TheappellantarguesthatthecurrentPostConvictionProcedureAct,whichbecameeffectivein1995,provideshimwithoneyearfromtheeffectivedateofthenewactinwhichtofilehispetitionforrelief.TheappellantcitesCarterv.State,No.03C019509CC00270(Tenn.Crim.App.atKnoxville,July11,1996)insupportofhisargument.Thestatemaintains,however,thattheappellantsrighttofilepostconvictionrelieffromhis1977convictionsexpiredinJuly1989underthepreviousPostConvictionAct. WebelievethatthelegislativeintentofthenewPostConvictionProcedureActwastodecreasetheburdenofpostconvictionpetitionsasnotedinthedissentinCarter.Therefore,werespectfullydisagreewiththedecisioninCarter.Thelegislaturedidnotintendtoawardeveryprisoneraoneyearperiodinwhichtofileapostconvictionpetitionregardlessoftheamountoftimethathadpassedsincehisorherconviction.Inthiscase,theappellantspetitionsforpostconvictionreliefaretimebarred.
