Therecordreflectsthat,onFebruary11,1994,theappellantenteredguiltypleastotheoffensesoffirstdegreemurderforthedeathofDonaldSirhan,firstdegreemurderforthedeathofRenaldoCrawford,criminalattempttocommitfirstdegreemurder,andcriminalattempttocommitaggravatedrobbery.Theappellantreceivedtwolifesentencesforthemurderconvictions,twentyfiveyearsfortheattemptedmurderconviction,andsixyearsfortheattemptedaggravatedrobberyconviction.Thetrialcourtorderedthatthesentencesbeservedconcurrently.Theappellantnowcollaterallyattacksthejudgmentsofconviction,contendingthathisguiltypleastotheseoffensesareconstitutionallydeficient. #    Afterareviewoftherecord,thejudgmentofthepostconvictioncourtisaffirmed. OnNovember17,1994,anevidentiaryhearingwasheldtoreviewtheappellant'sclaimsforpostconvictionrelief.Theoriginalpetitionwasfiledproseandunsigned.Thepetition,asamended,allegesthatthesentencingcourtfailedtocomplywiththerequirementsofRule11,Tenn.R.Crim.P.,asfollows:(1)thecourtfailedtoinformtheappellantofthenatureofthechargesandtherespectiveminimumandmaximumpenaltyranges,and(2)thecourtfailedtoadvisetheappellantofhisrighttotrialbyjury,hisrighttoconfrontwitnesses,andhisrightagainstselfincrimination.Moreover,theappellantallegesthat,onthedateofhisguiltypleas,hewasnotmentallycompetent.Therefore,hispleaswerenotvoluntary. Atthepostconvictionhearing,theappellanttestifiedthathecanneitherreadnorwrite,andthathispetitionwaspreparedbya"guythatdid[it]forme"inthepenitentiary.Hewasabletorecallfew,ifany,ofthedetailsofhisguiltypleahearing.TheStateintroducedthetranscriptoftheproceeding.Alsoreferencedwasamentalevaluationoftheappellant,completedpriortotheentryofhisguiltypleas. Thepostconvictioncourtfoundthatalthoughthetrialcourtfailedtoadvisetheappellantofthesentencingrangesfortheoffensesentered,itotherwisecompliedwithRule11.Moreover,thepostconvictioncourtfoundthattherecordclearlyprovidesafactualbasisforfindingsofguilt,andthattheappellantwasmentallycompetent,basedupontheconclusionsoftheJohnsonMentalHealthCenter. Inapostconvictionproceeding,thepetitionerhastheburdenofprovingtheallegationsinhispetitionbyapreponderanceoftheevidence.McBeev.State,655S.W.2d191,195(Tenn.Crim.App.1983).Furthermore,thefindingsofthetrialcourtinpostconvictionhearingsareconclusiveonappeal,unlesstheevidencepreponderatesagainstthejudgment.Statev.Buford,666S.W.2d473,475(Tenn.Crim.App.1983);Clennyv.State,576S.W.2d12,14(Tenn.Crim.App.1978).@ CONCLUSION  Initially,wemustdeterminewhethertheappellant'sguiltypleasareconstitutionallysufficientunderBoykinv.Alabama,395U.S.238,89S.Ct.1709(1969).Weconcludethattheappellant'spleaswereentered"voluntarily"and"knowingly"and,thus,noBoykinclaimispresented.Moreover,weconcludethatthereisnothingintherecordtoindicatethattheappellantwasincompetentatthetimehisguiltypleaswereentered.
