àOn€October€1,€1998,€counsel€for€Sentinel€withdrew€the€record€of€theÏprevious€appeal€from€the€archives€of€this€court.€€Later€that€same€day,€according€toÏthe€North€deposition,€Sentinel's€attorneys€and€North€discovered€that€the€documentsÏprovided€by€the€clerk€of€the€appellate€courts€included€detailed€time€records€ofÏdefense€counsel€and€other€information€pertaining€to€authorizations€for€expertÏservices€which€were€more€extensive€than€the€information€which€North€had€alreadyÏreceived€from€his€undisclosed€source.€€North€believed€this€information€wasÏ"accidentally"€provided,€and€the€documents€were€returned€to€the€court.ñ’;ñ׃: ÐSentinel€intended€to€publish€an€article€about€the€information€on€October€25,€1998Ïand€inquired€whether€Moncier€would€comment.ÌÌà ` àà ¸ àMoncier€and€Isaacs€filed€an€application€for€temporary€restraining€orderÏand€injunction€against€Sentinel€on€Friday,€October€23,€1998.€€They€soughtÏprohibition€of€publication€of€any€information€in€the€detailed€time€records€and€returnÏof€all€copies€of€the€time€records€in€Sentinel's€possession.€€The€trial€court€entered€aÏtemporary€restraining€order€prohibiting€publication€of€information€contained€in€theÏrecords.€€Based€upon€the€belief€the€order€was€invalid€on€its€face,€Sentinel€defied€theÏtrial€court's€order€on€Sunday,€October€25,€1998€by€publishing€an€article€whichÏutilized€some€of€the€information€from€the€records.ÌÌà ` àà ¸ àOn€October€26,€1998,€Sentinel€moved€to€dissolve€the€temporaryÏrestraining€order€and€to€dismiss€all€ñ;ñœñ;ñproceedings€challengingñ;ñ›ñ;ñ€publication€of€theÏinformation€obtained€by€Sentinel.ÌÌà ` àà ¸ àThereafter,€on€October€28,€1998€and€November€4,€1998,€the€trial€courtÏconducted€hearings€on€Sentinel's€motion€to€dissolve€the€temporary€restraining€orderÏand€on€Huskey's€motion€to€convert€the€temporary€restraining€order€to€a€temporaryÏinjunction.€€After€receiving€evidence€and€hearing€the€arguments€of€counsel€forÏSentinel€and€Huskey,€the€trial€court€entered€an€order€on€November€4,€1998Ïenjoining€Sentinel€"from€the€publication€or€dissemination€in€any€manner€of€anyÏinformation€contained€in€the€detailed€time€records€and/or€from€any€other€sealedÏdocuments€which€it€gained€access€to€through€the€review€of€the€appellate€courtÏrecord."€€The€order€further€required€Sentinel€to€turn€over€all€copies€of€"the€sealedÏrecords"€in€its€possession€to€Attorney€Hollow€for€confidential€safekeeping€"until€theÏconclusion€of€this€case."€€ÌÐ
