ThedefendantwasconvictedofaggravatedassaultunderTennesseeCodeAnnotatedSection3913102(a)(3).Forthereasonsdiscussedbelow,wemodifythedefendantsconvictiontoassaultasdefinedinTennesseeCodeAnnotatedSection3913101(a)(1)andhissentencetoeleven(11)monthsandtwentynine(29)days. WilliamHansard,thedefendant,andHollyMcGill,thevictim,wereinvolvedinabriefbutturbulentmarriage.Withinafewweeksoftheirwedding,McGillfledhometoherparents.Recurringviolencedefeatedallattemptsatreconciliation.InJuly,1994,McGillfiledfordivorce.OnOctober25,1994,McGillrequestedandJudgeCharlesS.Sextongrantedanexparteorderofprotection.Thedefendantwasservedwithacopyoftheorderthefollowingday.NeitherMcGillnorthedefendantappearedatthehearingscheduledforNovember4,1994. '   ׀InmidDecember,thedefendantbegansleepingatMcGillsapartment.HeworkedatOberGatlinburgandhelpedMcGillbuysomethingsfortheirson. OnthenightbeforetheeventsatissueinthiscasethedefendantreturnedhomefromworktofindthatMcGillhadvisitors.Thedefendantbecameangry.McGilltestifiedthat,thenextmorningasshewascookinghisbreakfast,thedefendantaccusedheroftalkingto"herboyfriend"onthetelephone.Heyankedthephoneoutofthewall.Whensheattemptedtogotoaneighborshousetousethetelephone,hegrabbedherbythehairanddraggedherdownthehallintothebabysroom.Hestruckherseveraltimesintheheadwithhisfist.Whenhereleasedhishold,shekickedhiminthegroinandrannextdoortoBobPartonsapartment.AfterMcGillcalledherfather,Partoncalled911.Whenthepolicearrived,theyarrestedthedefendantwhosteadfastlydeniedhehaddoneanythingwrong.BothPartonandthearrestingofficertestifiedtotheknotsandbruisestheyobservedonthevictimsscalp. ThedefendantwastriedandconvictedofaggravatedassaultunderTennesseeCodeAnnotatedSection3913102(a)(3)whichprovidesthatapersoncommitsaggravatedassault,who,afterbeingenjoinedbyalawfulcourtorderfromcausingorattemptingtocausebodilyinjuryorotherwisecommittinganassaultagainstanindividual,does,infact,attemptorcommitanassaultagainsttheprotectedindividual.Inthiscase,acourtofcompetentjurisdictionenteredanexparteorderonOctober25,1994,specificallyrestrainingthedefendantfrom"abusing,threateningtoabuse,orcommittingactsofviolenceuponthevictim." However,neitherpartyappearedatthescheduledhearing.OurCodeprovidesthatanexparteorderofprotectionremainsineffectonlyuntilahearingisheld.Thehearingmustoccurwithintendaysoftheissuanceoftheorder.Tenn.CodeAnn.363605(b).ThestateconcedesthatnosuchorderexistedatthetimeoftheassaultforthepurposeofenhancingtheoffensetoaggravatedassaultunderSection3913102(a)(3).Thisconcessiondissolvesanysupportforanaggravatedassaultconvictionunderthissection. (   ׀SeeStatev.AllanOlsen,No.02C019408CR00185(Tenn.Crim.App.,Jackson,Feb.15,1995).Basedontheproofintherecord,wereducetheaggravatedassaultconvictiontosimpleassault.̀ DefendantalsocontendsthatthevictimstestimonyabouthispriorbadactsandotherunchargedconductwasinadmissibleunderRule404(b)oftheTennesseeRulesofEvidence.Aftercarefullyreviewingtherecord,weconcludethatanyevidencethatmayhavebeenerroneouslyadmittedwasharmless.Tenn.R.App.P.36(b). Thevictimtestifiedtothedefendantsattackuponher,andthejuryaccreditedhertestimony.Bothhernextdoorneighbor,andthepoliceofficerwhorespondedtothecallobservedtheinjuriesshereceivedasresultoftheattack.Anytestimonyregardingpriorbadactsdidnotaffecttheverdictinthiscase. Thedefendantsconvictionisreducedtosimpleassault,aClassAmisdemeanor.BecauseaggravatedassaultisaClassCfelony%  ,wemustalsomodifythesentence.Atthesentencinghearing,thetrialjudgefoundthatseveralenhancementfactorswereapplicable.Therecordsupportstheuseofthefollowingfactorstoenhancethemisdemeanorconviction:(1)thedefendanthasahistoryofpreviouscriminalbehaviorwhichincludedseveralassaultsuponhiswife,and(5)thedefendanttreatedthevictimwithexceptionalcrueltyduringthecommissionoftheoffense.SeeTenn.CodeAnn.4035114(1),(5).Thetrialjudgedeclinedtofindthatthedefendanthadactedunderextremeprovocation.Althoughthetrialjudgeacknowledgedthatthedefendantsyouthfulnesswasamitigatingfactor,hedidnotaccordthisfactormuchweight.Basedonthetrialcourtsfactualfindings,wereducethesentencetoeleven(11)monthsandtwentynine(29)days.
