àThe€appellant,€Theodore€F.€Howard,€appeals€as€of€right€pursuant€to€RuleÏ3€of€the€Tennessee€Rules€of€Appellate€Procedure.€€The€Appellant€wasÏconvicted€of€aggravated€burglary€in€the€Shelby€County€Criminal€Court.€€TheÏAppellant€was€sentenced€by€the€trial€court€to€serve€fifteen€(15)€years€as€aÏRange€III€Career€Offender.€€The€sole€issue€the€Appellant€raises€for€appeal€isÏwhether€the€trial€court€erred€in€failing€to€instruct€the€jury€on€the€lesser€offense€ofÏburglary.€€We€affirm€the€judgment€of€the€trial€court.ÌÌà àAt€about€10:00€a.m.€on€September€4,€1994,€a€neighbor€to€the€house€Ïlocated€at€1155€Central€Avenue€in€Memphis€heard€a€loud€banging€noise.€€TheÏneighbor€and€his€wife€went€to€their€back€door€and€observed€a€man,€who€theyÏlater€identified€as€the€Appellant,€€breaking€out€a€window€on€the€back€door€of€theÏhouse€with€a€brick.€€The€property€known€as€1155€Central€Avenue€was€then€inÏthe€possession€of€United€American€Bank€due€to€a€foreclosure€on€the€property.ÏThe€house€on€that€property€had€been€vacant€for€approximately€two€monthsÏprior€to€September€4,€1994.€€No€one€other€than€the€bankððs€agents€hadÏpermission€to€enter€or€take€any€property€from€1155€Central€Avenue.€€TheÏneighbors€saw€the€Appellant€enter€the€€house.€€€The€neighbors€notified€theÏpolice,€and€then€the€wife€and€another€neighbor€waited€at€the€front€of€the€houseÍwhile€her€husband,€armed€with€a€shotgun,€waited€at€the€back€of€the€house€forÏthe€police€to€arrive.€€ÌÌà àThe€Appellant€attempted€to€leave€the€house€with€a€ceiling€fan,€but€thenÏsaw€the€neighbor€waiting€at€the€back€of€the€house.€€The€Appellant€put€the€fanÏdown€in€the€doorway€of€the€house.€€The€neighbor€waiting€in€the€back€told€theÏAppellant€the€police€were€on€their€way€and€to€stop,€but€the€AppellantÏproceeded€to€go€around€the€side€of€the€house.€€The€neighbor€observed€whatÏappeared€to€be€a€shiny€weapon€in€the€Appellantððs€hand,€and€he€followed€theÏAppellant€to€the€front€of€the€house.€€He€told€the€Appellant€to€put€his€weaponÏdown€and€to€get€down€on€the€sidewalk.€€The€Appellant€complied€and€was€heldÏthere€by€the€neighbor€until€the€police€arrived.€€The€police€officer€who€arrived€tookÏthe€Appellant€into€custody€based€upon€the€information€of€the€witnesses.€ÏAppellant€gave€a€statement€to€the€police,€introduced€into€evidence,€in€which€heÏadmitted€breaking€into€the€house,€taking€the€fan,€and€being€caught€and€detainedÏby€the€neighbors€until€the€police€arrived.ÌÌà@ àThe€issue€Appellant€raises€for€this€Courtððs€review€is€whether€the€trial€courtÏcommitted€reversible€error€by€failing€to€charge€the€jury€with€the€instruction€for€theÍlesser€included€offense€of€burglary.€€Only€when€there€is€some€evidence€uponÏwhich€reasonable€minds€could€convict€the€defendant€of€a€particular€lesserÏoffense€is€the€court€required€to€instruct€regarding€that€offense.€€òòJohnson€v.€Stateóó,Ï531€S.W.2d€558,€559€(Tenn.€1975);€òòState€v.€Atkinsóó,€681€S.W.2d€571,€577€(Tenn.ÏCrim.€App.€1984),€òòcert.€deniedóó,€470€U.S.€1028€(1985).€€The€practice€of€soÏcharging,€when€there€is€no€evidence€to€support€any€lesser€included€offenses,€isÏnot€favored.€€òòState€v.€Mellonsóó,€557€S.W.2d€497,€499€(Tenn.€1977);€òòWhitwell€v.ÏStateóó,€520€S.W.2d€338,€343€(Tenn.€1975).€€ÌÌà àVarious€evidence€was€presented€at€trial€by€the€State€to€prove€that€theÏbuilding€was€a€habitation.€€First,€an€employee€of€the€United€American€Bank,Ïwho€worked€in€the€special€asset€department€handling€foreclosures€andÏrepossessions,€testified€that€the€house€at€1155€Central€Avenue€was€a€single„family€residence€in€a€residential€area€of€Memphis.€€This€employee€also€statedÏthat€the€property€was€not€occupied€at€the€time€of€this€burglary.€€A€secondÏwitness,€a€neighbor€living€€behind€the€property€at€1155€Central€Avenue,€testifiedÏthat€the€house€was€empty€for€approximately€two€months€prior€to€the€time€of€theÏburglary.€€Other€evidence€as€to€the€nature€of€the€house€at€1155€Central€wasÏpresented€in€the€form€of€photographs€of€the€single„family€residence.€€No€proofÏthat€the€house€was€not€designed€as€a€family€residence€was€offered€at€trial.ÌÌà àThe€Appellant€contends€that€because€the€house€at€1155€Central€AvenueÏwas€vacant€at€the€time€the€Appellant€entered€the€house,€the€trial€court€erred€inÏits€failure€to€instruct€the€jury€on€burglary.€€According€to€Tenn.€Code€Ann.€ðð€39„14„403,€a€person€commits€aggravated€burglary€when€he€or€she€commits€burglaryÏof€a€habitation€as€defined€in€Tenn.€Code€Ann.€ðð€ðð€39„14„401€and€39„14„402.€€AÏð ðhabitationðð€is€defined€as€ð ð€.€.€.€any€structure,€including€buildings,€mobile€homes,Ïtrailers€and€tents,€which€is€designed€or€adapted€for€the€overnight€accommodationÏof€persons€.€.€.ðð€€Tenn.€Code€Ann.€ðð€39„14„401(1)(A).€€ð ðA€person€commitsÏburglary€who,€without€the€effective€consent€of€the€property€owner€enters€aÏbuilding,€other€than€a€habitation€(or€any€portion€thereof)€not€open€to€the€public,Ïwith€intent€to€commit€a€felony,€theft€€or€assault€€.€.€.€.ðð€€€Tenn.€Code€Ann.€ðð€39„14„402(a)(1).ÌÌà àThe€appellant€further€argues€that€at€some€point€after€a€house€isÏunoccupied€the€house€ceases€to€be€a€habitation.€€After€the€legislature€rewroteÏthe€criminal€code€in€1989,€there€ceased€to€be€any€requirement€that€the€structureÏbe€occupied€at€the€time€of€the€burglary€in€order€for€the€structure€to€be€consideredÏa€habitation.€€€òòState€v.€James€Ford,€IIIóó,€No.€02C01„9304„CR„00078,€ShelbyÏCounty€(Tenn.€Crim.€App.,€Jackson,€filed€August€3,€1994),€òòperm.óó€òòtoóó€òòappealóóÏòòdeniedóó€(Tenn.€1995).€€In€òòFordóó,€the€defendant€was€convicted€of€aggravatedÏburglary€of€a€house€which€was€vacant.€€This€Court€held€that€the€house€thatÍwas€burglarized€was€obviously€designed€for€overnight€accommodation€andÏwas€clearly€a€ð ðhabitation.ðð€€From€all€testimony€and€other€pictorial€evidence€withinÏthe€record,€the€house€which€was€entered€by€the€Appellant€was€obviouslyÏdesigned€for€overnight€accommodation€and,€therefore,€was€within€theÏLegislatureððs€definition€of€a€ð ðhabitation.ððÌÌÓ  Óà àAs€the€evidence€is€clear€as€to€the€nature€of€the€habitation€which€theÏAppellant€admittedly€entered,€the€issue€of€the€courtððs€failure€to€give€an€instructionÏon€the€lesser€offense€of€burglary€is€without€merit.ÌÌà
