TheDefendantwasconvictedonajuryverdictofsellingacontrolledsubstance.Onappealtothiscourt,heraisedthreeissues:(1)WhetherhisconvictionandsentenceviolatedtheInterstateCompactonDetainers;(2)whetherthetrialcourterredbyinstructingthejuryonflight;and(3)whethertheevidencesupportedthejuryverdict.ThiscourtresolvedthoseissuesagainsttheDefendantandaffirmedhisconvictionandsentence. )   ׀TheTennesseeSupremeCourtdeniedhisapplicationforpermissiontoappealonMarch7,1994. Provingfailureoftheadversarialprocessbecauseofineffectiveassistanceofcounselrequiresthedefendanttosatisfy,byapreponderanceoftheevidence,bothprongsofatwoprongedtest.SeeButler,789S.W.2dat899.First,thedefendantmustprovethatcounsel'sperformancefailedtomeetthethresholdofcompetencedemandedofattorneysincriminalcases.Butler,789S.W.2dat899.Second,thedefendantmustproveactualprejudiceresultingfromthedeficientperformance.Cooper,849S.W.2dat747(citingStrickland,466U.S.at687). Scrutinyofcounsel'sperformanceshouldbehighlydeferential.Strickland,466U.S.at689.Thecourtshouldjudgecounselatthetimeoftheallegederrorinlightofallfactsandcircumstances.Strickland,466U.S.at690;seeCooper,849S.W.2dat746.Tosatisfythisprong,thedefendantmustshowthatcounsel'sperformancedoesnotmeettheSixthAmendmentstandardofobjectivereasonableness.Strickland,466U.S.at687;Cooper,849S.W.2dat747.Objectivereasonablenessdemandsthatcounsel'sperformancefallwithinthewiderangeofprofessionalcompetency.Strickland,466U.S.at688,690;seeCooper,849S.W.2dat746.Informedtacticaldecisionsmadebytrialcounsel,suchasadecisionnottocallthedefendanttotestify,arenottobesecondguessed.Hellardv.State,629S.W.2d4,9(Tenn.1982).  Thedefendantmustproveprejudicethatresultsinanunfairorunreliableproceeding.Lockhartv.Fretwell,113S.Ct.838,84344(1993);Strickland,466U.S.at687.Tosatisfythisprong,thedefendantmustshowareasonableprobabilitythat,butforcounsel'sunreasonableerror,thefactfinderwouldhavehadreasonabledoubtregardingdefendant'sguilt.Strickland,466U.S.at695.Thisreasonableprobabilitymustbe"sufficienttoundermineconfidenceintheoutcome."Harrisv.State,875S.W.2d662,665(Tenn.1994).
