ðthe€indictment€in€thisÏcase€because€it€does€not€charge€a€crime.ðð€The€next€day,€September€29,€1993,€theÏappellant€filed€a€document€entitled:€ð ðDefendantððs€Withdrawal€of€Motion€to€DismissÏIndictment.ðð€€This€document€alleged:€ð ðComes€the€Defendant,€through€his€attorney,€andÏwithdraws€the€òòMotion€to€Dismiss€Indictmentóó,€which€was€filed€September€28,€1993.ððÌà àThe€appellant€entered€a€plea€of€guilty€to€the€indictment€on€December€14,€1993.€ÏThe€trial€court€accepted€the€plea.€€However,€the€trial€court€did€not€conduct€a€sentencingÏhearing€or€impose€a€sentence.€€Apparently,€the€parties€and€the€trial€court€agreed€toÏhold€sentencing€in€abeyance€until€this€Court€ruled€upon€the€issue€raised€by€theÏappellant.Ìà àThis€Court€considered€the€appellantððs€appeal€at€the€October€1994€Session.€€TheÏappeal€was€dismissed€because€the€judgment€of€the€trial€court€was€not€final.€€òòSeeóó€òòStateÏv.€Douglas€Brian€Irwinóó,€Blount€County€No.€03„C„01„9403„CR„00100€(Tenn.€Crim.€App.,ÏKnoxville,€April€26,€1995).€€The€appellant€returned€to€the€trial€court,€a€judgment€settingÏthe€sentence€was€entered€on€July€11,€1995,€and€he€now€seeks€to€have€this€CourtÍdecide€the€identical€certified€question€he€raised€in€the€first€appeal.Ìà
