Thedefendant,whowasindictedforfirstdegreemurder,enteredintoanagreementwherebyheenteredabestinterestpleaofguilttovoluntarymanslaughter,aClassCfelony.SeeNorthCarolinav.Alford,400U.S.25(1970). ` Thepunishmentforvoluntarymanslaughtermayrangefromthreetofifteenyears.Tenn.CodeAnn.4035112.ARangeIsentenceisthreetosixyears.Tenn.CodeAnn.4035112(a)(3).In1992,thetrialcourtimposedasentenceoffifteenyearscoupledwithRangeIreleaseeligibilityofthirtypercent.  In1997,thedefendantsoughtrelief,claimingthesentencewasillegal.Atanevidentiaryhearing,counselforthedefenseintroducedthejudgmentformandthetranscriptofthepleasubmissionhearingbutdidnotsubmitthewrittenpleaagreement.DefensecounselarguedthatthetrialcourthadfailedtoproperlyinformthedefendantthathewasagreeingtoasentencehigherthanthatpermittedforaRangeIoffender.Whilethedefendantwaspresentattheevidentiaryhearing,hedeclinedtotestify.Thedefendant'strialcounseldidnotparticipateintheproceeding.Thetrialcourtdeniedthemotion,concludingthatthepostconvictionstatuteoflimitationsbarredconsiderationoftheclaimandthatthetranscriptestablishedthatdefendant'spleawasknowingandvoluntary. Therewasnodiscussionofthedefendant'srangenordidthetrialcourtinformthedefendantthatthefifteenyearsentencehewasagreeingtoexceededthethreetosixyearrangesetforthbythestatute.Ontheotherhand,thetranscriptindicatesthatthesentenceresultedfromawrittenpleaagreement 8.4 whichhadbeenapprovedbythetrialcourt.Thatagreementisconspicuouslyabsentfromtherecord.  Itisthedutyoftheappellanttopreparearecordthatconveysafair,accurate,andcompleteaccountofwhattranspiredinthetrialcourtwithrespecttotheissuesthatformthebasisfortheappeal.Becausetheagreementisnotintherecord,thisissuemustbetreatedaswaived.Tenn.R.App.P.24(b);Statev.Miller, (  737S.W.2d556,558(Tenn.Crim.App.1987). T$ 1977).  Inthisinstance,thetranscriptdemonstratesthatthedefendantwasinformedofandunderstoodhisconstitutionalrightsandthatthedefendantagreedtoafifteen  yearsentenceforvoluntarymanslaughterratherthanfaceatrialforfirstdegreemurder.Obviously,pleanegotiationsbetweenthedefendantandthestatehadresultedinapleabargainagreement.Duringtheproceeding,awrittenagreement which hadbeenapprovedbydefensecounselandsignedbythedefendant.AlthoughthetrialcourtdidnotexplainthattheRangeIsentenceforvoluntarymanslaughterwasthreetosixyears,thatalonedoesnotrenderthepleainvoluntaryorunknowing.Becausethelengthofsentencewasthesignificantconsequenceof 8.4 theplea,thedefendantclearlyunderstoodthelengthofhistermofimprisonment.
