TherecordrevealsthattheappellantwasclassifiedasaRangeI,standardoffender.Thetrialjudgefoundoneapplicableenhancementfactorandoneapplicablemitigator. ,   ׀HestatedthatTenn.CodeAnn.4035210(c),whichbecameeffectiveJuly1,1995,requiredthatthemidpointwithintherangebeappliedasthepresumptivesentencefortheappellant'soffense. .   ׀Theappellantcontendsthatthisstatutewasnotineffectatthetimehecommittedtheoffenseanditsuseagainsthimviolateshisconstitutionalprotectionagainsttheimpositionofexpostfactolaws.Weagree. TheTennesseeConstitution'sexpostfactoprohibitionfoundinArticleI,11,provides:8 8 8 8 8 Thatlawsmadeforthepunishmentofactscommittedprevioustotheexistenceofsuchlaws,andbythemonlydeclaredcriminalarecontrarytotheprinciplesofafreeGovernment;whereforenoExpostfactolawshallbemade.Thefiveclassificationsofexpostfactolaware:8 1.Lawswhichprovideforpunishmentuponapersonforanactdonewhich,whencommitted,wasinnocent;8 2.Lawswhichaggravateacrimeormakeitgreaterthanwhencommitted;8 3.Lawsthatchangepunishmentorinflictgreaterpunishmentthanthelawannexedtothecrimewhencommitted;8 4.Lawsthatchangetherulesofevidenceandreceivelessordifferenttestimonythanwasrequiredatthetimeofthecommissionoftheoffenseinordertosustainaconviction;and8 5.Lawswhich,inrelationtotheoffenseoritsconsequences,alteraperson'ssituationtotheirdisadvantage.Statev.Pearson,858S.W.2d879,882(Tenn.1993). TheappellantcommittedthisoffenseonMarch31,1995.Atthattime,theapplicablestatuteprovided:"[s]houldtherebeenhancementandmitigatingfactors,thenthecourtmuststartattheminimumsentenceintherange...."Tenn.CodeAnn.4035210(e)(1990).Thetrialjudge,however,appliedtheamendmenttothisstatute,whichdidnotbecomeeffectiveuntilJuly1,1995.Theamendmentstatesthatthepresumptivesentencefortheappellant'soffenseshallbethemidpointintherange.Thisstatutewasnotineffectwhentheappellantcommittedtheoffense;hence,itsimplementationeffectivelyraisedthepresumptivestartingpointfromfifteenyearstotwentyyears.Inapplyingthisstatutetotheappellant,thetrialcourtviolatedtheexpostfactoprohibition.
