Afterreviewingtherecord,weaffirmthejudgmentofthetrialcourt.@ BACKGROUND  TherecordreflectsthatinMarch,1985,inKnoxCounty,theappellantwasarrestedonnumerouschargesandplacedinthecountyjail.InJuly,1985,theappellantwasreleasedonbail.Shortlythereafter,theappellantwasarrestedinIllinois.TheappellantwaivedextraditiontothestateofTennesseeand,followingthedispositionoftheIllinoischarges,wasreturnedtotheKnoxCountyjail.InMarch,1986,thestateofTexasobtainedafugitiveofjusticewarrantfortheappellant,whichwasservedontheappellantinthecountyjail.TheappellantrefusedtowaiveextraditiontothestateofTexas.Accordingly,thestateofTexasinitiatedextraditionproceedings.OnApril3,1986,GovernorAlexandersextraditionofficerforwardedthegovernorswarrantofrenditiontotheKnoxCountySheriff.Thegovernorinstructedthesherifftoplacetherenditionwarrantintheappellantsfileandtopostponeserviceofthewarrantpendingdispositionofthelocalcharges.OnApril25,1986,thegovernorsextraditionofficernotifiedthesheriffthatthegovernorwasrecallingthewarrant,becausetheextraditionrequesthadbeenwithdrawn. +   ׀TherecordindicatesthattheKnoxCountySheriffsDepartmentreturnedthewarranttotheGovernorsextraditionofficerinNashville. ,   ׀Atthehabeascorpushearing,theappellantclaimedthathewasservedwiththerenditionwarrantonJuly18,1986.ThetrialcourtobservedthatserviceonJuly18,1986,wasunlikely,astherenditionwarrantwasapparentlynolongerinKnoxCountyonthatdate. .   ׀Inanycase,inApril,1987,theappellantwastriedandconvictedoftheKnoxCountyoffenses.@ ANALYSIS  InTennessee,habeascorpusreliefisavailableonlyif itappearsuponthefaceofthejudgmentortherecordoftheproceedingsuponwhichthejudgmentisrendered,thataconvictingcourtwaswithoutjurisdictionorauthoritytosentenceadefendant,orthatadefendantssentenceofimprisonmentorotherrestrainthasexpired.Archerv.State,851S.W.2d157,164(Tenn.1993)(citationomittedinoriginal).Theappellanthastheburdenofestablishingeitheravoidjudgmentoranillegalconfinementbyapreponderanceoftheevidence.Passarellav.State,891S.W.2d619,627(Tenn.Crim.App.1994).Ifhesuccessfullycarrieshisburden,theappellantisentitledtoimmediaterelease.Id.̀ TheappellantcontendsthatthestateofTennesseelackedjurisdictioninApril,1987,toplacehimontrialforchargespendinginKnoxCounty.Theappellantarguesthat,inApril,1986,thegovernorofthisstate,bysigningtherenditionwarrantorderingtheappellantsreturntoTexas,effectivelywaivedtheStatesrighttoexercisejurisdictionovertheappellant.TheappellantreliesprimarilyuponoursupremecourtsdecisioninStatev.Grosch,152S.W.2d239(Tenn.1941). InGrosch,thesupremecourtheldthat,whenafugitivefromjusticefacescriminalchargesintheasylumstate,theasylumstatemaydisposeofthosechargesbeforehonoringtheextraditionrequestofthedemandingstate.Id.at243.Thecourtfurtherheldthattheasylumstatemayneverthelesschoosetoimmediatelyhonortherequisitionandsurrenderthefugitivetothedemandingstate.Id.at244.Thisdecisionrestswiththegovernor.Id.SeeYatesv.Gilless,841S.W.2d332,335(Tenn.Crim.App.1992)(ifcriminalchargesarependinginTennessee,itissolelywithinthegovernorsdiscretiontoopttodeliverafugitivetoademandingstateimmediatelyortodelaydeliveryuntilaftertheTennesseechargesareresolved).Finally,thecourtinGroschobservedthat suchsurrenderwilloperateasawaiverofjurisdictionoftheasylumstate.152S.W.2dat244(emphasisadded);Statev.Bomar,366S.W.2d750,751(Tenn.1963). WeconcludethatGroschisnotcontrolling.Initially,theExtraditionClauseoftheUnitedStatesConstitutionsetsforththedutyofstatestoextraditefugitivesfromjustice:8 Apersonchargedinanystatewithtreason,felony,orothercrime,whoshallfleefromjustice,andbefoundinanotherstate,shallondemandoftheexecutiveauthorityofthestatefromwhichhefled,bedeliveredup,toberemovedtothestatehavingjurisdictionofthecrime.U.S.Const.art.IV,2,cl.2.TheExtraditionClausehasbeenimplementedbyafederalstatute,18U.S.C.3182,andbytheUniformCriminalExtraditionAct.Coungerisv.Sheahan,11F.3d726,728(7thCir.1993)(citingMichiganv.Doran,439U.S.282,287289,99S.Ct.530,534536(1978)).TheUniformCriminalExtraditionAct,whereadopted,governsstateextraditionproceedings,inconjunctionwithoverridingfederallaw. /   כId.SeealsoMartinv.Sams,600F.Supp.71,72(E.D.Tenn.1984).Tennesseehasadoptedtheuniformact,Tenn.CodeAnn.409101to130(1990),whichspecificallyprovides:8 Nothinginthischaptercontainedshallbedeemedtoconstituteawaiverbythisstateofitsright,powerorprivilegetotrysuchdemandedpersonforcrimecommittedwithinthisstate,orofitsright,powerorprivilegetoregaincustodyofsuchpersonbyextraditionproceedingsorotherwiseforthepurposeoftrial,sentenceorpunishmentforanycrimecommittedwithinthisstate,norshallanyproceedingshadunderthischapterwhichresultin,orfailtoresultin,extraditionbedeemedawaiverbythisstateofanyofitsrights,privilegesorjurisdictioninanywaywhatsoever.Tenn.CodeAnn.409130(a)(emphasisadded).Moreover,Tenn.CodeAnn.409130(b)providesthat,evenwhentherearecriminalproceedingspendingagainstafugitiveinTennessee,thegovernormayextraditethefugitive beforetheconclusionofsuchproceedingsorhistermofsentenceinthisstatewithoutwaivingthejurisdictionofTennesseeinanyway.SeeCarterv.State,600S.W.2d750,752753(Tenn.Crim.App.),perm.toappealdenied,(Tenn.1980).SeealsoMatterofExtraditionofDixon,487So.2d1195,1197(Fla.App.1986)(undertheUniformCriminalExtraditionAct,surrenderofthefugitivetothedemandingstatedoesnotamounttoawaiverofFloridasrighttoexercisejurisdictionoverhiminthefuture).Inotherwords,undertheExtraditionAct,thegovernorofthisstateneverwaivesjurisdictionovertheaccusedbyenteringintoanyextraditionproceeding.̜ Additionally,asmentionedearlier,thecourtinGroschheldthatanywaiveroccursonlyuponthesurrenderofthefugitivetothedemandingstate.152S.W.2dat244.IninterpretingGrosch,welooktothiscourtsopinioninElliottv.Johnson,816S.W.2d332,339(Tenn.Crim.App.),perm.toappealdenied,(Tenn.1991),inwhichweheld:8 [O]nce[theaccused]isbroughtwithintheboundariesofthisstate,absentoutrageousorillegalconductbythearrestingauthoritiessoextremeastoshocktheconscience,hemaybeplacedupontrialforanychargespending.ӜInotherwords,aslongasanaccusedisphysicallypresentinTennessee,absentconductbystateauthoritiesthatshockstheconscience,heissubjecttothisstatesjurisdiction. Tenn.CodeAnn.409117(1990)providesthatthegovernormayrecallarenditionwarrant.Thissectionfurtherillustratesthatthecriticalfactorinthestatesexerciseofjurisdictionoverafugitiveisthelocationofthefugitivewithintheboundariesoftheasylumstateratherthantheissuanceorserviceoftherenditionwarrant. 0   כSeealsoStatev.Smith,127N.E.2d633,635(OhioApp.1953)(undertheUniformExtraditionAct, [a]slongasthefugitiveisinthecustodyof[theasylumstate]theGovernormayrecallhiswarrantofarrestorissueanotheroneashedeemsproper).Inotherwords,8 Ifagovernordiscoversthata[rendition]warrantwhichhasbeenissuedwasgrantedimprovidently,therighteouscoursewouldseemtobetorecallit,torevokeit,providedthepersonuponwhomitoperatedwasstillwithinhisdomain.Itisalicensetotakeandnotacontract.Itisaprivilegetomovewithinthestate,andbeforetheborderisreachedtheprivilegemaybewithdrawn.Downeyv.Schmidt,4F.Supp.1,3(N.D.Texas1933).SeealsoStatev.Eberstein,182N.W.500,502(Neb.1921)( [i]tis...perfectlyproperthatthepowerofrevocationshouldremaininthehandsoftheGovernortobeexercisedbyhimatanytimebeforetheallegedfugitiveistakenfromthestate).Intheinstantcase,therecordreflectsthatGovernorAlexander,infact,recalledtherenditionwarrantwhiletheappellantremainedinTennessee.Thus,themereissuanceofthewarrantoreventheallegedserviceofthewarrantinnowayimpairedtherightofthisstatetosubsequentlyplacethedefendantontrialforhiscrimes.
