PursuanttoTenn.R.App.P.,Rule4,anoticeofappealshallbefiledwithin30daysafterentryofthejudgmentfromwhichanappealissought.Incriminalproceedings,however,thenoticeisnotjurisdictional.Accordingly,thisCourtmayreviewuntimelyappealsanddeterminewhetherthenoticerequirementshouldbewaived.Id.;Statev.Mullins,767S.W.2d668(Tenn.Crim.App.1988).Waiverisnotautomaticandshouldonlyoccurwhen"theinterestofjustice"mandateswaiver.Toholdotherwise,bysummarilygrantingwaiverwheneverconfrontedwithuntimelynotices,rendersthe30dayrequirementalegalfictionandcircumventstherule. Appellant'sprosenoticeofappealwasfiledmorethanthreemonthslate.̀Appellantattributeshisuntimelinesstohisignoranceofthelaw.Althoughappellant'sfilingwasprose,Rule4doesnotrelieveproseappellantsfromthe30daynoticerequirement.Accordingly,appellant'sprosestatusisonlyafactorandnotdeterminativeindecidingwhether"theinterestofjustice"mandateswaiverofthe30daynoticerequirement. IndeterminingwhetherwaiverisappropriatethisCourtshallconsiderthenatureoftheissuesforreview,thereasonsforthedelayinseekingrelief,andotherrelevantfactorspresentedineachcase.Wenote,however,thatourdiscretiontowaiveisnotunbridledandmustonlybeexercisedsoastoservetheinterestofjustice.Thejudicialsystem'sintegritymustbeconsidered.
