àThe€Defendant,€Christian€Johnson,€appeals€as€of€right€pursuant€to€RuleÏ3€of€the€Tennessee€Rules€of€Appellate€Procedure.€€He€was€convicted€by€aÏHenry€County€jury€œof›€aggravated€sexual€battery€and€aggravated€burglary.€€œFor›Ïthe€œaggravated›€sexual€battery,€he€was€sentenced€as€a€Range€I€offender€toÏœserve€eight›€years€in€the€Department€of€Correction.€€œFor€the›€œaggravated›€burglary,Ïhe€was€sentenced€as€a€Range€I€offender€to€œthree›€years€to€œbe€servedÏconcurrently›€with€the€œother€sentence.€€The›€Defendant€appeals€his€conviction.€ÏWe€affirm€the€judgment€of€the€trial€court.ÌÌà àOn€the€night€of€July€11,€1994,€the€œten„year„old€victim›€in€this€case,€B.× ƒ5 ××  ×,Ïwas€spending€the€night€at€the€home€of€Donna€Krezinski,€and€her€boyfriend,ÏGeorge€Briley,€in€Paris,€Tennessee.€€The€victim€was€a€friend€of€Ms.€KrezinskiððsÏtwo€girls,€ages€4€and€5.€€œThe›€children€went€to€bed€at€approximately€10:00€thatÏevening.€€The€two€adults€went€to€bed€between€10:30€and€11:00€p.m.ÌÌà àMs.€Krezinsky€and€Mr.€Briley€were€sleeping€in€the€front€master€bedroom,Ïwhich€was€near€the€front€door.€€They€were€using€a€box€fan€to€cool€the€roomÍbecause€the€house€was€hot.€€The€children€were€in€a€bedroom€in€the€middle€ofÏthe€house.€€The€bedroom€had€no€windows,€but€was€next€to€the€kitchen€andÏdining€room.€€The€room€was€lit€by€a€small€lamp€that€was€covered€with€a€sheetÏto€create€a€night€light.€€The€three€children€were€sleeping€in€a€bed€that€wasÏpushed€to€the€wall.€€The€two€younger€children€were€closer€to€the€œwall,›€and€œtheÏvictim›€was€lying€on€the€outside€part€of€the€bed€closest€to€the€door.€€The€kitchenÏhad€a€door€that€led€to€a€back€porch.€€This€door€was€used€by€the€occupants€asÏthe€main€entrance€to€the€house.€€The€door€opened€inward€and€was€secured€byÏa€hook€and€eye€latch€lock€of€the€type€commonly€used€for€screen€doors.ÌÌà àAt€approximately€5:51€a.m.€on€July€12,€1994,€Ms.€Krezinski€and€Mr.€BrileyÏwere€awakened€by€someone€knocking€at€the€front€door.€€They€checked€the€frontÏdoor,€but€did€not€see€anyone.€€Mr.€Briley€checked€the€house,€including€the€locksÏon€the€doors,€found€that€they€were€secure,€and€returned€to€bed.ÌÌà àAfter€that,€the€œthe€victim›€was€awakened€by€someone€in€her€bedroom,Ïtouching€her€genitals.€€She€was€wearing€a€nightshirt€and€panties,€and€wasÏtouched€underneath€the€panties.€€She€opened€her€eyes€and€saw€a€man,€œwho›Ïœshe€said€was€ugly,›€with€long€hair€on€the€top€and€shaved€on€the€sides.€€At€thatÏœtime,€the€man€was€standing›€at€the€end€of€the€bed.€€The€œman€asked›€the€victimÏwhether€she€was€ð ðTaraðð€and€where€was€her€mother.€€She€was€scared€andÍpulled€the€sheet€over€her€eyes.€€She€hid€under€the€sheet€and€did€not€see€or€hearÏthe€œman€leave›€the€room.€€The€other€children€remained€asleep€during€the€incident.€ÏB.€fell€asleep.ÌÌà àœThe€victimððs›€mother€and€stepfather€arrived€at€the€Krezinski€residenceÏshortly€before€7:00€a.m.€to€pick€up€Mr.€Briley€for€work.€€œThe€victim›€heard€herÏmother€in€the€other€room,€got€out€of€bed,€and€told€her€mother€about€the€incident.€€ÏAfter€a€search€of€the€house,€they€discovered€that€the€eye€of€the€lock€to€the€backÏœdoor›€had€been€torn€from€the€door,€and€that€a€mop€had€been€moved€out€ofÏplace.€ÌÌà àMs.€Krezinski€called€the€police.€€From€the€description€that€the€victim€gaveÏof€the€man€in€her€room,€her€mother€identified€Christian€Johnson€as€someone€sheÏknew€who€fit€the€description.€€B.€had€seen€the€Defendant€on€one€occasionÏseveral€months€before€the€incident.€€Ms.€Krezinski€also€knew€the€DefendantÏfrom€work,€and€stated€that€he€had€been€in€her€home€approximately€one€to€twoÏweeks€before€the€incident.€€Ms.€Krezinski€did€not€consent€to€the€DefendantÏbeing€in€her€home€on€the€morning€on€July€12,€1994.ÌÌà àThe€police€canvassed€Poplar€Street€near€the€Krezinski€home€to€determineÏwhether€a€child€named€ð ðTaraðð€lived€there.€€No€neighbors€who€were€contactedÍknew€a€child€by€that€name.€€The€police€also€œlooked›€for€the€œDefendant€and€foundÏhim€at€the€Magnolia€Apartments.›€€When€they€located€him€at€9:15€a.m.,€heÏstated€that€he€had€been€with€his€girlfriend€from€midnight€until€9:00€a.m.€thatÏmorning.€€He€said€her€name€was€Selina€Hosford€and€that€she€lived€at€herÏuncleððs€home€on€Depot€Street.€€The€Defendant€stated€he€didnððt€know€theÏuncleððs€name,€nor€would€œhe›€give€directions€to€the€house.€The€police€questionedÏthe€occupants€of€the€houses€on€Depot€Street€to€find€anyone€who€knew€SelinaÏHosford.€€No€one€stated€that€they€knew€or€had€heard€of€her.€€A€friend€of€theÏDefendant€testified€at€trial€that€œthe€Defendant›€came€to€her€house€at€6:00€a.m.€onÏJuly€12.€€Her€home€is€located€one€block€behind€the€Krezinski€home.ÌÌà à€Dr.€Debra€Selby€conducted€a€physical€examination€of€B.€at€HenryÏCounty€Medical€Center.€€She€observed€redness€at€the€opening€to€the€vagina,Ïbut€€the€hymen€was€intact.€€She€reported€that€this€was€consistent€with€sexualÏabuse.€€The€police€and€œa€Department›€of€Human€Services€worker€interviewedÏthe€victim.€€At€the€police€station,€B.€was€shown€a€photo€array€which€includedÏthe€Defendant.€€When€asked€to€indicate€if€one€of€the€six€subjects€in€theÏphotographs€was€the€man€in€her€room,€she€identified€the€Defendant.ÌÌà àThe€Defendant€presents€one€issue€on€appeal,€that€the€evidence€wasÏinsufficient€to€support€his€conviction€beyond€a€reasonable€doubt.€€When€anÍaccused€challenges€the€sufficiency€of€the€convicting€evidence,€the€standard€isÏwhether,€after€reviewing€the€evidence€in€the€light€most€favorable€to€theÏprosecution,€any€rational€trier€of€fact€could€have€found€the€essential€elements€ofÏthe€crime€beyond€a€reasonable€doubt.€€òòJackson€v.€Virginiaóó,€443€U.S.€307,€319Ï(1979).€€Questions€concerning€the€credibility€of€the€witnesses,€the€weight€andÏvalue€to€be€given€the€evidence,€as€well€as€all€factual€issues€raised€by€theÏevidence,€are€resolved€by€the€trier€of€fact,€not€this€court.€€òòState€v.€Pappasóó,€754ÏS.W.2d€620,€623€(Tenn.€Crim.€App.),€òòpermóó.€òòtoóó€òòappealóó€òòdeniedóó,€òòidóó.€(Tenn.€1987).€ÏNor€may€this€court€reweigh€or€reevaluate€the€evidence.€€òòState€v.€Cabbageóó,€571ÏS.W.2d€832,€835€(Tenn.€1978).€€ÌÌà àThe€Defendant€asserts€that€inconsistencies€in€testimony€by€the€StateððsÏwitnesses€preclude€a€showing€of€sufficient€evidence€to€support€the€conviction.€ÏThe€Defendant€first€notes€that€the€physician€testified€that€vaginal€redness€mayÏhave€other€causes.€€He€contends€that€the€light€in€the€room€was€dim€and€that€theÏother€children€did€not€wake€up,€and€that€the€victim€went€back€to€sleep.€ÏœTherefore,€he€argues€that€the›€victim€œcould€have€been›€mistaken€or€dreaming.€€HeÏcontends€that€there€was€a€lack€of€physical€evidence€collected€at€the€scene.€ÏFinally,€he€contends€that€although€the€victim€testified€that€the€Defendant€wore€aÏT„shirt€and€jeans,€her€mother€stated€that€her€daughter€could€not€describe€whatÏhe€was€wearing.ÌÌà àThe€œevidence,€viewed€in€the€light€most€favorable€to€the€state,›€shows€thatÏthe€Defendant€broke€into€the€Krezinski€home€and€fondled€the€victim.€€AnÏaggravated€sexual€battery€occurs€with€unlawful€sexual€contact€with€a€victim€byÏthe€defendant€when€the€victim€is€less€than€thirteen€years€old.€€œTenn.€Code€Ann.Ïðð€39„13„504(a)(4).›€€In€the€case€òòsubóó€òòjudiceóó,€the€victim€was€ten€years€old€whenÏthe€battery€occurred.€€She€testified€that€she€woke€up€with€a€man€touching€herÏgenitals.€€The€description€she€gave€of€the€perpetratorððs€hairstyle€was€like€theÏDefendantððs€hairstyle.€€The€Defendant€had€recently€been€inside€the€KrezinskiÏhome€and€had€used€the€back€door.€€One€of€the€Krezinski€children,€Theresa,€hasÏa€œname›€œwhich€sounds€similar€to›€ð ðTaraðð,€the€name€the€Defendant€said€to€theÍvictim.€€There€is€direct€evidence€that€the€victim€saw€a€man€fitting€the€DefendantððsÏdescription€œstanding€by›€her€bed.€€The€victim€had€seen€the€Defendant€on€a€priorÏoccasion€and€identified€him€from€a€photo€lineup.€€œShe€also€identified€theÏDefendant€in€court€as€the€man€standing€by€her€bed.€€Another€witness€placedÏthe€Defendant€within€one€block€of€the€crime€scene€at€about€the€time€of€the€crime.€ÏAlthough›€other€causes€were€possible,€the€redness€in€the€vaginal€area€wasÏconsistent€with€sexual€abuse€and€with€the€victimððs€testimony.€€There€is€sufficientÏevidence€to€support€each€element€of€aggravated€sexual€battery.ÌÌà àAn€aggravated€burglary€is€committed€when€one€enters€a€habitationÏwithout€the€effective€consent€of€the€owner,€with€the€intent€to€commit€a€felony,Ïtheft€or€assault.€€Tenn.€Code.€Ann.€ðð€39„14„402,€39„14„403,€39„14„401(1)(A),(3).€€ÏIn€this€case,€the€ð ðownerðð€of€the€home€was€Ms.€Krezinski,€who€leased€theÏhouse.€€She€testified€that€she€did€not€give€consent€to€the€Defendant€to€be€in€herÏhome.€€The€lock€that€was€torn€from€the€door€œindicates›€a€forced€entry.€€The€victimÏsaw€the€Defendant€in€the€bedroom€on€the€morning€of€July€12,€1994,€sometimeÏœbetween›€approximately€5:51€a.m.€and€approximately€6:00€a.m.€€Although€theÏDefendant€œclaimed›€he€was€with€his€girlfriend€at€that€time,€œno€evidence€wasÏpresented€to›€corroborate€his€alibi.€€Wanda€Lee€testified€that€the€Defendant€cameÏto€her€house€around€6:00€a.m€that€morning.€€She€stated€that€he€had€been€to€herÏhome€many€times,€but€it€was€very€unusual€for€him€to€be€there€so€early.€€Ms.ÍLeeððs€home€at€the€time€of€the€incident€was€on€Brewer€Street,€one€street€overÏfrom€Poplar€and€the€Krezinski€home.€€There€is€œsufficient›€evidence€to€support€aÏconviction€of€aggravated€burglary.ÌÌà àThe€jury€obviously€accredited€the€testimony€of€the€Stateððs€witnesses€andÏresolved€any€conflicts€in€the€œproof€in€the€stateððs€favor.›€€In€viewing€the€evidence€inÏthe€light€most€favorable€to€the€State,€we€cannot€œconclude€that›€the€evidenceÏdoes€not€support€the€juryððs€verdict.€€We€conclude€that€the€elements€of€the€crimesÏof€aggravated€burglary€and€aggravated€sexual€battery€could€have€been€foundÏbeyond€a€reasonable€doubt€and€that€the€evidence€is€sufficient€to€uphold€theÏjuryððs€verdict€on€both€counts.€ÌÌà
