TheDefendantwasindictedforonecountofvehicularhomicideasaresultofintoxication 1   ׀andtwocountsofvehicularassault. 2   ׀Pursuanttoapleaagreement,sheenteredpleasofnolocontenderetoonecountofvehicularhomicideandonecountofvehicularassaultinexchangefortheStatesrecommendationthatshebesentencedasaRangeIstandardoffendertoatermoffouryearsforthevehicularhomicideandaconcurrenttermoftwoyearsforthevehicularassault.Themannerofserviceofthesentencewaslefttothediscretionofthetrialcourt,althoughthepleaagreementspecificallyincludedtheunderstandingthattheStatewouldopposeprobation.Thetrialcourtacceptedandapprovedthepleaagreementand,afterconductingasentencinghearing,orderedtheDefendantssentencetobeservedincommunitycorrections.ItisfromthisϜjudgmentofthetrialcourtthattheStateappeals. WhentheStatechallengesthelength,range,orthemannerofserviceofasentence,thiscourthasadutytoconductadenovoreviewofthesentencewithapresumptionthedeterminationsmadebythetrialcourtarecorrect.Tenn.CodeAnn.4035402(d).Thispresumptionis"conditionedupontheaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances."Statev.Ashby,823S.W.2d166,169(Tenn.1991). Inconductingadenovoreviewofasentence,thiscourtmustconsider:(a)theevidence,ifany,receivedatthetrialandthesentencinghearing;(b)thepresentencereport;(c)theprinciplesofsentencingandargumentsastosentencingalternatives;(d)thenatureandcharacteristicsofthecriminalconductinvolved;(e)anystatutorymitigatingorenhancementfactors;(f)anystatementthatthedefendantmadeonhisownbehalf;and(g)thepotentialorlackofpotentialforrehabilitationortreatment.Tenn.CodeAnn.4035102,103,and210;seeStatev.Smith,735S.W.2d859,863(Tenn.Crim.App.1987).  OnMay17,1994,theDefendantwasdrivinganautomobilewhichranofftheroadandstruckatree.Onepassengerwaskilledandatleasttwopassengerswereseriouslyinjured.TheDefendant,whowasalsoseriouslyinjuredintheaccident,hadabloodalcohollevelof.18percent.ThevictimwhowaskilledwastheDefendantsformerstepfather.TheDefendantshusbandandherminorchildwereseriouslyinjured. Atthetimeofsentencing,theDefendantwasthirtytwoyearsold,marriedandhadtwominorchildren.Herformaleducationendedwiththeseventhgradeandheremploymenthistorywassporadic.Thepresentencereportreflectsapproximatelyfivepreviousconvictionsforpublicintoxication,threeconvictionsfordisorderlyconduct,threeconvictionsforDUI,onedrivingonarevokedlicenseandoneregistrationviolation. Atthesentencinghearing,theDefendantadmittedthatshehadhadaproblemwithalcohol,whichisobviousfromherrecord.Sheapparentlycompletedathirtydayinpatientrehabilitationprogramin1992,butadmittedthatshecontinuedtodrinkthereafter.Shetestifiedthatshenolongerdrinks,althoughsheadmittedtoconsumingalcoholicbeveragesafewtimessincetheaccidentwhichprecipitatedthechargesinthecasesubjudice.Shetestifiedthatshebelievessheneedsfurthertreatmentforheralcoholism.AlthoughtheDefendanttestifiedthatshehadattendedsomeAlcoholicsAnonymousmeetings,shewasunabletoϜconveytothejudgemuchinformationabouttheAAprogramoftreatment. AlthoughthisissuewasnotarguedbytheStateatthesentencinghearingoraddressedbythetrialcourt,wefirstnotethatapersonwhocommitsaviolentcrimeisnotgenerallyeligibleforsentencingpursuanttotheCommunityCorrectionsAct.Tenn.CodeAnn.4036106(a)(3);Statev.Birge,792S.W.2d723,725(Tenn.Crim.App.1990).Asthestateargues,thiscourthasheldthatvehicularhomicidedoesnotqualifyasa nonviolentfelonyoffenseandthus,apersonconvictedofvehicularhomicideisnotgenerallyeligibleforsentencingundertheCommunityCorrectionsAct.Statev.RobertGlenGrissom,III,No.02C019204CC00076,HendersonCounty,slipop.at6(Tenn.Crim.App.,Jackson,Mar.10,1993).Thiscourthascometothesameconclusionregardingtheoffenseofvehicularassault.Statev.VickieC.Evans,No.03C019112CR00411,JeffersonCounty,slipop.at2,(Tenn.Crim.App.Knoxville,Apr.22,1992). Eventhoughadefendantmayhavebeenconvictedofa violentoffense,thatpersonmaybeeligibleforacommunitycorrectionsentenceifheorsheisone whowouldbeusuallyconsideredunfitforprobationduetohistoriesofchronicalcohol,drugabuse,ormentalhealthproblems,butwhosespecialneedsaretreatableandcouldbeservedbestinthecommunityratherinacorrectionalinstitution.Tenn.CodeAnn.4036106(c). 3   כBecausethetrialjudgemadenofindingsontherecordconcerninghisdeterminationinthisregard,wecannotϜdetermineifthecourtfoundhertobeeligiblebecauseofherhistoryofchronicalcoholabuseandthatherspecialneedscouldbebesttreatedandservedinthecommunityratherthaninacorrectionalinstitution. ThetrialcourtclearlyfoundtheDefendantwasnotasuitablecandidateforprobationwhenhestatedtohercounsel youcanforgetordinaryprobation.ThetrialjudgenotedthatattemptsatrehabilitationhadfailedtheDefendantinthepastandstated Imnotgoingtoorderanybodyintoarehabilitationprogram...ifshedidntpickthatupthefirsttime,Ihavegravedoubtsthatsheisgoingtopickitupnowandshewillprobablybebackuphere.Ifsheis,sheisgoingtothepenitentiary.Shehasnotmadethefirstefforttogettothesourceofherrealproblem,whichisalcoholism.Untilshedoesnobodyelsecandoanythingatallforher.AfterorderingthattheDefendantssentencewouldbeservedinthecommunitycorrectionsprogram,thetrialjudgestated thatsprobablyamistake,General.Ihavemadethembefore. TheDefendantiseligibleforacommunitycorrectionssentenceonlyifher specialneedsaretreatableandcouldbeservedbestinthecommunityratherthaninacorrectionalinstitution.Tenn.CodeAnn.4036106(c).ThetrialjudgeappearstohavedeterminedthathedidnotbelievetheDefendantwassusceptibletotreatmentforheralcoholabuse.Thisfindingisinconsistentwithhisdecisiontoplaceherincommunitycorrections.Simplystated,ifthisDefendants specialneedsarenot treatablethensheisnoteligibleforcommunitycorrections. TheCriminalSentencingReformActof1989providesthattherecordofthesentencinghearingmustincludespecificfindingsoffactuponwhichapplicationofthesentencingprinciplesisbased.Tenn.CodeAnn.4035209(c).Thepurposesofthesentencinglawsandcertainsentencingconsiderationsaresetforthinstatute.Tenn.CodeAnn.4035102,103.Thepurposesandgoalsofthecommunitycorrectionsprogramarealsosetforthinstatute.Tenn.CodeAnn.4036103,104.
