àò òANALYSISó óÌà àInitially,€we€note€that€the€State€cites€no€authority€for€its€proposition€thatÏjudicial€diversion€pursuant€to€Tenn.€Code€Ann.€ðð€40„35„313€(1990)€does€notÏconstitute€a€ð ðmanner€of€service€of€[a]€sentenceðð€which€a€criminal€defendant€mayÏappeal€under€Tenn.€Code€Ann.€ðð€40„35„401€(1990).× ƒ3 ××  ×€€Moreover,€Tenn.€CodeÏAnn.€ðð€40„35„401€(b)(1)€provides€that€any€sentence€not€imposed€in€accordanceÏwith€the€provisions€of€the€Sentencing€Act€may€be€appealed.€€Clearly€a€denial€ofÏjudicial€diversion€could€fall€within€this€category.€€Finally,€this€court€hasÏpreviously€held€that€ð ðan€appeal€may€be€taken€after€entry€of€judgment€when€theÏtrial€court€denies€judicial€diversion.ðð€€òòState€v.€Georgeóó,€830€S.W.2d€79,€80€(Tenn.ÏCrim.€App.€1992).ÌÌà àAdditionally,€Tenn.€R.€App.€P.€3(b)€provides€that€a€defendant€may€appealÏas€of€right€ð ðany€judgment€of€conviction€entered€by€a€trial€court€from€which€anÍappeal€lies€to€the€Supreme€Court€or€Court€of€Criminal€Appeals€...€on€a€plea€ofÏguilty€...€if€the€defendant€seeks€review€of€his€sentence€and€there€was€no€pleaÏagreement€concerning€his€sentence.ðð€€The€record€indicates€that€the€appellant'sÏpleas€of€guilty€were€entered€pursuant€to€the€provisions€of€Tenn.€R.€Crim.€P.Ï11(e)(1)(c).€€This€rule€provides€that€the€district€attorney€general€and€the€attorneyÏfor€the€defendant€are€in€agreement€"that€a€òòspecificóó€sentence€is€the€appropriateÏdisposition€of€the€case."€€òòIdóó.€(emphasis€added).€€Obviously,€the€appellantððs€pleasÏwere€not€entered€in€conformity€with€this€rule,€as€there€was€no€agreementÏconcerning€the€suitability€of€judicial€diversion.€€Rather,€that€portion€of€the€pleaÏagreement€relating€to€judicial€diversion€was€an€11(e)(1)(b)€agreement.€€ÏAccordingly,€the€appellant,€pursuant€to€Tenn.€R.€App.€P.€3(b),€could€appeal€anÏarbitrary€denial€of€judicial€diversion€by€the€trial€court.ÌÌÌà ð[w]hen€the€trial€courtÏrefuses€to€grant€judicial€diversion€to€the€accused,€the€court€should€clearlyÏarticulate€and€place€in€the€record€the€specific€reasons€for€its€determination.ðð€ÏòòBonestelóó,€871€S.W.2d€at€168.€€The€trial€court€failed€to€do€so€in€this€case.€ÏNevertheless,€the€burden€is€first€upon€the€defendant€to€present€adequateÏevidence€upon€which€the€trial€court€may€make€an€informed€decision€regardingÍpre„trial€diversion.€€òòRyansóó,€No.€03C01„9503„CR„00071.€€Accordingly,€evenÏwhen€the€trial€court€has€not€set€forth€the€required€findings,€we€have€affirmed€aÏdenial€of€diversion.€€òòState€v.€Haltomóó,€No.€01C01„9209„CC„00286€(Tenn.€Crim.ÏApp.€at€Nashville),€òòperm.€to€appeal€deniedóó,€(Tenn.€1993).ÌÌà àIn€the€instant€case,€the€pre„sentence€report€reveals€that,€at€the€time€of€theÏsentencing€hearing,€the€appellant€was€41€years€old€and€had€no€criminal€history.€ÏHe€is€paralyzed€and€confined€to€a€wheel€chair€due€to€a€past€spinal€cord€injury.€ÏHe€is€unemployed,€divorced,€and€lives€alone€in€rural€Madison€County.€€TheÏappellant€dropped€out€of€high€school€in€the€tenth€grade€and€joined€the€UnitedÏStates€Marine€Corps.€€He€served€in€the€Marine€Corps€from€1971€until€1974€andÏreceived€an€honorable€discharge.€€He€obtained€his€GED€at€the€Jackson€StateÏCommunity€College€in€1974.€€The€appellant€maintains€his€innocence€andÏclaims€that€he€pled€guilty€because€ð ð[his]€nerves€couldnððt€take€much€more€of€this.ðð€€ÌÌà àThe€appellantððs€pleas€arose€from€allegations€that€he€had€providedÏalcohol€and€drugs€to€numerous€minors€and€had€engaged€in€sexual€intercourseÏwith€two€fifteen€year€old€girls.€€The€victims€asserted€in€the€victim€impactÏstatements€that,€due€to€the€appellantððs€actions,€they€have€experiencedÏconsiderable€psychological€distress.€€Similarly,€the€father€of€one€of€the€victimsÏtestified€at€the€sentencing€ÌÌÌhearing€that€he€was€upset€by€the€appellantððs€involvement€with€his€daughter.€ÏThe€circumstances€of€the€offense€alone€may€support€a€denial€of€diversion.€ÏòòState€v.€Kyteóó,€874€S.W.2d€631,€634€(Tenn.€Crim.€App.),€òòperm.€to€appeal€deniedóó,Ï(Tenn.€1993).€€We€conclude€that€the€record€supports€the€trial€courtððs€denial€ofÏjudicial€diversion.ÌÌà ðððfully€aware€of€the€direct€consequences€[of€his€guilty€plea],Ïincluding€the€actual€value€of€any€commitments€made€to€him€by€the€court,€theÏprosecutor,€or€his€own€counsel.ðððð€òòBradyóó,€397€U.S.€at€755,€90€S.Ct.€at€1472Ï(citation€omitted).€€òòSee€alsoóó€Advisory€Commission€Comments,€Tenn.€R.€Crim.€P.Ï11€(the€defendant€must€have€an€understanding€of€those€aspects€of€the€pleaÏagreement€which€are€plea€contingent€and€those€that€are€not€so€that€his€plea€isÏknowing).ÌÌà àIt€is€apparent€from€the€record€that€the€appellant€did€not€understand€thatÏhis€pleas€were€contingent€only€upon€the€trial€courtððs€òòconsiderationóó€of€judicialÏdiversion€rather€than€the€trial€courtððs€òògrantingóó€of€judicial€diversion.€€The€recordÏdemonstrates€that€the€trial€courtððs€attempts€to€explain€to€the€appellant€theÏcondition€of€his€pleas€relating€to€judicial€diversion,€including€the€courtððsÏstatement,€"I€can€allow€you€to€apply,€and€in€two€years€you€can€ask€for€it€and€I€canÏthen€determine€whether€I'll€allow€it€or€not,"€did€not€alleviate€the€appellantððsÏconfusion.€€The€court€apparently€intended€to€convey€to€the€appellant€that,€òòifóó€theÏcourt€granted€the€appellantððs€application€for€judicial€diversion,€òòthenóó,€followingÏthe€appellantððs€service€of€two€years€of€supervised€probation,€the€court€wouldÏconsider€the€appellantððs€application€for€expungement€of€his€record.€€However,€itÏis€equally€apparent€that€the€trial€court€did€not€explain€to€the€appellant€theÍdistinction€between€the€application€for€òòjudicial€diversionóó€and€the€application€forÏòòexpungementóó.€€Adding€confusion€to€the€situation,€the€court€advised€theÏappellant€at€the€conclusion€of€the€guilty€plea€hearing€that€he€was€sentenced.€ÏYet,€the€court€could€not€have€sentenced€the€appellant€if€he€had€not€yetÏconsidered€judicial€diversion.€€Judicial€diversion€is€a€sentencing€option.€€AsÏmentioned€earlier,€Tenn.€Code€Ann.€ðð€40„35„313(a)€requires€that€the€courtÏð ðwithout€entering€a€judgment€of€guilty€...€defer€further€proceedings€and€place€[aÏdefendant]€on€probation.ðð€€Following€a€successful€probationary€period,€aÏdefendant€may€apply€for€expungment.€€Tenn.€Code€Ann.€ðð€40„35„313(b).ÌÌà
