BACKGROUND  T      Thiscasepresentsaproceduralnightmare.Thepaucityoftherecordfurthercomplicatesthecourtsattempttomakeacompletedeterminationoftheissues.XX&&7XXXX          1      &&XX&7&&& l AnarrestwarrantwasissuedfortheappelleeonSeptember30,1997.ThewarrantreflectsthatanautomobileaccidentoccurredinOakRidge,AndersonCounty,TennesseeonSeptember24,1997.Onevehicleleftthescenejustpriortothearrivalofpoliceofficers.Subsequentinvestigationresultedinthelocationshortlythereafterofthevehicleandtheappellee,whoadmittedbeingthedriver.Atthattimetheinvestigatingpoliceofficerobservedtheappelleetohaveastrongodorofalcoholicbeverageonherbreathandaboutherperson.Hestatedthathereyeswereredandglassyandthatshewasunsteadyonherfeet.Shethenfailedfieldsobrietytestsandrefusedabloodalcoholtest.Shewasarrestedfordrivingundertheinfluenceofanintoxicant.  Ononeormoredatesafterappelleesarrest,apreliminaryhearingwasscheduledingeneralsessionscourt.ThehearingwasthenrescheduledtoDecember10,1997.DefendantfiledamotiontosuppressandappearedincourtonDecember10forthehearingonbothmatters.ThearrestingofficerdidnotappearandthecasewasrescheduledtoJanuary14,1998.Onthatdatedefendantappearedagain,alongwithawitness.Sometestimonywasreceivedbythegeneralsessionscourtjudge,butheapparentlyranoutoftimeonhiscalendar.Hecontinuedthehearingagainto `0+3 February11,1998,theprosecutingofficersnextavailablecourtdate.  1-7 7dd7  OnFebruary3,1998,theDistrictAttorneypresentedthecasetotheAnderson  CountyGrandJury,whichreturnedanindictmentagainstappelleefordrivingundertheinfluenceofanintoxicant.ThestatedidnotinformtheappelleeordefensecounselabouttheindictmentuntiltheynextappearedingeneralsessionscourtonFebruary11,1998.OnMarch5,1998,appelleefiledintheAndersonCountyCriminalCourtamotiontoremandforpreliminaryhearingorinthealternativetodismiss.  OnMarch20,1998,thetrialcourtconductedahearingonthatmotion.Thecourtstatedthatitwas hardforhimtofindthattheprosecutorwasactinginbadfaith,",butheremandedthecasetothegeneralsessionscourtforanyfurthersuppressionhearingleftundecided,andanyothernecessaryproceedings.  ANALYSIS  @     Thestatecontendsthatbecausetheappelleehadalreadybeenindictedfordrivingundertheinfluence,andthetrialcourtdeniedhermotiontodismisstheindictment,thetrialcourterredinremandingthecasebacktogeneralsessionscourt.ThestatereliesonStatev.Hudson,487S.W.2d672,676(Tenn.Crim.App.1972),in | assertingthat,afterindictment,ageneralsessionsjudgehasnoauthorityorpowertoproceedwithapreliminaryhearingandtoredeterminethesamequestionofprobablecause.Thestatealsoassertsthatthetrialcourtdidnotspecificallyfindthattheprosecutorhadactedinbadfaith,sothatappellantwasnotentitledtoadismissaloftheindictmentmorethanthirtydaysafterherarrest.Theappelleeassertsthatthetrialcourtsrulingrepresentsanimplicitfindingofbadfaithonbehalfofthestate.  Tennesseelawisclearthat,whileapreliminaryhearingisnotconstitutionallyrequired,itisacriticalstageofacriminalprosecutionmandatedbystatutorylaw.Moorev.State,578S.W.2d78,80(Tenn.1979);Waughv.State,564S.W.2d654, *l%. 659(Tenn.1978).Theprimaryfunctionofapreliminaryhearingistodeterminewhetherprobablecauseexiststobelievethattheaccusedcommittedtheoffensecharged,andtofixtheamountofbailforbailableoffenses.Tenn.R.Crim.P.5.1;Statev.DAnna,506S.W.2d200,203(Tenn.Crim.App.1973).Itisalso 0+6 fundamentalthatmotionstosuppressillegallyseizedevidenceareappropriateatthepreliminaryhearing.Statev.Golden,941S.W.2d905,907(Tenn.Crim.App.1996).  3,/:     3     Rule5(e)oftheTennesseeRulesofCriminalProcedureprovidesasfollows:   l Anydefendantarrestedpriortoindictmentorpresentment0   l foranyoffense...shallbeentitledtoapreliminaryhearing  (# (# 0   l uponhisrequesttherefor,whetherthegrandjuryofthecounty  (# (# 0   l beinsessionornot.Ifthedefendantisindictedduringtheperiod  (# (# 0  0l  (# (#oftimeinwhichhispreliminaryhearingisbeingcontinued,oratanytimebeforetheaccusedhasbeenaffordedapreliminaryhearingonawarrant,whetherathisownrequestorthatoftheprosecutor,hemaydismisstheindictmentuponmotiontothecourt.Provided,however,thatnosuchMotiontoDismissshallbegrantedaftertheexpirationofthirtydaysfromthedateofdefendantsarrest. l (#l (# TheTennesseeSupremeCourtinMoorev.State,578S.W.2d78,82(Tenn.19 7  9 9 9 ) ,    createdanexceptiontothethirtydayrule,holdingthat:   l [T]hethirtydaylimitation...isapplicableonlywhenallparties0  0l  (# (#includingthedefendant,whomustactpromptlyhaveactedingoodfaithandincompliancewiththestatute.Thefailureofthecourtortheprosecutiontoexercisegoodfaithandtoabidethelawoperatestotollthestatuteandprecludeitsinvocation. l (#l (# Thus,thequestioncentraltoourreviewiswhetherthestateorthegeneralsessionscourtactedin badfaithtodeprivetheappelleeofherrighttoapreliminaryhearing.
