OnDecember10,1994,KingsportpoliceofficersexecutedasearchwarrantatanapartmentinasubsidizedhousingcomplexinKingsport. '   ׀Theapartmenthadbeenthecenterofdrugtransactionspriortotheexecutionofthesearchwarrant.Whentheofficersenteredtheapartment,theappellantcamefacetofacewithoneoftheofficers.Theappellantwastackledandtakentothefloorbytheofficer.Asearchoftheappellant'spersonrevealed.2gramsofcocaineandfiveorsixplasticbaggiesusedtopackageillicitdrugsforresale. Theappellantwastwentyyearsofage.Helefthighschoolaftercompletingthetenthgrade.Hestatedheleftschoolbecausehehad"problems"withtheteachersandtheprincipal.Theappellantbeganingestingmarijuanawhenhewaseighteenyearsofage.Helacedthemarijuanawithcocaineonceortwiceaweek.Headmittedhewasadruguser. Therecordestablishestheappellanthasbeenconvictedoftwocountsofcriminaltrespass,theftunder$500,andtwocountsofdrivingwithoutalicense.Ofcourse,eachpossessionofmarijuanaandcocaineinthepastconstitutedaseparateanddistinctcrime.Theappellantwasgrantedthelargesseofprobationfortwooftheoffenseshecommitted.Infact,hewasonprobationwhenhecommittedthecrimesinquestion. Theappellanthasapriorprobationviolation,andhewasviolatingthetermsofprobationwhenhewasarrestedonDecember10,1994.Hewasusingillicitdrugs,andhehadfailedtopaythefine,courtcosts,andrestitution,whichweremadeconditionsofhisprobation. Baseduponadenovoreviewoftherecord,theappellanthasfailedtoovercomethepresumptionofcorrectnessaffordedthedeterminationsmadebythetrialcourt.Tenn.CodeAnn.4035401(d).Moreover,therecordclearlyestablishesthepresumptionoffitnessforalternativesentencinggrantedbyTenn.CodeAnn.4035102wassuccessfullyrebutted.Inotherwords,thetrialcourtdidnotabuseitsdiscretionbyrefusingtogranttheappellantanalternativesentence.Therecordsupportsthedeterminationofthetrialcourt.Inaddition,theappellanthasbeenaffordedanalternativesentenceinthepast,andhefailedtoabidebythetermsofthislargesse.Thereisnoindicationthegrantofprobationwouldhaveassistedtheappellantinrehabilitatinghisadmittedcriminallifestyle.      ________________________________________      JOEB.JONES,PRESIDINGJUDGECONCUR:_____________________________________ PAULG.SUMMERS,JUDGE_____________________________________ DAVIDG.HAYES,JUDGE
