Weaffirmthejudgment. OfficerMartinTayloroftheSurgoinsvillePoliceDepartmentobservedthedefendantsvehiclesittinginanintersectionatStonyPointRoadandHwy.11W.ThevehiclemadewhatOfficerTaylordescribedasanoddturn.Thispromptedhimtofollowthevehicle.TaylortestifiedheobservedthevehiclecrossoverthecenterlinethreetimesonHwy.11W.Thevehicleturnedontoanarrowroadandtheofficercontinuedtofollow.Taylorcalledinthelicensenumberofthevehicleand,aftersomedelay,wasinformedthelicensewasnotlistedorregistered.Taylorturnedonhisbluelighttostopthevehicle.Thevehiclespeededupanddrovesomel/4ofamileandpulledintoadriveway.ThedefendantemergedfromthecarandTaylordeterminedhewasintoxicated.Thedefendant,afterabriefresistance,washandcuffed.Beforethedefendantwasputinthepolicevehicletheofficerdidapatdownofhim.AbagofmarijuanaandValiumwasfoundonthedefendantsperson.Inaddition,alargeamountofmoneywasfoundinhispocket.Taylordidnotremovethecashatthattimebecausehewantedtohaveabackupofficertowitnesstheremovalandcountingofthecash. ThevehicledrivenbythedefendantwasaCamarowithaTtop.TheTtopwasopen.WhenOfficerTaylorreturnedtothevehiclehelookeddownthroughtheopenTtopandobserveddrugparaphernaliaandbagsofmarijuanabesidetheconsole.Heobservedinthebackseatadufflebagwhichwasopenandinwhichhecouldseebagsofmarijuana.ThevehiclewasseizedandtowedtothePoliceDepartmentwhereaninventorysearchwasdone.Therewasnoincriminatingevidencefoundinthetrunkofthevehicleoranyotherpartofthecar. Weseelittlereasontobecometangledinananalysisofwhetherthestopofthedefendantwasproper.Basedupontheobservationoftheofficer,whichwouldgivereasontobelievethevehiclewasbeingdrivenbyapersonwhowasintoxicated,wefindthestopwasreasonableandproper. Defendantraisestheissueofwhethertherewasavalidinventorysearchofthevehiclewhichledtotheseizureofcontraband.Weseenoneedtodelveintotheinventorysearchaspectofthecaseeither.Fromourreadingoftherecord,alloftheevidenceuponwhichtheconvictionrestswasseizedinplainviewandnotdiscoveredinaninventorysearch.ThiswasthetestimonyofOfficerTaylorandnoonedisputedthisevidence. Whenobjectsareseizedinplainview,theviewerhasarighttobewheretheyarewhentheyviewtheobjectsandthenatureoftheobjectsisincriminating,theseizurethereofislawful.SeeStatev.Layne,623S.W.2d629(Tenn.Crim.App.1981);Statev.Johnson,705S.W.2d681(Tenn.Crim.App.1985)andStatev.Horner,605S.W.2d835(Tenn.Crim.App.1980).
