Therecordreflectsthatthepetitionerwasoriginallyprosecutedforandconvictedofespeciallyaggravatedrobberyandtwocountsofattempttocommitfelonymurder.Pendinghissentencinghearing,theTennesseeSupremeCourtrenderedanopinionholdingthattheoffenseofattempttocommitfelonymurderdidnotexistinTennessee.SeeStatev.Kimbrough,924S.W.2d888,892(Tenn.1996).Thetrial #  courtsetthepetitionerscaseforretrialfortwocountsofattempttocommitseconddegreemurder,butpursuanttoapleabargain,thepetitionerenteredguiltypleastotwocountsofattempttocommitseconddegreemurder.Thepetitionerreceivedconcurrenttenyearsentences,tobeservedconsecutivelytothetwentyfiveyearsentenceheacceptedfortheespeciallyaggravatedrobberyconviction. Atthepostconvictionevidentiaryhearing,thepetitionertestifiedthathistrialattorneyshouldhavetoldhimabouthisrightnottobetriedagainandshouldnothaveadvisedhimtopleadguilty.Hesaidthathewantedareductioninhissentence.Atthatpoint,thedistrictattorneygeneralmovedtodismissthepetitionbecauseitwasuntimelyfiledandbecausethepetitionerhadnotprovenanygroundforreliefexisted. 706 ThedistrictattorneygeneralstatedthatthejudgmentsofconvictionwereenteredonSeptember3,1996,andthatthepetitionwasfiledonSeptember4,1997,outsidetheoneyeartimelimit.SeeTenn.CodeAnn.4030202(a).Thetrialcourtgrantedthe   motiononbothgrounds. First,webelievethattherecordreflectsthatthepetitionwasfiledwithintheoneyeartimelimit.AlthoughthetrialcourtclerksstampshowsthatthepetitionwasfiledintheclerksofficeonSeptember4,1997,thepetitionerscertificateofserviceassertsthatthepetitionwasdeliveredtotheprisonpostofficepursuanttothe PostOfficeBoxDepositRuleonSeptember2,1997.Tworulesexistregardomgingapplytothepetitionersfilingofhisfpetitionforpcpostconvictionrelief.PursuanttoRule28,2(G),RulesoftheSupremeCourtofTennessee,filingofapostconvictionpetitionbyapro  seincarceratedpetitioneriscomplete whenitisreceivedbytheappropriateprison  authoritiesformailing.PursuanttoRule49(c),Tenn.R.Crim.P.,apostconvictionpetitionpreparedbyoronbehalfofaproselitigantisdeemedfiledtimely ifthepapers 0 ( aredeliveredtotheappropriateindividualatthecorrectionalfacilitywithinthetimefixedforfiling.Thus,therecordbeforeusdoesnotsupportthetrialcourtsconclusionthatthepetitionwasuntimelyfiled. Asforthepetitionerssubstantiveclaims,theyareprimarilybaseduponhiscontentionthatafterhewastriedandconvicted,theDoubleJeopardyClausepreventedhisreprosecution.However,theDoubleJeopardyClausedoesnotbarretrialincertaincircumstances.Forinstance,ifadefendantissuccessfulinseekingreversalofaconviction,doublejeopardydoesnotbarretrial.SeeUnitedStatesv. \0T).
