Thepetitionerwasoriginallyindictedononecounteachoftheft,burglaryandevadingarrest,andtwocountsofattemptedfirstdegreemurder.Thepetitionersubsequentlypledguiltytotwocountsofaggravatedassault,forwhichhereceivedconsecutivetenyearsentences.Therecordalsoreflectsthatthepetitionerwassentencedtofouryearsforonecountofburglary,tobeservedconcurrentlywiththeaggravatedassaultcounts.Inthepresentappeal,thepetitionerraisesthreeissues:1)theindictmentchargingattemptedmurderisdefective;2)hisguiltypleawasinvoluntarilyentered;and3)thetrialjudgeimproperlyimposedconsecutivesentences.  Thetrialjudgedismissedthepetitionerspetitionstatingthat [t]hejudgmentisnotvoidonitsface,norhasthesentenceexpired.Allegationsconcerningthesufficiencyofanindictmentarenotsubjecttohabeascorpusrelief.Itiswellestablishedthatchallengestothesufficiencyofanindictmentcannotbetestedinahabeascorpusproceeding.SeeHaggardv.State,475S.W.2d186,187(Tenn.Crim.App.1971);Brownv.State,445S.W.2d669,674(Tenn.Crim.App.1969).ApanelofthisCourtrecentlyheldthesameinacapitalcase.Barberv.State,No.01C019408CR00281(Tenn.Crim.App.,Feb.23,1995).  Nonetheless,thepetitionersclaiminthisrespectmustfail.Thepetitionerallegesthattheindictmentchargedtheoffenseofattemptedfelonymurder,whichisnolongerrecognizedasacrimeinTennessee,seeStatev.Kimbrough,924S.W.2d888(Tenn.1996),andisthereforevoidonitsface.Theindictmentintherecordbeforeuschargedthatthepetitioner didunlawfullycommitcriminalattempttocommitfirstdegreemurder...inthatsaiddefendantsdidunlawfully,premeditatedly,intentionally,anddeliberatelyattempttokill[thevictim]byfiringafirearmathisperson.Contrarytothepetitionersassumption,thislanguagechargesthepetitionerwithattemptedfirstdegreemurder.Itdoesnotspecificallyrefertoattemptedfelonymurder.Theindictmentinthiscaseisvalid.  Thepetitioneralsocontendsthathisguiltypleawasnotvoluntary.Inresponse,thestatecontendsthatthisissueisnotproperlybeforetheCourtbecausethepetitionerraisesitforthefirsttimeonappeal.Moreover,thestateassertsthatthisisnotaproperissueforhabeascorpusrelief.Weagreewiththestate.Sincethepetitionerfailedtoraisetheissuebelow,thisCourtisprecludedfromconsideringitonappeal.SeeT.R.A.P.36(a).Nonetheless,thisissueisnotsubjecttohabeascorpusrelief,butmustberaisedunderthePostConvictionProcedureAct.SeeT.C.A.4030201et.al.Asthestatenotes,however,thestatuteoflimitationshasalreadyexpiredinthepetitionerscase.  Finally,thepetitionerclaimsthathisaggravatedassaultsentencesshouldhavebeenorderedtorunconcurrently.ItappearsthepetitionerisessentiallyaskingthisCourttoreviewthesentenceimposed.Thepetitionerpledguiltytotwocountsofaggravatedassault.Ordinarily,anappealdoesnotliefromaguiltyplea,andthepetitionerfailedtotaketheappropriatestepsforperfectingoneinthiscase.SeeT.R.A.P.3(b);Tenn.R.Crim.P.37(b)(2).Accordingly,thisissueisnotproperlybeforetheCourt.̀  Havingreviewedthestatesmotioninlightofthepetitionersbriefandtheentirerecordonappeal,weconcludethatthemotioniswelltakenandshouldbegranted.Forthereasonsstatedabove,itisherebyORDERED,pursuanttoRule20,RulesoftheCourtofCriminalAppeals,thatthejudgmentofthetrialcourtdismissingthepetitionforwritofhabeascorpusisaffirmed.Costsofthisappealshallbeassessedagainstthepetitioner.
