OnJuly18,1977,thePetitionerwasconvictedofbankrobberyintheUnitedStatesDistrictCourtfortheWesternDistrictofTennessee.Hewassentencedtothirtyyearsimprisonmentforthatoffense.HewasparoledonFebruary28,1985,witheightthousandonehundredeightyfourdaysremainingtobeservedonhisfederalsentence.OnApril25,1990,inShelbyCountyCriminalCourt,hewasconvicteduponguiltypleasoffivecountsofrobberywithadeadlyweapon.HewassentencedtoaneffectivetermoftwentyyearsimprisonmentwiththeTennesseeDepartmentofCorrection.OnMay16,1990,afederalwarrantwasissuedforthePetitionerongroundsthathehadviolatedaconditionofhisparole.HisparolewasrevokedonJune21,1995,andhewasreturnedtofederalcustodyonJuly20,1995. OnApril15,1996,thePetitionerfiledapetitionforpostconvictionreliefwhichisthesubjectofthecasesubjudice.Inthepetition,hearguedthathewasdeniedtheeffectiveassistanceofcounselathisguiltypleaproceedingandthatboththetrialcourtandhiscounselfailedtoinformhimthathisconvictionscouldlaterbeusedasabasisforenhancement.Thetrialcourtfoundthatthepetitionwasbarredbythestatuteoflimitationsanddismisseditwithoutconductinganevidentiaryhearing.ItisfromthetrialcourtsorderofdismissalthatthePetitionerappeals. Onappeal,thePetitionercontendsthatthetrialcourterredinfindingthathispetitionforpostconvictionreliefwasbarredbythestatuteoflimitations.AtthetimethePetitionersconvictionsbecamefinal,thestatuteoflimitationsapplicabletopostconvictionproceedingswasthreeyears.Tenn.CodeAnn.4030102(repealed1995).TheexpirationofthethreeyearstatuteoflimitationsinthePetitionerscaseoccurredin1993.Aswestatedabove,thepresentpetitionwasnotfileduntilAprilof1996. Ofcourse,thenewPostConvictionProcedureActgovernsthispetitionandallpetitionsfiledafterMay10,1995.SeeTenn.CodeAnn.4030201etseq.(Supp.1996).ThisActprovides,inpertinentpart,that notwithstandinganyotherprovisionofthisparttothecontrary,anypersonhavinggroundforreliefrecognizedunderthispartshallhaveatleastone(1)yearfromMay10,1995,tofileapetitionoramotiontoreopenapetitionunderthispart.CompilersNotestoTenn.CodeAnn.4030201(Supp.1996)(referringtoActs1995,ch.207,3).ThePetitionerarguesthatthetermsofthenewPostConvictionProcedureActallowedhimoneyearfromMay10,1995,tofilehispetitionand,thus,hisApril1996petitionwastimelyfiled. WerecognizethatanotherpanelofthisCourthasheld,withonememberdissenting,thatthenewPostConvictionProcedureActprovides aoneyearwindowduringwhicheachandeverydefendantmayfileapetition.SeeArnoldCarterv.State,C.C.A.No.03C019509CC00270,MonroeCounty(Tenn.Crim.App.,Knoxville,July11,1996),perm.toappealgranted(Tenn.1996).TheCartercourtheldthattheoneyearwindowisavailableevenifthepetitionwouldhavebeenlongagobarredbythethreeyearstatuteprovidedunderthepreviousact. WechoosetofollowthereasoningsetforthintheCarterdissent.Inourview,theoneyearwindowprovidedbythelanguageofthenewActisapplicableonlytothosepetitionerswhowerenotalreadybarredbythepreviousstatuteoflimitationsatthetimethenewActtookeffect.Thus,ifthepreviousthreeyearstatuteoflimitationshadnotexpiredonapetitioneratthetimethenewActtookeffect,heorshewouldhaveoneyearfromtheeffectivedateofthestatute,May10,1995,tofileforpostconvictionrelief.ThisapproachisinaccordancewiththegeneraltenoroftheentireActaswellasitslegislativehistory. Inthecasesubjudice,therecordindicatesthatthePetitionerwasconvictedandsentencedinAprilof1990.ThepreviousthreeyearstatuteoflimitationsexpiredforthePetitionerinAprilof1993.Asaresult,thePetitionerwasalreadybarredbythepreviousstatuteoflimitationsonthedatethenewActtookeffect,May10,1995.Inaddition,thePetitionerhasnotdemonstratedthathefitswithinanexceptiontothestatuteoflimitations.SeeTenn.CodeAnn.4030202(b)and202(c)(Supp.1996).Accordingly,thetrialcourtdidnoterrinfindingthatthepetitionwasbarredbythestatuteoflimitations.
