In1975theDefendantwasconvictedintheMonroeCountyCriminalCourtofmurderinthefirstdegreeandhispunishmentwasfixedatdeathbyelectrocution.Afterthedeathpenaltystatuteunderwhichhewassentencedtodiewasheldtobeunconstitutional,GovernorRayBlantoncommutedtheDefendantsdeathsentencetolifeimprisonmentonFebruary8,1977.Ondirectappeal,thiscourtaffirmedtheDefendantsfirstdegreemurderconvictionandhislifesentence,inanopinionfiledonMay24,1977.Inthatopinion,thiscourtobservedthat, theevidenceinthiscaseisclearandconvincingtoshowtheDefendantsguilt. 2   כ TheDefendantsfirstpostconvictionpetitionwasdismissedbythetrialcourtafterconductinganevidentiaryhearing.InanopinionfiledonNovember19,1985,thiscourtaffirmedthedismissalofthepreviouspostconvictionpetitionstating, themattersbeforeusprobablyhavetheleastmeritofthemanymeritlesspostconvictionproceedingswehaveseen. 3   כ OnApril5,1995,sometwentyyearsafterhisconviction,theDefendantfiledthispetitionforpostconvictionrelief.Thetrialcourtdismissedthepetitionwithoutappointingcounselandwithoutconductinganevidentiaryhearing.Itisfromtheorderdismissingthispetitionthatthepetitionerappeals. ThepetitionallegesgenerallythattheDefendantisbeingunconstitutionallydetainedandrestrainedpursuanttoanillegalandvoidsentence,thatthetrialcourtcommittederrorininstructingthejuryinvariousregards,thatthetrialcourtdidnothavejurisdictionovertheoffense,thattrialcounselwasineffectivebynotdetectingthetrialjudgesallegederrors,andthattheDefendantspriorpostconvictioncounselwasincompetent. Weseenoreasontoanalyzethevariousissuesraisedinthepetition.Thispetitionisclearlytimebarredbythestatuteoflimitationsapplicabletoitwhichreads:8 Apetitionerincustodyundersentenceofacourtofthisstatemustpetitionforpostconvictionreliefunderthischapterwithinthree(3)yearsofthedateofthefinalactionofthehigheststateappellatecourttowhichanappealistakenorconsiderationofsuchpetitionshallbebarred. 4   ׀ The1986amendmentcreatingthethreeyearstatuteoflimitationswaseffectiveJuly1,1986.Thiscourtruledthatthestatuteoflimitationscommencedontheeffectivedateoftheamendment,July1,1986,astothosepotentialsuitsyetunfiled.Statev.Masucci,754S.W.2d90,91(Tenn.Crim.App.),perm.toappealdenied,id.(Tenn.1988).Thus,apersonwhosejudgmentbecamefinalpriortotheeffectivedateoftheamendmenthadthreeyearsuntilJuly1,1989,tofileapetitionforpostconvictionrelief.Thispetitionwasfiledmorethanfiveyearsafterthestatuteoflimitationshadrun.     ̜ Thejudgmentofthetrialcourtdismissingthispetitionforpostconvictionreliefisaffirmed.     ____________________________________     DAVIDH.WELLES,JUDGECONCUR:___________________________________GARYR.WADE,JUDGE___________________________________WILLIAMM.BARKER,JUDGE
