Weaffirmthejudgmentofthetrialcourt.  In1983,thepetitionerwasfoundguiltyoffirstdegreemurderandsentencedtolifeinprison.ThiscourtaffirmedtheconvictioninStatev.EanosEarlHunt,No.181(Tenn.Crim.App.,atKnoxville,Mar.18,1985),appealdenied,June3,1985.OnJune29,1995,thepetitionerfiledthispetitionallegingviolationsofnewlyrecognizedconstitutionalrightsregardingcertainjuryinstructions.    Thisisthepetitioner'sfourthpetitionforpostconvictionrelief. Z   ׀Underthe1995PostConvictionAct(theactinforceatthetimethepetitionwasfiled),onceapetitionhasbeen"resolvedonthemeritsbyacourtofcompetentϜjurisdiction,anysecondorsubsequentpetitionshallbesummarilydismissed."Tenn.CodeAnn.4030202(c)(1996Supp.).ThepetitionerdoesnotmeetanyofthelimitedcircumstancesinTenn.CodeAnn.4030217(1996Supp.)whichwouldentitlehimtoreopenhispastpostconvictionproceeding;therefore,weholdthatthetrialcourtproperlydismissedthepetition.[  Wealsopointoutthatthepetitionerclaimshisissueshaveneverbeenbroughtbeforeacourt.Thisisuntrue.Hisclaims,basedupontheholdingsinStatev.Brown,836S.W.2d530(Tenn.1992),Sandstromv.Montana,442U.S.510(1979),andSullivanv.Louisiana,113S.Ct.2079(1993),alreadyhavebeenconsideredandrejectedbythiscourt.SeeHunt,Feb.3,1994,slipop.at4,5.  Thepetitionermakesallegationsofimproperjuryinstructionsregardingthedefinitionof"malice"and"deliberate"andthedefinitionofreasonabledoubt.Hearguesthattherewereerroneousinstructionsonthedifferencebetweenevidenceandargumentandjurorsas"theexclusivejudgesofthelaw.""Agroundforreliefiswaivedifthepetitionerpersonallyorthroughanattorneyfailedtopresentitfordeterminationinaproceedingbeforeacourtofcompetentjurisdictioninwhichthegroundcouldhavebeenpresented...."Tenn.CodeAnn.4030206(g)(1996Supp.)."[W]aiveristobedeterminedbyanobjectivestandardunderwhichapetitionerisboundbytheactionorinactionofhisattorney."Housev.State,911S.W.2d705,714(Tenn.1995)."[T]herebuttablepresumptionofwaiverisnotovercomebyanallegationthatthepetitionerdidnotpersonallyandtherefore,'knowinglyandunderstandingly,'waiveagroundforrelief."Id.Thus,thedoctrineofwaiveralsobarsrelief.
