Thedefendant,GaryWayneHall,appealsfromtheconvictionofaggravatedchildabusehereceivedattheconclusionofajurytrialintheSullivanCountyCriminalCourt.Thedefendantispresentlyservinga24yearincarcerativesentenceintheDepartmentofCorrection.Inthisappeal,thedefendantclaimsthattheevidenceattrialinsufficientlysupportsthejury'sfindingofhisguiltbeyondareasonabledoubtandthatthesentenceimposedisexcessive.Followingareviewoftherecord,thebriefsoftheparties,andtheapplicablelaw,weaffirmthejudgmentofthetrialcourt. The25yearolddefendantand23yearoldLauraMcGheesharedaplatonicfriendshipinlate1996andearly1997.InNovember1996,McGheedeliveredthevictim,JohnDanielHunley.AfterHunley'sbirth,thedefendantbeganhelpingMcGheewithchildcare.Atfirst,thedefendantassistedinMcGhee'spresence,andeventually,byJanuary1997,McGheewouldleavethevictiminthedefendant'scareforseveralhoursthreetofourtimesaweekwhileshewenttowork. `  InlateJanuary,thevictimbecameveryill.Afterbelievingthevictimhadaviralinfection,andlaterepilepsy,medicalpersonneleventuallydiagnosedthevictim'sconditionasresultingfrom"nonaccidentaltrauma"orchildabuse.Thedefendantwasinterviewedbylawenforcementpersonnelseveraltimesandadmittedshaking,hitting,dropping,andtossingthevictim.Ineachstatementthedefendantgave,heprovidedmoreinformationaboutthenatureandseverityoftheabuseinflictedonthevictim.Thedefendantmaintained,however,thathehadnotmeanttohurtthevictimandwashavingahardtimecomingtotermswithwhathemighthavedonetothevictim. Attrial,thestatepresentedevidencethatthevictim,whohadbeenbornwithoutanyknownphysicalormentalimpairments,nowsuffersdevelopmentaldelaysandmayneverwalk,talkorliveindependently.Medicalpersonnelopinedthattheabusesufferedbythevictimisthecauseoftheseimpairments. Thedefensecenteredonproof,viathedefendant'stestimony,thatthedefendantcaredaboutthevictimasifhewerehisownchildandwouldneverknowinglyharmhim.Thedefendantadmitted,inhistestimonyandinhispretrialstatements,thathehadvigorouslyshakenthevictim,slappedthevictimonthehead,droppedthevictimseveralinchesintohiscarseatwhichcausedthevictimtohithisheadonthefloororthecarseat,andtossedthevictimintohiscribfromthedefendant'schestheight.Thedefendantmaintained,however,thathehadnotmeanttohurtthevictimandtookalloftheseactionsotherthandroppingthevictimintothecarseatineffortstoassuagethevictim'scolic.Heclaimedhehadaccidentallydroppedthevictimintothecarseatafterthevictimstartledhimashewasliftingthevictim. Viewingtheevidenceofthecaseatbarinthelightmostfavorabletothestate,wefindtheevidencesufficienttosupportafindingofthedefendant'sguiltbeyondareasonabledoubt.Thevictimwasgiven$$a$$diagnosisof"nonaccidental%%%%%%  0', %%%%trauma."Themedicalexpertstestifiedabouttheamountsandtypesofforcenecessarytocausethevictim'sinjuries.Therewasexperttestimonythatthe 4$+0 victim'sretinalhemorrhageswereconsistentwith"veryviolent,forcibleshaking,"notrocking,puttingthechildonone'sknee,orgentlymovingthechildbackandforth.Theskullfractureswereconsistentwitha"blow"tothehead.Theheadtraumaandresultantdisabilitywereconsistentwithvigorousshakingofthreetofourminutesduration,beingdroppedintoacrib,beingdroppedintoacarseat,andbeingslappedontopofthehead.Anotherexpertconcurredthatforcefulshakinglastingtwotofourminutescouldcausethebraininjuryandopinedthatbasedupontheamountofbleedingthevictimhad,theshaking"wouldhavetobeashardasyoucoulddoit,justabout.Youwouldhavetoreallybeusingasmuchforceasyoucouldpotentiallydotocausebleedinginsidethehead."Callingintodoubtanyclaimofaccidentaldroppinginthehome,anexpertopinedthatafallwouldnotresultinasmuchinternalbleedingasthevictimhadunlessitwasfromtentotwelvefeetontoconcrete.However,theinjurycouldresultfroma"forcefulsortofthrowandhit"againstanobject.Yetanotherexpertopinedthatthebraininjurywouldresultfrom"fairlyvigorousshaking"ratherthanmererocking,puttingthechildonone'sknee,oreven"normal"dropping,althoughdroppingwasapossibility. `  Althoughthedefendantclaimedanyinjuriestothevictimwereaccidental,thejurywasfreetoacceptorrejecthisexplanationoftheevents.Nevertheless,inhispretrialstatementsthedefendantacknowledgedhitting,rocking,shaking,tossinganddroppingthevictim.Hesaidhetossedthevictimintohiscrib"onpurpose"ratherthanbyaccident.Attrial,thestatecalledthedefendant'scredibilityintoquestionviaintroductionofseveralstatementsinwhichthedefendantadmittedprogressivelytogreateramountsofforceanddifferentforcibleactionsandeventsinvolvingthevictim.Twoofthedefendant'sformercoworkers,whotestifiedaboutthedefendant'struthfulnessandgoodreputation,wereimpeachedby$$evidencethat$$thedefendantwasnotforthcomingwiththemaboutthenatureoftheaccusationsagainsthim.Bothofthedefendant'sformercoworkers 906 wereparents,andbothtestifiedthatcommonsensedictatedthatonenotthrow,droporshakeachild.Thejuryviewedavideotapeofthedefendantdemonstratinganddescribingsomeofhisactionsrelativetothevictim. `  Thejurywasfreetoassessthedefendant'sclaimofaccidentontheonehandagainstthestate'sevidenceofthedegreeanddurationofforcenecessarytocausethevictim'sinjuriesontheother.Althoughthiscourtdoesnotreweightheevidence,itisapparentfromtherecordthatthedefendant'sclaimofaccidentalinjuryisincredibleinthe$$faceof$$themagnitudeof$$theforce$$$$andthe$$natureofactionsnecessarytocausethevictim'sveryseriousinjuries.TX"kXX
