Thedefendantnowattemptstoattackhisconvictionthroughacertifiedquestionoflaw.AspointedoutbytheStateinitsbrief,however,thedefendanthasnotproperlyreservedthismatterforappeal.  Tenn.R.Crim.P.37(b)(2)(i)provides:      Anappealliesfromanyorderorjudgmentinacriminalproceedingwherethelawprovidesforsuchappeal,andfromanyjudgmentofconviction: L   Uponapleaofguiltyornolocontendereif:   ` DefendantenteredintoapleaagreementunderRule11(e)butexplicitlyreservedwiththeconsentofthestateandofthecourttherighttoappealacertifiedquestionoflawthatisdispositiveofthecase[.] D   OurSupremeCourtsetforththerequirementsforproperlyreservingacertifiedquestionoflawasfollows:    Regardlessofwhathasappearedinpriorpetitions,orders,colloquyinopencourtorotherwise,thefinalorderorjudgmentfromwhichthetimebeginstoruntopursueaT.R.A.P.3appealmustcontainastatementofthedispositivecertifiedquestionoflawreservedbydefendantforappellatereviewandthequestionoflawmustbestatedsoastoclearlyidentifythescopeandthelimitsofthelegalissuereserved....Withoutanexplicitstatementofthecertifiedquestion,neitherthedefendant,theStatenorthetrialjudgecanmakeameaningfuldeterminationofwhethertheissuesoughttobereviewedisdispositiveofthecase....Noissuebeyondthescopeofthecertifiedquestionwillbeconsidered. Inthiscasethedefendantfirstattemptedtoreserveacertifiedquestionoflawinhispetitiontoenterhispleatothischarge.Thispetitionincludesthestatement, Defendanttoappeal,withtheconsentoftheStateandoftheCourtacertifiedquestionoflawthatisdispositiveofthecaseunderTNRuleofCriminalϜProcedure37(B)(2)(I)[sic],𛀜andwassignedbythedefendant,hislawyerandtheAssistantDistrictAttorneyGeneralwhorepresentedtheStateinthismatter.Thetrialcourtsorderacceptingthepleamakesnoreferencewhatsoevertothereservationofacertifiedquestionoflaw.   Thetrialcourtsverdict,however,doesincludethestatement, Thereupon,thedefendanttoappealcertifiedquestionoflawpursuanttoT.C.A.Ϝ37(B)(2)(1)[sic].Also,thejudgmententeredonthedefendantsconvictionstatesasaspecialcondition, DefendanttoappealcertifiedquestionoflawpursuanttoTenn.R.Crim.P.37(b)(2)(i).    Nowhereinanyofthesedocumentsisanystatementprovidedastowhatactuallyconstitutesthecertifiedquestionoflaw.Again, thequestionoflawmustbestatedsoastoclearlyidentifythescopeandthelimitsofthelegalissuereserved.Preston,759S.W.2dat650.Theonlyallusionwhatsoevertothesubstanceofthequestionsoughttobereservedappearsinthecaptionofthetrialcourtsverdict,whichincludesthereference FailingtoobtainlocaladdressofϜpawn[o]r(certifiedquestionoflawastomotiontodismiss).Thisissimplynotsufficient.%    WerecognizethatourSupremeCourtappearstohaverelaxedthePrestonrequirementssomewhatbyitsrecentorderinStatev.SarahHuttonDowney,No.03C019307CR00221,HamiltonCounty(filedJuly6,1994).Inthatcase,apanelofthisCourtdismissedanattemptedappealonacertifiedquestionoflaw,finding Inthiscasethefinalordersimplyincorporatedbyreferencevariousissuestheappellantraisedinseveralmotionsbeforethetrialcourt.OurSupremeCourtremandedthecasetothisCourt forconsiderationofthecertifiedissue,andsetforthwhatithaddeterminedthecertifiedissuetobe.  Inthiscase,however,wehavenosuchincorporation.Evenifthereferencetothedefendantsmotiontodismissinthecaptionoftheverdictwassufficienttoincorporatetheissuesraisedinthatmotion,whichwefinditwasnot,theissuessetforthinthemotiondonotallowustoproperlyidentifythe scopeandthelimitsofthelegalissuereserved.Thedefendantsmotiontodismissraisedfourissuesaboutthestatuteinquestion:thelegislaturesintent;whetheritresultsinanunconstitutionalrestraintoftrade;thevariancebetweenitandthelocalordinances;anditsambiguity.Inhisbriefinsupportofhisappeal,however,thedefendantraisesdifferentissues:hisstandingtochallengetheconstitutionalityofthestatute;whetherhisdueprocessrightswereviolatedbyenforcementofthestatutebecauseitisvoidforvagueness;andwhetherthisCourtshouldadoptthedoctrineofinparimateriainconstruingthestatute.Thus,thedefendantsmotionraisesmultipleissueswithnoindicationofwhichone(s)hedesiresthisCourttoaddress,andhisbriefonappealraisesstillmoreissues.Wesimplycannotmakeadeterminationfromthismorassastowhatthethedefendantsoughttoreserveasthecertifiedquestion.
