Wefindnoerrorandaffirmthetrialcourt'sjudgment.  Thepetitionerwasindictedformurderduringtheattemptedperpetrationofrobberyandfirstdegreemurder.OnDecember13,1993,hepledguiltytoseconddegreemurder.Underapleaagreement,hewassentencedtofiftyyearsasaRangeIIIoffender.Almostayearlater,thepetitionerfiledthispetitionforpostconvictionrelief,allegingthathewasdeniedtheeffectiveassistanceofcounselandthathispleawasneitherknowinglynorvoluntarilymade.Followinganevidentiaryhearing,thetrialcourtdeniedrelief,issuingdetailedfindingsoffactandconclusionsoflaw.  Thepetitionerclaimsthathehadappearedonthedateofhispleaundertheimpressionthatthecourtwouldconsiderpretrialmotionsonly.Infact,thetrialwasscheduledtobegin.Thepetitionerinformedthetrialjudgethathewantedtochangeattorneys.Thetrialjudge,inresponsetotherequest,revokedbail.Thepetitionerassertsthatthesefactorsundulyinfluencedhimtochangehismindanddecidetoentertheguiltyplea.̜@ I  Inordertobegrantedreliefonthegroundsofineffectiveassistanceofcounsel,thepetitionermustestablishthattheadvicegivenortheservicesrenderedwerenotwithintherangeofcompetencedemandedofattorneysincriminalcasesandthat,butforhiscounsel'sdeficientperformance,theresultofhistrialwouldhavebeendifferent.Stricklandv.Washington,466U.S.668,693(1984);Baxterv.Rose,523S.W.2d930,936(Tenn.1975). H Thistwopartstandard,asitappliestoguiltypleas,ismetwhenthepetitionerestablishesthat,butforhiscounsel'serrors,hewouldnothavepledguiltyandwouldhaveinsistedongoingtotrial.Hillv.Lockhart,474U.S.52,53(1985).  Atthepostconvictionhearing,thepetitionertestifiedthathistrialcounselwasineffectiveforseveralreasons.First,heassertsshegenerallyfailedtoprepareanytypeofdefenseforhim,claimingthatthreedaysbeforethescheduledtrialdate,hisattorneytoldhimhewould"havetogetanotherlawyer[ifhewenttotrial]...[b]ecauseshe%  didn'thaveadefensefor[him]."Next,petitionerassertshistrialcounselwasineffectiveforfailingtoinvestigatehisalibidefense.Hetestifiedthathisattorneyfailedtopursuethisdefenseeventhoughthepetitionerhadinformedherthathewaswithhiswifeatthetimeofthemurder.Finally,petitionerassertsthathiscounselfailedtofileamotiontosuppressanincriminatingstatementhehadgiventopolice.Thepetitionertestifiedthathehadtoldhis H ќattorneythatthepolicehadthreatenedhimandthatoneoftheofficershadassaultedhiminordertoobtainthestatement.  Thepetitioner'strialcounseltestifiedthatshewouldhavereceivedacontinuanceofthetrialhadthepetitionerrejectedthepleaofferbythestate.Sherelatedthatthepetitionerhadnotbeencooperativewithherinpreparingfortrialand"hadnotgiven[her]anyinformationthatwouldbeusefultohisdefense."Shealsostatedthatshehaddiscussionswiththepetitioneraboutthestatesofferwellinadvanceofthetrialdate.Sheclaimedthatthepetitioneragreedtoaccepttheofferthreedaysbeforehisplea.Trialcounselalsotestifiedthatsheinvestigatedthealibidefensebutdetermineditwasnotviablebecausethepetitioner'swifegaveinconsistentstatements.Sheclaimedthatthepetitionerwouldnotgiveheranyreliableinformationastothewhereaboutsofpossiblealibiwitnesses.Counselclaimedthatshewouldhavesoughtahearingonamotiontosuppresshadthepetitionersoughtone.Shetestifiedthatthefirsttimeshehadheardthepetitionersayanyonehadstruckhimorthreatenedhiminanefforttoextractastatementwasatthepostconvictionhearing.  Thetrialcourtfoundnomerittoanyoftheclaims.Theburden,ofcourse,isonthepetitionertoshowthattheevidencepreponderatesagainstthefindingsofthetrialjudge.Clennyv.State,576S.W.2d12,14(Tenn.Crim.App.1978).Otherwise,findingsoffactmadebythetrialcourtarebindingonthiscourt.Gravesv.State,512S.W.2d603,604(Tenn.Crim.App.1973).Here,thetrialcourtaccreditedthetestimonyoftrialcounselandconcludedthatthepetitionerhadfailedtodemonstratethathewouldnothaveenteredhisguiltypleawereitnotforthedeficientperformanceofhiscounsel.Hillv.Lockhart,474U.S.at53.Weagree.Inshort,theevidencedoesnotpreponderateagainstthefindingsofthetrialcourt.  II    Thepetitioneralsoclaimsthathisguiltypleawasneitherknowingnorvoluntary.Hearguesthathiscounselsineffectiveness,combinedwithvariousoccurrencesonthedayofhisguiltyplea,lefthimwithnochoiceotherthantopleadguilty.Hespecificallypointsoutthathewasscheduledfortrialonthedateofhiscourtappearance.Thepetitionerclaimsthattherevocationofbail,whenheaskedforpermissiontohirenewcounsel,andtrialcounselsadvicethathehadnodefenseundulyinfluencedhimtoenterintothepleaagreement.  Theoverridingdeterminationonthevalidityofaguiltyplearestsuponwhetheritwasknowinglyandvoluntarilyentered.Statev.Neal,810S.W.2d131,139140(Tenn.1991).Iftheproofestablishesthatthepetitionerwasawareofhisconstitutionalrights,heisentitledtonorelief.Johnsonv.State,834S.W.2d922,926(Tenn.1992)."[A]pleaisnot'voluntary'ifitistheproductof'[i]gnorance,incomprehension,coercion,terror,inducements,[or]subtleorblatantthreats...."Blankenshipv.State,858S.W.2d897,904(Tenn.1993)(quotingBoykinv.Alabama,395U.S.238,24243(1969)).Revocationofbailbecausethepetitionersoughtnewcounseloradelayintrialwouldnotnecessarilyrenderapleainvoluntary.Courtsmustconsiderallofthesurroundingcircumstances.Here,thepetitionertestifiedatthesubmissionhearingthathispleawasknowingandvoluntary.Thetrialcourtsofound.Therecordestablishesthatthepetitionersoughttheadviceofhiswifeandmotherbeforeenteringhisplea.Theproofintherecordsimplydoesnotpreponderateagainstthefindingofthetrialcourt.
