'   ׀WithrespecttotheMooreCountysentence,theappellantstatedthathewasreleasedandplacedonparoleinSeptember,1994.HisparolewasrevokedinFebruary,1995,duetotheappellantsfailuretopassadrugurinescreen. Onappeal,theappellantarguesonlythathereceivedineffectiveassistanceofcounselduringtheguiltypleaproceedings,becausetrialcounseladvisedhimthathisMooreCountyandCoffeeCountysentenceswouldexpireatthesametime.TheappellantcontendsthatherelieduponthisadvisewhenheacceptedtheStatespleaoffer.Furthermore,theappellanttestifiedthatcounselinformedhimthat,duetothenumberofdaysofpretrialjailcreditaccumulatedbytheappellant,hewouldbeeligibleforreleaseimmediately. (   ׀Theappellantacknowledgedthatacomparisonofhiscurrentsentencewithhisoriginalsentencerevealedthathehadbenefitedfromthepleaagreementnegotiatedbytrialcounsel. Theappellantstrialcounseltestifiedthat,onthedayoftheappellantsguiltyplea,theappellantinformedcounselthathewantedasentencenolongerthansevenyears,whichtheappellantwouldserveconcurrentlywiththeCoffeeCountysentences.Counselalsotestifiedthat [theappellant]wantedwhenhegotoutthat[hissentences]allbeover.Hedidwantthat.TherewasnowayIcouldguaranteethat.Counselassertedthatheneverguaranteesexpirationdatestohisclients.Finally,counselstatedthathecouldnotrecalleverinformingtheappellantthathisMooreCountysentenceandhisCoffeeCountysentenceswouldexpiresimultaneously.Henotedthat,hadhebeenasked,hewouldhaveexplainedtotheappellantthatexpirationdatesaredeterminedbysentencereductioncreditswhichmustbecalculatedbytheDepartmentofCorrection. Attheconclusionofthehearing,thepostconvictioncourtdismissedtheappellantspetition.Withrespecttothetrialattorneysperformance,thecourtmadethefollowingfindingsoffact:8 Ifound[defensecounsels]testimonycompletelycredibleinhisdescriptionoftherepresentationsthathemadetohisclient/defendantatthattime....Ithereforedonotbelievethatthedefendant/petitionerhasmethisburdenofproof...astowhethertherewasanyerrororomissionmadebyhiscounselatthattime.[Defensecounsel]toldhimexactlywhatthesituationwasandwhathecouldexpect....[I]nfactallhewaspromisedwaswhathegot.Hewaspromisedaconcurrentsentenceandthatiswhathegot.Afterreviewingtherecord,weaffirmthejudgmentofthepostconvictioncourt.@ ANALYSIS  Reducedtoitssimplestterms,theappellantnowraisesinthiscollateralattackthecriticalquestion, WhyaintIfree.Althoughthereareundoubtedlyseveralpossibleresponsestotheappellantsinquiry,includingtheappellantsapparentfailuretocomplywiththeconditionsofhisparole,therecordsimplydoesnotsupporttheappellantsallegationofdeficientperformancebytrialcounsel.Inpostconvictionproceedings,theappellantmustprovetheallegationsinhispetitionbyapreponderanceoftheevidence.Davisv.State,912S.W.2d689,697(Tenn.1995).Moreover,onappeal,thiscourtisboundbythepostconvictioncourtsfindingsoffactunlesstheevidenceintherecordpreponderatesagainstthosefindings.Id.SeealsoBlackv.State,794S.W.2d752,755(Tenn.1990). Whenaclaimofineffectiveassistanceofcounselisraised,theappellantbearstheburdenofshowingthat(a)theservicesrenderedbytrialcounselweredeficientand(b)thedeficientperformancewasprejudicial.Stricklandv.Washington,466U.S.668,687,104S.Ct.2052,2064(1984);Butlerv.State,789S.W.2d898,899(Tenn.1990).Withrespecttodeficientperformance,thecourtmustdecidewhetherornotcounselsperformancewaswithintherangeofcompetencedemandedofattorneysincriminalcases.Baxterv.Rose,523S.W.2d930,936(Tenn.1975).TosatisfytheprejudiceprongoftheStricklandtest,theappellantmustshowareasonableprobabilitythat,butforcounselsineffectiveperformance,theresultoftheproceedingwouldhavebeendifferent.Strickland,466U.S.at694,104S.Ct.at2068.Accordingly,whentheappellantseekstosetasideaguiltypleaonthegroundofineffectiveassistanceofcounsel,hemustdemonstrateareasonableprobabilitythat,butforcounselsdeficiency,hewouldhaveinsisteduponproceedingtotrial.Hillv.Lockhart,474U.S.52,59,106S.Ct.366,370(1985);Bankstonv.State,815S.W.2d213,215(Tenn.Crim.App.),perm.toappealdenied,(Tenn.1991);Manningv.State,883S.W.2d635,637(Tenn.Crim.App.1994).
