àFor€the€reasons€set€forth€in€this€opinion,€we€modify€the€sentence€fromÏRange€II€to€Range€I.€€Otherwise,€the€judgment€is€affirmed.€€ÌÌà àà àIn€1993€and€1994€the€defendant€was€charged€with€and€found€guilty€ofÏthree€different€drug€offenses.€€Only€the€third€conviction€is€the€subject€of€this€appeal.ÏBecause€the€sentencing€for€the€offenses€is€interrelated,€the€circumstances€of€eachÏof€the€three€convictions€are€pertinent.€€ÌÌà àIn€June€of€1993,€the€defendant€was€arrested€for€possession€ofÏmarijuana€with€the€intent€to€sell€or€deliver€and€possession€of€cocaine€with€the€intentÏto€sell€or€deliver;€she€was€later€convicted€of€the€lesser€offense€of€simple€possession€€Ïand€the€Class€B€felony€of€possession€of€cocaine€with€intent€to€sell.€€The€trial€courtÏimposed€concurrent€sentences€of€eleven€months€and€twenty„nine€days€on€the€firstÏconviction€and€eight€years€on€the€second.€€Because€the€indictment€did€not€allegeÍthe€amount€of€cocaine€involved,€a€fact€which€is€necessary€to€determine€the€grade€ofÏfelony,€this€court€was€required€on€direct€appeal€to€modify€the€1994€conviction€to€aÏClass€C€felony€and€remand€for€resentencing.€€òòState€v.€Emma€Jean€Dunlap€Hilliardóó,Ï906€S.W.2d€466,€470€(Tenn.€Crim.€App.€1995);€òòseeóó€Tenn.€Code€Ann.€ðð€ðð€39„17„417(c)(1)€&€(2).€€The€record€on€the€appeal€of€the€third€offense€does€not€reflect€whatÏsentence€the€defendant€received€after€the€remand.€€ÌÌà àà àOn€October€26,€1993,€some€four€months€after€the€initial€charges,€theÏdefendant€sold€less€than€.5€grams€of€cocaine€to€an€undercover€agent.€€The€incidentÏoccurred€while€the€defendant€was€out€on€bail€on€the€prior€charges.€€After€herÏconvictions€on€the€first€two€offenses,€a€jury€convicted€the€defendant€on€the€lastÏcharge.€€The€trial€court€imposed€a€Range€II€sentence€of€six€years,€consecutive€toÏher€previous€terms€of€imprisonment.€€The€Range€II€classification€was€based€on€anÏeven€earlier,€1985€felony€conviction€and€on€the€1994€felony€conviction,€which€wasÏon€appeal€at€the€time€of€this€sentence.€€ÌÌà àà àà à€A€multiple,€Range€II€offender€is€a€defendant€who€has€received€theÏfollowing:ÌÓÓà8 àà8 àœ(1)›€€A€minimum€of€two€(2)€but€not€more€than€four€(4)€priorÏfelony€convictions€within€the€conviction€class,€a€higherÏclass,€or€within€the€next€two€(2)€lower€felony€classes,Ïwhere€applicable;€orÌÌà8 àIn€seeking€the€enhanced€classification,€the€state€relied€on€the€1985Ïfelony€conviction€and€the€1994€felony€conviction.€€Our€supreme€court,€however,€hasÏheld€that€ð ðprior€convictions€used€to€enhance€a€defendantððs€status€beyond€that€of€aÏstandard€offender€must€have€been€reduced€to€judgment€before€the€commission€ofÏthe€...ðð€more€recent€offense€for€which€sentence€is€being€imposed.€€òòState€v.€Blouvettóó,Ï904€S.W.2d€111,€111„13€(Tenn.€1995).€€The€1994€felony€conviction€had€not€beenÏreduced€to€judgment€before€the€defendant€committed€this€offense€in€October€ofÍ1993.€€Because€the€defendant€only€had€one€ð ðprior€felony€convictionðð€at€the€time€ofÏsentencing,€we€must€classify€the€defendant€as€a€Range€I€standard€offender.Ìà àà àÌà àà àWe€will€now€attempt€to€determine€the€sentence€required€by€law.€€TheÏpresumptive€sentence,€of€course,€is€the€minimum€within€the€range€if€there€are€noÏenhancement€or€mitigating€factors.€€Tenn.€Code€Ann.€ðð€40„35„210(c).€€òòButóó€òòseeóó€1995ÏTenn.€Pub.€Acts€ch.€493€(amending€the€statute€for€offenses€occurring€on€or€afterÏJuly€1,€1995,€to€make€the€presumptive€sentence€in€a€Class€A€felony€the€midpoint€inÏthe€range).€€If€there€are€enhancement€factors€but€no€mitigating€factors,€the€trial€courtÏmay€set€the€sentence€above€the€minimum.€€Tenn.€Code€Ann.€ðð€€40„35„210(d).€€AÏsentence€involving€both€enhancement€and€mitigating€factors€requires€anÏassignment€of€relative€weight€for€the€enhancement€factors€as€a€means€ofÏincreasing€the€sentence.€€Tenn.€Code€Ann.€ðð€40„35„210(e).€€The€sentence€mayÏthen€be€reduced€within€the€range€by€any€weight€assigned€to€the€mitigating€factorsÏpresent.€€òòIdóó.€ÌÌà àà àA€Range€I,€Class€C€felony€requires€a€€three„year€minimum€sentence.€ÏTenn.€Code€Ann.€ðð€40„35„112(a)(3).€€The€trial€court€applied€the€followingÏenhancement€factors:ÌÓÓà8 àà8 à(1)à àThe€defendant€has€a€previous€history€of€criminalÏconvictions€or€criminal€behavior€in€addition€to€thoseÏnecessary€to€establish€the€appropriate€range,€Tenn.ÏCode€Ann.€ðð€40„35„114(1);€andÌÌà8 àà8 à(2)à àThe€defendant€committed€the€crime€while€on€bail,ÏTenn.€Code€Ann.€ðð€40„35„114(13)(A).ÌÌÓÓWe€agree€that€these€enhancing€factors€are€applicable.€€Moreover,€the€defendantÏfiled€no€mitigating€factors€and€the€trial€court€found€none.€€Thus€the€trial€court€actedÏwithin€its€authority€in€assessing€significant€weight€to€each€factor€and€imposing€a€six„year€sentence,€consecutive€to€the€prior€term€of€imprisonment.€€Ìà àà à€ÌÓ  ÓIIÌÓ  Óà àà àThe€defendantððs€second€issue€is€whether€the€trial€court€erred€byÏdenying€some€form€of€alternative€sentencing€or€Community€Corrections.€€The€trialÏcourt€made€the€following€observations:€ÌÓÓà8 àà8 àThis€Court€has€again€considered€alternative€forms€ofÏsentencing,€as€it€is€required€to€do,€and€for€those€reasonsÏstated€in€her€prior€sentence€finds€not€only€that€theyððre€notÏinappropriate€but€that€they€are€impossible€to€be€imposedÏin€this€particular€case....€€ÌÌà@ àAmong€the€factors€applicable€to€the€defendant's€application€forÏprobation€are€the€circumstances€of€the€offense,€the€defendant's€criminal€record,Ïsocial€history,€and€present€condition,€and€the€deterrent€effect€upon€and€best€interestÏof€the€defendant€and€the€public.€€òòState€v.€Grearóó,€568€S.W.2d€285,€286€(Tenn.€1978),Ïòòcertóó.€òòdeniedóó,€439€U.S.€1077€(1979).€€ÌÌà àEspecially€mitigated€or€standard€offenders€convicted€of€Class€C,€D,€orÏE€felonies€are€presumed€to€be€favorable€candidates€"for€alternative€sentencingÏoptions€in€the€absence€of€evidence€to€the€contrary."€€Tenn.€Code€Ann.€ðð€40„35„102(6).€€With€certain€statutory€exceptions,€none€of€which€apply€here,€probation€mustÏbe€automatically€considered€by€the€trial€court€if€the€sentence€imposed€is€eight€yearsÏor€less.€€Tenn.€Code€€Ann.€ðð€40„35„303(a)€and€(b).ÌÌà àà àAlternative€sentencing€issues€must€be€determined€by€the€facts€andÏcircumstances€of€the€individual€case.€€òòState€v.€Mossóó,€727€S.W.2d€229,€235€(Tenn.Í1986).€€ð ð[E]ach€case€must€be€bottomed€upon€its€own€facts.ðð€€òòState€v.€Tayloróó,€744ÏS.W.2d€919,€922€(Tenn.€Crim.€App.€1987).à àÌÌà àà àHere,€the€defendant€has€two€daughters;€they€were€10€and€18€yearsÏold€at€the€time€the€presentencing€report€was€prepared.€€The€defendant€appears€toÏhave€a€supportive€family;€her€mother€is€caring€for€her€children€while€she€isÏincarcerated.€€The€defendant€has€a€limited€work€history.€€Otherwise,€very€littleÏappears€in€the€presentence€report€about€her€ð ðsocial€historyðð€or€ð ðpresent€condition.ðð€€ÌÌà àà àWeighing€against€the€grant€of€probation€is€the€fact€that€the€defendantÏhas€a€prior€criminal€record€since€1985,€which€includes€a€felony€drug€conviction€andÏseveral€misdemeanor€convictions€for€such€offenses€as€shoplifting,€disorderlyÏconduct,€and€petit€larceny.€€òòSeeóó€Tenn.€Code€Ann.€40„35„103(1)(A).€€Also,€weighingÏagainst€probation€is€the€fact€that€the€defendant€committed€this€crime€while€on€bailÏfor€a€similar€crime.€€The€nature€and€circumstances€of€this€case€warranted€the€denialÏof€probation.€€The€defendant€has€not€overcome€the€presumption€that€the€trial€courtððsÏdenial€of€probation€was€correct.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„401(d).€ÌÌà àà àThe€defendant€also€contends€that€she€should€have€been€sentenced€toÏCommunity€Corrections.€€The€defendant,€however,€is€not€statutorily€eligible€for€thisÍprogram.€€ð
