Adistrictattorney'sgrantordenialofpretrialdiversionis"presumptivelycorrect"andthedecisionshallonlybereverseduponashowingofa"patentorgrossabuseofprosecutorialdiscretion."Statev.Perry,882S.W.2d357,359(Tenn.Crim.App.1994).Tofindanabuseofdiscretion,therecordmustbedevoidof"anysubstantialevidence"supportingthedistrictattorneygeneral'sdecision.Id.;Statev.Houston,900S.W.2d712,714(Tenn.Crim.App.1995).Wemaynotsupplantthedistrictattorney'sjudgmentwiththatofourown.Id. Inassessingwhetheradefendantisentitledtopretrialdiversion,thedistrictattorneygeneralmustconsider:(1)thecircumstancesoftheoffense,(2)thedefendant'scriminalrecord,(3)thedefendant'ssocialhistory,(4)thedefendant'sphysicalandmentalcondition,(5)thedeterrenteffectofpunishmentuponothercriminalactivity,(6)thedefendant'samenabilitytocorrection,and(7)thelikelihoodthatpretrialdiversionwillservetheendsofjusticeandthebestinterestofboththepublicandthedefendant.Id.Thecircumstancesoftheoffenseandtheneedfordeterrencemay,inanappropriatecase,outweighallotherrelevantfactors.Id.at715. Weagreewiththedistrictattorney'sassessmentthattheplantingoforfabricationofevidencecallsintodoubttheintegrityoflawenforcement.Fabricatingevidencenotonlystrikesatthecoreoflawenforcementandpoliceintegrity,italsostrikesatthe"veryheart"ofthejudicialprocess.SeePerry,882S.W.2dat360(affirmingdenialofdiversionnotingthatperjurystrikesat"veryheartofjudicialsystem").Actsthreateningthevitalityofourjudicialsystemshouldneitherbecountenancednorrewardedwithremedialmeasuressuchaspretrialdiversion.We,therefore,concludethatthecircumstancesoftheoffenses,theneedtodetersimilaractsaffectingtheintegrityofboththecourtsandlawenforcement,andtheneedtoprotectthepublic'sinterestsoutweighallfactorsinfavorofpretrialdiversion.Thetrialcourt'sjudgmentinfindingthattheprosecutordidnotabusehisdiscretionisaffirmed.`  p  Q  ______________________________  Q  PAULG.SUMMERS,JudgeCONCUR:________________________________JOSEPHM.TIPTON,Judge________________________________CHARLESLEE,SpecialJudge
