tenn.1994);Statev.Beckham,No.02C019405CR00107(Tenn.Crim.App.atJackson,Sept.27,1995);Statev.Voaden,No.01C019305CC00151(Tenn.Crim.App.atNashville,Dec.22,1994),perm.toappealdenied,(Tenn.May1,1995).Accordingly,thisissueiswithoutmerit. Concerningtheappellant'ssecondissue,allegingineffectiveassistanceofappellantcounsel,thetrialcourtfound(1)lackofsubjectmatterjurisdictioninthatthepetitionwasnotfiledinthecountyofconvictionand(2)itistimebarred.Weagreewiththesefindings.Tenn.CodeAnn.4030103(a)(1994Supp.)(repealed1995)requiresthatapetitionforpostconvictionreliefbebroughtinthecountyofconviction.ThepetitionwasfiledinHickmanCounty,however,theappellant'sconvictionoriginatesinRutherfordCounty.Thus,thetrialcourtdidnothavesubjectmatterjurisdictionoverthepetition.Moreover,therecordestablishesthattheappellant'sjudgmentsofconvictionbecamefinalonFebruary9,1989.Theappellant'sclaim,althoughcognizableforpostconvictionpurposes,isnonethelesstimebarredasitwasfiledoutsidetheapplicablethreeyearstatuteoflimitationsperiod.Tenn.CodeAnn.4030102(1990)(repealed1995).Additionally,thisissueiswaivedbecauseitcouldhavebeenpresentedintheappellant'sfirstpetitionforpostconvictionrelieffiledin1992.SeeTenn.CodeAnn.4030111(1990)(repealed1995);Tenn.CodeAnn.4030112(1990)(repealed1995).Accordingly,thisissueisalsowithoutmerit.
